Remedial response actions were conducted to mitigate environmental and human health hazards associated with the sudden release of an estimated 40 gallons of diesel fuel from a transportation accident involving a Bortolotti Construction vehicle on November 8, 2002, as constituting a 2-hour release condition. ' This report provides technical rationale and justification in support of a Class A-2,Response Action Outcome(RAO) Statement in accordance with the Massachusetts Contingency Plan(MCP) 310 CMR, Section 40.1036(2). The excavation of some 17.71 tons of contaminated soils to a depth ' of 2' (+/-) below ground surface (bgs), has effectively eliminated the source of diesel fuel contamination as having infiltrated to underlying soils and mitigated environmental impact. Laboratory results of petroleum,concentrations in soil samples collected at the extent of excavation demonstrate a condition of"No Significant Risk" for human exposures and environmental hazards in accordance with 310 CMR 4B.0970 and 40.0980. As such,a permanent solution has been achieved in support of regulatory closure within the initial 60 day statutory deadline. 1 ' DECEMBER 30,2002 BORTOLOTTI CONSTRUCTION/299 WHEELER ROAD[RTN 4-1 746 711BO02-3599 PAGE 2 OF 7 IRA COMPLETION/CLASS A-2 RAO This work has proceeded under my supervision in a manner consistent with the MCP Response Action Performance Standards, pursuant to 310 CMR 40.0191 and QA/QC policies of ' BENNETT & O'REILLY, INC. The facts and statements herein are,to the best of my knowledge, a true and accurate representation of the site activities,remedial response actions and environmental conditions associated with the project. ENVIRONMENTAL CONDITIONS [Refer to Appendix A] The roadside on the property of 299 Wheeler Road(herein referred to as the site), is shown as Parcel 04,on Assessor's Map 82. The site is located in a low lying area between Mystic Lake and Middle Pond within the buffer zone for the bordering vegetated wetland with shallow groundwater within 6'of grade at the bottom of the hill. [Refer to Figure 1]. The subject site is undeveloped land. The neighborhood and surrounding area is largely developed, as comprising of residences. Wheeler Road is a private road in a residentidr neighborhood with unrestricted access to the site. Review of USGS topographic maps and regional groundwater contours indicate a southeasterly flow direction toward Middle Pond [Refer to Figure 2]. Municipal water service is available at the site and surrounding area. There are known potable wells within 200' of the subject property. The property does not fall within the Zone II Protective Radius for any public water supply or in the Zone A Protection Zone for any surface reservoir. The property is approximately 50% t upland and 50% wetland. The nearest surface water body is Mystic lake located west of the site. The MA DEP, BWSC overlay for the GIS mapping program shows the area as within a potentially productive high yield aquifer. [Refer to Figure 3]. Based on site conditions releative to residential setting, shallow groundwater within the buffer zone for the bordering vegetated wetland ' with shallow groundwater and presence of private wells in potential drinking water source area (PDWSA),the RCS-1 and RCGW-1 Reportable Concentration/Quantities are applicable to Release Notification criteria and the S-1/GW-1, GW-2, GW-3 criteria for Method 1 Risk Characterization to potential ingestion,inhalation and direct contact exposures to identified human and environmental receptors. BACKGROUND [Refer To Appendix B] On November 8, 2002 the driver of a Bortolotti construction vehicle lost its cargo of one texcavator off of the side of a low body trailer that jack knifed due to failing brakes causing the excavator roll off and over releasing diesel fuel from its tank. When the excavator came to a rest the I released diesel fuel ran along the roadside protected by a"Cape Cod Berm" for 150' to a low spot where the fuel impacted soils in a 50' long section of roadside that was not protected by the berm. The Barnstable (COMM) Fire Department applied sorbent materials and bermed soil on arrival in an effort to limit soil contamination. EnviroSafe Corporation was contacted to make an emergency response to the release. As directed by the Barnstable (COMM) Fire Department DECEMBER 30,2002 BORTOLOTTI CONSTRUCTION/299 WHEELER ROAD[RTN 4-17467]BO02-3599 PAGE 3 OF 7 IRA COMPLETION/CLASS A-2 RAO EnviroSafe Corporation applied additional sorbent materials to the road and roadside. BENNETT & O'REILLY, INC., personnel (David C. Bennett, LSP) arrived on site as requested by Bortolotti Construction through the emergency response contractor. ENVIROSAFE Corporation personnel . ' was already drumming the spent sorbent materials. As requested by BENNETT&O'REILLY,INC., the 50' section at the bottom of the hill where soil was impacted,was capped with poly sheeting and bermed with dirt to seal against receiving storm water runoff or rainfall infiltration as could exacerbate environmental conditions to environmental receptors identified. A meeting was conducted with the MA DEP (SERO), BWSC/ERS (Joe Leary), Bortolotti Foreman (John Norman),and BENNETT & O'REILLY, INC. (David C. Bennett, LSP) to dicuss issues of proposed response actions in area of impact to earthen shoulder and in the area of voids in asphalt paving at the base of the hill. Due to traffic safety and private ownership issues,jurisdiction of conservation in a resource area and night fall, further Remedial Response Activities were postponed pending approvals and ! traffic control. PRELIMINARY RESPONSE [Refer to Appendix B] ' On November 11 2002 BENNETT & O'REILLY, INC., personnel made inquiries at the P q Barnstable Town Hall to identify the property owner of 299 Wheeler Road as Wilfred Wheeler - rTrust, Richard Wheeler - Trustee. Mr. Wheeler was contacted to advise him of the release details and to secure access authorization to perform remedial response actions on private property. Contact was also made to Neal Andres - Barnstable Highway Department, Rob Gatewood - Conservation ' Commission, and David McKearney, Board of Health to set up the November 12, 2002 on site meeting to resolve any jurisdictional issues to facilitate an Immediate Resopnse Action with the cutting of pavement for environmental assessment in conjunction with soil removal operations. Access and conservation commission approvals were granted and the MADEP(SERO)[Andy Jones- BWSC/ERS] was contacted for verbal authorization of an IRA to excavate contaminated soils with ' disposal at a local licensed asphalt batching facility. Such approval was granted on November 12, 2002 and the environmental contractor was scheduled with a police detail. REMEDIAL RESPONSE ACTIONS [Refer to Appendix B and Appendix C] On November 18, 2002 BENNETT & O'REILLY, INC., personnel returned to the site to provide technical assistance,inspect,and document soil removal activities conducted by Envirosafe Corporation. Asphalt in the area of soil impact was removed for the purpose of excavating beneath that section of roadway where penetration and roadway runoff occurred. Hand digging was required during the initial excavation to locate a buried gas line marked out by dig safe in the area of impact. Soil samples were collected at I Y intervals along the side walls and base of the excavation during the procedure. Field screening forlotal organic vapor (TOV) was conducted with a photoionization ' detector (PID) by "jar headspace" analysis. A Dexsil PetroFLAG field test for TPH was run on a "worst case" sample (S2: 0-2, TOV= 6.2 ppm) resulting in a TPH concentration of 48 ppm which is well under the Method-1 Risk Characterization S-1/GW-1 standard of 200 ppm. Due-to traffic ' safety and wetland resource issues ENVIROSAFE Corporation,personnel was instructed to baclffill and compact the trench to grade for future re-paving of the roadside. Confirmatory samples from the trench were packaged,preserved in the field, labeled, and transported under chain of custody to ' Groundwater Analytical, Inc., P.O. Box1200, 228 Main Street, Buzzards Bay, MA., 02532, for f DECEMBER 30.2002 BORTOLOTTI CONSTRUCTION/299 WHEELER ROAD[RTN 4-174671/BO02-3599 PAGE 4 OF 7 IRA COMPLETION/CLASS A-2 RAO extractable/volatile petroleum hydrocarbon (E/VPH) and total petroleum hydrocarbon (TPH) analysis. ' On December 5, 2002 BENNETT & O'REILLY, INC., received laboratory analysis qualifying the samples taken as below the applicable Method 1-Risk Characterization Standards for the applicable S-1/GW-1, GW-2, and GW-3 soils. These analysis reported fractional Extractable Petroleum Hydrocarbons (EPH), Volatile Petroleum Hydrocarbons (VPH) and Total Petroleum Hydrocarbons (TPH) at low level concentration or as Below Reporting Limits (BRL) of the laboratory method used. All target analytes were reported as BRL. Results of laboratory analysis ' are summarized in Tables 1, 2 and 3. Additionally, target analytes in the biased"worst case" samples were all reported as below applicable and restrictive S-1/GW-1, GW-2 and GW-3 standards. As such,laboratory analysis of soil samples at the extent of excavation represent a condition of"No Significant Risk"to ingestion, inhalation or direct contact exposures, and potentially leaching to groundwater or any environmental receptor. Low level residual soil impact was reported significantly below the S- 1/GW-1, GW-2, and GW-3 Method 1 -Risk Characterization standards on the sidewalls and the base at approximately 2'. With ground water projected at 6+/-below glade surface and a discreet vertical extent of any reportable soil impact defined within 2' of the ground surface, no potential for groundwater impact was considered as part of the Immediate.Response Action. As such, no groundwater analysis was undertaken or deemed necessary in support of the Class A-2 Response r Action Outcome without any Activity or Use Limitation in support of project closure. ' A review of costs and feasibility to meet background conditions has been considered against traffic control, worker safety issues and further disturbance to the wetland. With isolated low-level residual impact within the excavation approaching background conditions, it is not cost effective or necessary to. incur any further excavation costs to bring residual levels down to background conditions. The level of"No Significant Risk"has been achieved for the appropriate S-1/GW-1,GW- 3 Method 1- Risk Characterization standards without an access and use limitation (AUL). A good portion of the residual contamination will be covered by a new layer of asphalt separating it from potential human exposure and protecting against potential leaching to the nearby ground and surface water. As such further actions to reduce the remaining levels of soil impact to background levels are ' considered unnecessary while levels in support of a Class A-2 Response Action Outcome without any Activity or Use Limitation in support of project closure have been achieved. ' CONCLUSIONS Based on Method l-Risk Characterization showing conditions of"No Significant Risk" for ' all activities and uses of the roadside area at 299 Wheeler Road, as associated with soil conditions at the extent of excavation, it is apparent that the use of some 6 drums of absorbent materials and removal of some 17.71 tons of contaminated soil has mitigated significant impact to the environment ' and risk to human receptors. Laboratory analysis indicates that the appropriate Method 1-Risk Characterization Standards for S-1/GW-1, GW-3 soils has been met, indicating a level of"No Significant Risk" has been achieved. As such, a permanent solution has been achieved and a Class A-2 Response Action Outcome(RAO)without an Activities and Use Limitation(AUL)is applicable for the closure of this project, in accordance with the provisions of 310 CMR 40.1036. ' The findings of this investigation, as represented herein, set forth the rationale and technical justifications for the LSP opinions offered, as established by the certifications made on the attached Transmittal Forms. The LSP opinions are based on the available data and regulations in effect at the ' time of this reporting. Area of release is not in a Zone II IWPA for any municipal water supply well or within any Zone A for surface water reservoir. • The release occurred in a low lying area between Mystic Lake and Middle Pond within the buffer zone for the bordering vegetated wetland with shallow groundwater within 6'of grade ' at the bottom of the hill. • The area of the release is on a private road in a residential neighborhood with unrestricted access. Based on site conditions relative to residential setting, shallow groundwater and ' presence of private wells in a PDWSA,the RCS-1 Reportable Concentration/Quantities are applicable to Release Notification criteria and the S-1/GW-1, GW-2 and GW-3 criteria for Method 1 Risk Characterization to potential ingestion,inhalation and direct contact exposures to identified human and environmental receptors. I responded in 321 along with rescue 321 and engine 305. Upon arrival we found a ten wheel tractor with a 10,0001b flat bed trailer that had jack-knifed on a steep grade and the excavator that had been on the trailer had tipped over across Wheeler Rd. There was a small diesel spill of approximately 15 gallons that was quickly contained.There were no injuries so our duties consisted of safety coverage until the excavator was righted by a crane. Some 30-40 gallons of diesel fuel was released onto the roadway on November 8th. Absorbent pads and speedi dry were applied by the Fire Department when they arrived on the scene. Diesel fuel did however travel along the pavement and down the hill from the area of release to a low spot as shown in the attached photos. Along approximately 50'of roadway, no curbing existed as allowing the diesel to infiltrate into the adjacent soils. From inspection of the area, the degree of infiltration seems to be minor and localized to a T wide area to a depth of between 6"to 2'. the area of soil impact has been capped with poly sheeting to advert any further exacerbation of environmental conditions while approvals are sought. I have flagged the limit of work for your reference. We have requested, and have received authorization from the MA DEP, for the removal of contaminated soils within this 50' (L)x Y(W) x 2' (D) area along the edge of the roadway. The Barnstable Highway Department has provided roadway construction guidance for the restoration of the area and the property owner, abutting this section of the private road has been contacted for access and authorization of such work which is tentatively scheduled for Monday, November 18th. This work would be completed in a day with the contaminated soils loaded directly into roll-off container for temporary storage at the Bortolotti facility and the area of excavation backfilled and compacted as prepared for paving. The paving the roadway would take place the following day. We would be prepared to install a silt barrier around the limit of work with staked hay bails. Quality Control protocols include written Standard Operating Procedures (SOPS) developed for each analytical method. SOPs are derived from US EPA methodologies and other established references. Standards are prepared from commercially obtained reference materials of certified purity, and documented ' for traceability. Quality Assessment protocols for most organic analyses include a minimum of one laboratory control sample, one method blank, one matrix spike sample, and one sample duplicate for each sample preparation batch. All samples, standards, blanks, laboratory control samples, matrix spikes and sample duplicates are spiked with internal standards and surrogate compounds. The MCP requires that a fee of$750.00 be submitted to the Department when an RAO statement is filed greater than 120 days from the date of initial notification. Specific approval is required from the Department for the implementation of all IRAs, and Release Abatement Measures (RAMS)pursuant to 310 CMR 40.0420 and 31:0 CMR 40.0443, respectively. Assessment activities, the construction of a fence and/or the posting of signs are actions that are exempt from this approval requirement.
