The following conditions must be met: The developer must provide Town water to each and every lot in subdivision. Each septic system shall be located within the prescribed boundaries of each individual lot. The developer' s engineer must certify, in writing, to the Board that the installation of private sewage systems on each lot will not adversely affect surface or sub-surface public or private water resources of (1) all lots in subdivision; (2 ) the adjacent land (whether developed or not) ; (3) a defined aquifer recharge area. r In addition, the developer must comply with all recommendations of the Conservation Commission. A percolation test must be made on each lot, at leaching site, before a building permit will be issued. Each proposed septic system must conform strictly to 310 CMR 15.00, the State Environmental Code, Title 5, and Town of Barnstable Rules and Regulations. My understanding is that Board of Health conditions must, by law, be made conditions of Planning Board approval of subdivisions. Ch. 131, S. 40, the BARNSTABLE CONSERVATION COMMIS- SION has considered your Notice of Intent and plans submitted therewith, and has determined that the area on which the proposed work is to be done is significant to one or more of the interests described in the said Act. The BARNSTABLE CONSERVATION COMMISSION hereby orders that the following conditions are necessary to protect said interests and all work shall be performed in strict accordance with them and with the Notice of Intent and plans identified above except where such plans are modified by said conditions. CONDITIONS: 1. Failure to comply -,A-ith all conditions stated herein, and with all related statutes and other regula- tory measures, shall be deemed cause to revoke or modify this Order. ?. This Order does not grant any property rights or any exclusive privileges; it does not authorize any injury to private property or invasion of private rights. 3. This Order does not relieve the permittee or any other person of the necessity of complying with all other applicable federal, state, or local statutes, ordinances, by-laws and/or regulations. 4. The cork authorized hereunder shall be completed within one (1) year from the date of this Order unless it is for a maintenance dredging project subject to Section 5 (9). The Order may be extended by the issuing authority for one or more additional one-year periods upon application to the said issuing authority at least thirty (30) days prior to the expiration date of the Order or its extension. Any fill used in connection with this project shall be clean fill, containing no trash, refuse, rubbish or debris, including, without limiting the generality of the foregoing: lumber, bricks, plaster, wire, lath, paper, tires, ashes, refrigerators, motor vehicles or parts of any of the fore- going. G. No work may be commenced until all appeal periods have elapsed from the Order of the Con- servation Commission or from a final Order by the Department of Environmental Quality En- gineering. 7. No work shall be undertaken until the Final Order, with respect to the proposed project, has been recorded in the Registry of Deeds for the District in which the land is located within the chain of title of the affected property. The Document number indicating such recording shall be submitted on the form at the end of this order to the issuer of this Order prior to commence- ment of work. 8. A sign shall be displayed at the site not less than two square feet or more than three square feet bearing tthe ords: "Massachusetts Department of Environmental Quality Engineering. Number ...S ..._3.-68 copy of this Order shall be available at the site. and a 9. Where the Department of Environmental Quality Engineering is requested to make a determin- ation and to issue a superseding Order, the Conservation Commission shall be a party to all agency proceedings and hearings before the Department. 10. Prior to any work being done at the site, all legal advertising bills incurred by the petitioner in relation to the Wetlands Hearing held on this project shall be paid. 11. Notice shall be given to the Barnstable Conservation Commission or Conservation Officer no more than two weeks nor less than two days prior to the commencement of the work. 12.The foilowirig"lots--will reduire separate Wetlands Hearings under M.G.L. Ch 131 sec 40 and Article XXVIII of the Town of Barnstable By-laws and any other applicable statutes, for any alterations thereon within 100 feet of a wetland including, but not limited to filling, excavating, landscaping, residential construction, and s on-site septic disposal: Lots 1,2,6,7,9-14 inclusive, 17-36 inclusive; 47-61 inclusive, 63-67 inclusive, 69-80 inclusive, and 81 (Common 'Lot) for any further alteration than shown on the herein-cited plan. 13.All roadway drainage shall be .self-contained .and properly maintained to assure _ continued proper functioning, Overflow pipes shall be provided to handle a minizqum 20-year storm. Drainage calculations shall be provided to the Barnstable Conserva,- tion Commission and the Barnstable Engineering Department for approval prior to construction. 14.The Barnstable Conservation Commission shall be provided with erosion prevention plans for the time during and subsequent to construction, and no road work shall be undertaken until said plans are approved, in writing, by the Barnstable Conserva- tion Commission. A copy of said plans and/or specifications shall be provided to the Barnstable Engineering Department, and shall include as a minimum: a: Staked hay bales for all filled areas adjacent to wetlands. b. A planting plan for all embankments, including the provision of a suitable planting medium and methods of preventing erosion until the vegetation is established. 15.The Barnstable Conservation Commission shall be provided with cross sections of the roadway for areas A, B, C, D and E, on the herein-cited plans, incorporating side slopes not to exceed 2:1, and retaining walls as necessary to maintain the slope requirement. Said cross sections must be drawn and stamped by .a registered civil engineer, and no road work shall be undertaken until they are approved, in writing by the Conservation Commission. 16.Retaining walls used in conjunction with roadway construction shall not be treated with a preservative that might leach into the cranberry bogs. 17.The centerline of the roadway and limit of fill shall be marked, and the Conserva- tion Commission notified at least 48 hours prior to the commencement of any work at the site. No road work shall begin until the centerline location has been approved by the Conservation Commission or their agent. CONDITIONS CONTINUED FILE NUMBER SE 3-689 18.Filling of area E (an isolated .wetland under the Act) shall be allowed as necessary for roadway construction. Dumped debris now present in this area shall be removed off site to a location not. subject to state and local wetlands statutes, 19.Filling for tennis courts shall be allowed as per plan #3, Common Lot, Whistle- berry: Proposed Site Plan, contingent upon submission of the following material to the Conservation Commission for approval prior to construction; a. a detailed layout/grading plan b, cross section . c, erosion prevention plan 20.No road construction machinery shall be allowed on a bog at any time during construction. 21.Construction for this project shall be designed to maintain the existing drainage flow through the site and shall in no way interfere with the normal operation .and: maintenance of cranberry bogs and herring run. All existing flow control structures shall be maintained or replaced with equivalent structures with the invert at the same elevation. 22.The project shall be inspected by the Conservation Commission or their agent during construction and six months following completion, The petitioner shall be held liable to correct erosion or other negative impact on wetlands that may have occurred as a result of this project. 23.All disturbed areas are to be revegetated following construction. Areas stripped of vegetation during construction may NOT be left uevegetated or unmulched for more than 60 days, unless other erosion control measures have been provided for herein.. _ 24.Immediately following completion, the project shall be certified to be as per these conditions and plans, in writing, to the Barnstable Conservation Commission by the project Engineer who shall be registered in the state of Massachusetts. Upon certification by the project Engineer, the applicant shall forthwith request, in writing, that a Certificate of Compliance be issued stating that the work has been satisfactorily completed. 25.Work shall also conform to Order issued under Article XXVIII of the Town of Barnstable By--Laws.. i CONDITIONS CONTINUED FILE NUMBER .....
