Said lots are also shown on Barnstable Assessor's Map 103 as Parcel 29 (hereinafter called "the exempted lot'). The exempted lot contains .96 acre Present Owners Lithuanian Foundation, Inc. Date Acquired October 26, 2001 Date Recorded December 5, 2001 Title Reference Book 14531, Page 193 The following 4 lots are contiguous to Parcel 29 as shown on Assessor's Map 103: Parcel 28 Shown as lots 65 & 66 on aforementioned plan, are currently owned by Francis R.Ledoux&Denise A.Ledoux title by deed dated October 23, 1984 as recorded in Book 4307, Page 287 with said Deeds. In 1960, when both lots 67 and 68 (exempted lot) were created by the aforementioned plan, they were designated as being located within Residential RD-2 zone and required a minimum of 10,000 square feet, 100 foot width with a minimum of 20 feet frontage. In 1969 the exempted lot was still designated in a RD-2 zone which now required a minimum of 20,000 square feet with 125 feet frontage. Therefore in 1969 both lots 67 and 68 were still separate, conforming building lots. In 1978 the property was changed by Article 9 of the Zoning Bylaws to RF zone requiring 43,560 square feet in area. Since lots 67 and 68 were in common ownership, and the 5 year period has expired, the lots were merged into one building lot which was nonconforming. I hereby certify that, according to the records of the Barnstable Registry of Deeds that as of the date of the zoning change that made the exempted lot nonconforming on 1978 by requiring one acre minimum,the exempted lot was not held in common with any abutting lots at the time of the zoning change and has remained in separate ownership since November 8, 1967. As of October 26, 2000, the date in which the RPOD (Resource Protection Overlay District) was adopted and created by Section 3-5.3, requiring a new minimum lot area of 87,120 square feet, the exempted lot was located in a designated Residential F zone which on that date required a minimum of 43,560 square feet with a minimum of 150 feet frontage. The exempted lot has an area 41,600 square feet, and fronts on Willington Avenue 260.00 feet. On that same day,the Town Council adopted a new paragraph 6 to Section 4-4.2,Non-Conforming Lots which states:"Any increase in area,frontage,width,yard or depth requirements of the Resource Protection Overlay District shall not apply to a lot for single or two-family residential use which immediately prior to(on the effective date of this ordinance)was protected from the applicable bulk requirements of the Zoning Ordinance by the provisions of Section 4-4.2 (1), (2), (3), (4), or(5) of the Zoning Ordinance. I hereby certify that,according to the records of the Barnstable Registry of Deeds,that as of the date of the zoning change that made the exempted lot nonconforming on October 26,2000,by requiring a two acre minimum lot area, the exempted lot was already a nonconforming lot protected by Section 4-4.2 (1) and the exempted lot was not held in common with any abutting lots at the time of the zoning change and has remained in separate ownership since November 8, 1967. I am enclosing a chain of title for the exempted lot and each of the four contiguous parcels along with copies of the deeds in each chain of title for your review. It is my opinion that since the nonconforming,exempted lot meets the requirements of Section 4-4.2 Nonconforming Lots, of the Zoning Ordinances of the Town of Barnstable, and A) was not held in common ownership with any adjoining land since November 8, 1967 and B) has a minimum of 5,000 square feet(actually has 41,600 square feet)of area and 50 feet frontage (actually has 260 feet); and C) conformed to the existing zoning bulk requirements in 1960 and again when it was conveyed in 1967, when both parcels were owned by the same person; and D) was separately owned at the time of every subsequent zoning change,beginning in 1978, which made it nonconforming; and E) since the protection afforded by paragraph 6 to Section 4-4.2,Non-conforming Lots which are protected from the applicable bulk requirements of the Zoning Ordinance by the provisions of Section 4-4.2, is permanent; it is therefore grandfathered, should be considered a legal, nonconforming, building lot, and a building permit should be allowed for a single family residence.
