Dear Mr. Fogelgren:
The Board of Health has reviewed the preliminary open space subdivision plan in West
Barnstable, and makes the following recommendations:
Each septic system shall be located within the prescribed boundaries of each individual
lot.
The developer must submit a copy of a master plan to the Board showing the locations
of the proposed and existing wells, and septic systems throughout the subdivision prior
to issuance of any building permits.
Building permits will not be approved by the Board of Health on individual lots until the
well is installed and certification submitted as to the bacteriological and mineral content
of the water by a State Approved Laboratory. The water must meet all of the standards
established by the Safe Drinking Act of 1974, revised 1986 and all the standards of the
Board of Health's Private Well Regulation effective June 1, 1989.
The developer shall have recorded on the deed that no variances from Title 5, Minimum
Requirements for the Subsurface Disposal of Sanitary Sewage, and the Town of Barnstable
Health Regulations will be granted on any lot in this subdivision.
A percolation test must be made on each lot, at each leaching site, before a Disposal
Works Construction Permit will be issued. Maximum ground water elevations must be
determined by using data available from the United States Geological Survey - Probable
High Ground Water Levels on Cape Cod, Mass. Each proposed septic system must conform
strictly to 310 CMR 15.00, the State Environmental Code, Title 5, and Town of Barnstable
Rules and Regulations.
All tree stumps, brush and building debris removed when clearing lots or roads must be
disposed of at a licensed solid waste disposal facility. Chipping brush and tree stumps
is an acceptable alternative. Burial on site is prohibited.
The applicant must receive an Order of Conditions from the Conservation Commission,
if applicable.
The Board of Health recommends that all drainage be contained on site at each lot.
Proposed private water supply wells shall be constructed at least 100 feet from the railroad
right-of-way due to herbicide spraying. The developer shall have recorded on the deed
that underground fuel and chemical storage tanks cannot be installed or maintained on
property within this subdivision.
Prior to Board of Health approval of each building permit, the sewage system and water
supply must conform to 310 CMR 15.00, the State Environmental Code, Title 5, and Town
Health Regulations.

Bamstable's Designated Scenic Roads
Designated Scenic Roads
In 1983 the town,through the enactment of General Ordinance Ch.11l,Article XU
"Scenic Roads"implemented the 1973 Massachusetts Scenic Roads Act in
Barnstable. This Ordinance allows for identification,nomination and designation
of certain roadways as having special characteristics and deserving of protection
as Scenic Roads. To date the town has designated fifty-six(56)roadways,
totaling 91.38 miles,as Scenic Roads. This represents 18.9 percent of the total
1 Service Road 482.3 miles of roadways within the town.
2 Cedar Street The Scenic Roadways vary in length,the shortest is Old Shore Road measuring
3 High Street only 1,500 feet in length;the longest is that portion of Rte 6A,the historic Old
4 Maple Street King's Highway,that is within the Town of Barnstable,measuring 8.43 miles.
Willow Street Recently designated by an act of the State Legislature,the Old King's Highway

is one of the original Native American trails traversing the length of Cape Cod.
Many of Barnstable's Scenic Roads date back to a network of trails and paths
7 Church Street created by local Indian inhabitants,others were cart ways that linked the first
8 Pine Street,W. Barnstable settlers to each other and to the sea.
9 Parker Road
10 Plum Street Today,these roads not only represent attractive and historically important ways
11 Oak Street within the town,but also provide vital links to open space,historical sites and
12 Old Neck Road conservation lands. Travel along the Scenic Roads presents a capsule of the
13 Aunt Hatch's Lane 350 year history of Barnstable and a field trip through a rich and varied natural
14 Pine Lane environment.
15 Phinney's Lane Town Article XLI"Scenic Roads"authorizes the Planning Board,Conservation
16 Hyannis Road Commission, Historical Commission or Old King's Highway Regional Historic
17 Mill Way District Commission to nominate a road as a Scenic Road. The Town Council,
18 Commerce Road by majority vote,is responsible for designation. The designation allows for the
19 Keveney Lane preservation of the scenic qualities of the roadways,such as stone walls,trees,
20 Mary Dunn Road bridge pylons and road markers. It requires Planning Board approval for all
21 Lewis Bay Road construction, improvements and removal activities within the public right-of-way
22 Sea Street of any designated Scenic Road except Rte 6A which is under the jurisdiction of
23 Scudder Avenue the Old King's Highway Regional Historic District Commission. Activities
24 Craigville Beach Road permitted within the public way of a Scenic Road are those which:
25 South Main Street 1. preserve historic values;
26 Pine Street, Hyannis&Centerville 2. preserve scenic and aesthetic qualities;
27 Main Street, Centerville 3. protect natural resource and environment;
28 Old Post Road, Centerville 4. are necessary for public safety; and
