Dear Mr. Mahler:
You are granted a variance to install an onsite sewage disposal leaching pit
115 feet from the proposed onsite well, in lieu of the required 150 feet, on
your property at Lot 30 Crocker Road, West Barnstable, with the following
conditions:
(1) All other regulations contained in Title 5: of the State Environmental
Code and Town Health Regulations must be complied with.
(2) The well water must be tested bacteriologically, chemically, and for
volatile:organics prior to the issuance of a building permit. The water
must meet all of the standards established by the Safe Drinking Act
of 1974, revised 1986, and of all the Town of Barnstable Board of Health
Private Well Regulations effective June 1, 1989.
(3) The dwelling cannot contain more than three (3) bedrooms. Dens, study
rooms, playrooms, enclosed porches, sleeping lofts, finished cellars and
similar type rooms are considered bedrooms according to the Department
of Environmental Protection.
(4) The system must be installed in strict accordance to the submitted plans
dated August 24, 1989. .
(5) The designing engineer shall supervise the installation of the onsite sewage
disposal system and shall certify in writing to the Board the system was
installed in strict accordance to the submitted plan.
(6) The onsite sewage disposal system shall be pumped at least once every
three (3) years and certification of the pumping submitted to the Board
by'a licensed septage hauler.
The variance expires October 1, 19�0.

Dear Board Members:
On behalf of our client,. Mr, Richard Mahler, we hereby
request a variance from the Board of Health regulation
requiring a distance of 150 feet between a well and a
septic system leaching facility.
. Enclosed are two copies of the proposed septic system design.
Test pits 1 & 2 -were excavated at the only location on the
lot where the 150 feet setback criteria can be met from all
wells, both existing and proposed. These test pits revealed
at least 12 feet of fill, including buried stumps, tree
branches , boulders and silty soil .
Test pits 3 & 4. were made in an area located at least 150
feet from all existing wells, but closer than 150 feet
to the proposed well on Lot 30. This location was chosen to
try to locate a proposed septic leaching facility outside
the filled area on the lot, which is suspected to cover a
portion of the rear of Lot 30:
Based upon the enclosed septic system design, a setback
variance of 35 feet is requested to locate the proposed septic
leaching reserve area 115 feet from the proposed well on
Lot 30. The proposed septic leaching facility is located
123 feet from the proposed well and will require a setback
variance of 27 feet.

LEGAL NOTICE
In accordance with the provisions of Section 31 and Section 127A of
Chapter 111, of the General Laws, Regulation 2, of Article I and
Regulation 3, of Article XI, of the Sanitary Code of the Commonwealth of
Massachusetts, and for the protection of the Public Health, the Town of
Barnstable Board of Health adopts the following regulation:
The installation of a private water supply and a private sewage
disposal system on a lot containing an area less than 40,000 square feet
of buildable land is prohibited and in no case shall a private water
supply and a private sewage disposal system be located within 150 feet
of each other.
Variance to this regulation may be granted by the Board of Health,
after a hearing, during which the applicant proves that the installation
of the private sewage disposal system will not adversely affect surface
or sub-surface public or private water resources of:
1) The lot subject to the application
2) The adjacent land (whether developed or not) or
3) A defined aquifer recharge area
In granting variances, the Board will take into consideration
population density of the area, the size and shape of the lot slope
the suitability of the soil for drainage and percolation, existing and
known future water supplies, depth to ground water and impervious material
and area reserved for expansion of sewage system and relocation of water
supply in case of failure.
This regulation takes effect on the date following publication, but
does not apply to preliminary or definitive sub-division plans filed
prior to publication. After publication this regulation supercedes the
previous 40,000 square foot regulation whi ent into effect April 12,
1974.
