Reardon, Chair-man The Board of Health wishes to express their concern in relation to the Meetinghouse subdivision in West Barnstable. We were pleased to hear hhat your Board is taking advantage of the tools you have to work with in order to insure proper protection of this village and the Town. The Board feels in a large and concentrated development such as this one,, we must pay even stricter attention to the possible contamination of well water and pollution of the streams in the area and ultimately to the marshes into which they flow. This becomes even more important When you remember that blis area has no public sewage or water available. we feel close communication and cooperation between the Planning Board, Conservation Commission and the Board of Health is of the utmost importance particularly in relation to this (Meetinghouse) development and also to any future subdivision involving marginal land so that the protection of public health and safety to the inhabitants of the Town of Barnstable may be sustained. McGlone Gentlemen: The Board of Health has not reached a final decision concerning its recommendations for this sub-division. Your attention is called to Section 31-U, Chapter 41, 1_assachusetts General Laws, that states there is no time limit for Board of Health a,,aoroval o-f those sub-divisions not serviced by a municipal sewage system. information received by the Board indicates possible discrepancies be'-ween the developer' s soil rezoorts and the soi 1 report arepared by the Soil Conservation Service of the U. McGlone Gentlemen: The Board of Health disapproves this subdivision plan. Your attention is called to sub-paragraph C. of Paragraph 41 Section IV of the Town of Barnstable Sub-division Rules and Regulations which states, If district sewerage is not proposed approval by the Board of Health .of the means of sewage disposal and approval of the soil ' structure in the disposal locus" The soil data furnished by the developer consisting of twenty- five test pits does not prove the suitability of the soil structure for sewage systems for the proposed 169 lots. The four to five feet of natural pervious soil below. the bottom of the leaching area of the disposal systems as required by the Town of Barnstable Health Regulations and Article XI of the State Sanitary Code, were not proven in the following observation pits - Numbers 1,4,5,7.8,9,11,12,13 and' 25. Test pits 16,17, and 18 were considered unsuitable by the developer's engineer. Test pits 10 and 14 would not meet the Town of Barnstable's Health Regulation concerning ground water elevation. Test pit 6 possibly would not. Ground water determinations were made in August, 1972. Article ' Yl: of the State Sanitary Code states : "Ground water determinations should be made during the period of the year when the ground water is at its highest elevation. Ground water elevations are at their highest in spring - not mid-summer. The lots in the location of test pits 20, 3,15119y,20®21,22,23,24 could possibly meet the sewage requirements but these would have to be proven by percolation tests, observed by the Board. Lots on sixteen of twenty-five test pits are considered unsuitable for sewage systems at this time, P i { Page 2 August 13, 1972 Other consideration in disapproving this plan are as follows : ± (1) There is no town water available. 1,7ells will be used. In a development of this size, the-Ka is a considerable risk due to the i soil structure and possible quifers f pollution of the wells by the septic systems. . (a) Public safety must be a Board of Health consideration,. In the absence of town water, a fire in the sub-division could pose a grave threat to the lives of the entire community. (2) Drainage from paved roads, house gutters, etc. , could r cause pollution of the great marsh and Barnstable Harbor (very fragile areas) . It is therefore the opinion of the Board that in fulfilling their primary function to safeguard the health and well-being of' the citizens of Barnstable, it has no choice but to disapprove this sub-division plan at this time because of the uncertainty of soil conditions for individual septic systems. However, the Board will .give further consideration to the re-submission of a plan by the developer; provided each lot is clearly marked and staked and test holes dug and percolation tests performed on each and every lot in the presence of an authorized Health agent, A central well system is also recommended. The testing of each lot'. in our opinion is necessary due to the fragility of . this particular area and the eff t is developme U will have upon our environment. RUobLrt L.
