Webb �SLE- C/O Iron House 95 Corporation Road Hyannis, MA 02601 ORDER TO ABATE VIOLATIONS OF MA GENER AL LAWS CHAPTER 111 SECTION 150A, 310 CMR 16.00, SITE ASSIGNMENT REGULATIONS FOR SOLID WASTE MANAGEMENT FACILITIES 310 CMR 19.00 105 CMR 410.00, STATE SANITARY CODE II, MINIMUM STANDARDS OF FITNESS FOR HUMAN HABITATION AND THE TOWN OF BARNSTABLE BOARD OF HEALTH'S NUISANCE CONTROL REGULATION NUMBER ONE The property owned .by you located off of Osterville- West Barnstable Road, Marstons Mills, listed as parcels 2, 3, and 4 on Assessor's Map 127 on January 3, 1992 by Kendall Ayers, Conservation Agent, during August by Jerome Dunning, Health Inspector for the Town of Barnstable, and again on January 18, 1992, by Thomas McKean, Health Director for the Town of Barnstable, because of a complaint. The following violations were observed: 410.602: Many stumps, tree branches, grass clippings and brush debris piled on the ground on your property along the south and east property lines located at parcels 2, 3, and 4 listed on Assessor's Map 127, off of Osterville-West Barnstable Road, Marstons Mills. The debris is considered a solid waste according to the MA Department of Environmental Protection. You are directed to correct this violation within forty (40) days of receipt of this notice. You may request a hearing if written petition requesting same is received by- the Board of Health within seven- (7) F days after the date order is received. However, these j violations must be corrected regardless of any request for a hearing. q I I I Please be advised that failure to comply with an order could result in a fine of not more than $500. Each separate day's failure to comply with an order shall constitute a separate violation. i You are also subject to a $25.00 ticket. Tickets will be issued daily until the violations are corrected. HYANNIS, MASS.02601 May 1, 1992 Mr. John Webb C/O Iron House 95 Corporation Road Hyannis, Ma. 02601 RE: Stumps, Branches, Brush, at Osterville West Barnstable Road, Marstons Mills, listed as parcels 2, 3 and 4 on Assessor's Map 127 Dear Mr. Webb: On January 30, 1992, you requested a hearing due to your receipt of an order letter dated January 21, 1992 from Thomas McKean, Director of Public Health. The order letter directed you to correct the violations at your property located off Osterville West Barnstable Road, Marstons Mills within 40 days. You presented testimony at two (2) public hearings of the Board of Health held on February 11, 1992, and March 10, 1992 . You stated it would be a financial hardship to remove the very large pile of brush, stumps, and branches. You also submitted a copy of a letter from Fire Chief John P. Jenkins, the West Barnstable Forest Warden dated March 10, 1992 . The letter stated: "the manner in which the stumps have been disposed of on this property is not in violation of any applicable sections of the Forest Fire laws of the Commonwealth or any other state or local statutes or regulations" . In addition, you submitted a copy of a letter from Mr. Donald F. Rugg, the Centerville-Osterville Marstons Mills Water Department Superintendent dated February 21, 1992 which stated he found "no problems whatsoever with regard to the safety of our public water supply. (The) activities on the property pose no threat at all to pollution or contamination of the public water supply" . Thomas McKean testified that your property is in violation of both state and local regulations. He stated Massachusetts General Law Chapter 111, Section 150A clearly states that solid waste shall be disposed of at a licensed solid waste facility. Mr. McKean also reminded the Board of Health that Nuisance Control Regulation No. 1 states grass clippings, branches, stumps, and similar debris are defined as rubbish. In addition, during a telephone conversation with Mr. Robert Johnson of the Solid Waste Division of Department of Environmental Protection, he stated the waste pile is clearly in violation of Massachusetts General Law 111, Section 150A. However, the Board of Health is in receipt of the letter dated April 7, 1992 from Mr. Sumner Martinson, the Recycling Coordinator for the Division of Solid Waste of the Massachusetts Department of Environmental Protection along with a copy of the Site Assignment Regulations forwarded by you . According to the Site Assignment Regulations for Solid Waste Facilities, 310 CMR 16.05 (3) , the disposal of wood wastes at a single family residence or farm where the wood wastes are generated and disposed within the boundaries of such residence or farm, is "conditionally" exempted from the site assignment requirements provided the operation incorporates good management practice, is carried out in a manner that prevents an unpermitted discharge of pollutants to air, water, or other natural resources of the Commonwealth and results in no public nuisance. Therefore, the Board of Health members voted unanimously at its public meeting held on April 28, 1992, to rescind the order letter addressed to you from Thomas McKean, Director of Public Health dated January 21, 1992. The order is rescinded with the following conditions: (1) Additional grass clippings, leaves, tree branches, brush, stumps, and other waste debris shall not be added to the property. Such waste debris shall either be composted or disposed of at a licensed Solid Waste. (2) You shall comply with any orders from the Town of Barnstable Conservation Department and the Town of Barnstable Conservation Commission. (3) This exemption may be revoked anytime unsanitary violations are observed on the property or anytime groundwater sample tests reveal contamination at the property or downgradient of the property. The order letter is rescinded because, at this time, there is no evidence of any groundwater contamination or of any other public health hazards at your property due to the waste debris pile. Also, the site is conditionally exempted from the Site Assignment Regulations for Solid Waste Facilities. Sincerely yours, oseph C.
