(5) and (6) There are certain conditions imposed by the Town of Barnstable Conservation Commission in its Order of Conditions issued on December 13, 1983 (a copy of which is enclosed) to which reference was not made in your Superseding Order. These specific conditions were #3, #6 and V, and we feel that the Superseding Order should include them. Condition #3: As it appears in. the original Order of Conditions issued by the Town of Barnstable Conservation Commission on 12/13/83, which is self-explanatory- Condit ion #6: The plan does .not show any access to construct or service the proposed sewage system.. The Conservation Commission in its original Order requires a right of access over land presently owned by Mr. and Mrs. Kittredge. This is necessary since the only alternative would be. access from the lot on Packet Landing on which the proposed house is to be built, which would mean crossing the creek with heavy equipment and supplies .to construct the system and later to service and maintain the same. We would also like to point out that there is a decree in effect issued by the Land Court in Boston, .MA refusing 'the use of any of the lots in the subdivision on Packet Landing for access to the back land (that is, the land on which the proposed sewage system is to be installed) . It is Land Court Case #36433 Robert A. Fairbairn et al, Petitioners vs. R. Theodore Steinhilber et al, Respondents. Condition #7: As it appears in the. original Order of Conditions issued by the Town of Barnstable Conservation Commission on 12/13/83, which is self-explanatory. (7) That the DEQE Superseding Order should be revised to include Conditions #3, #6 and #7 which were imposed by the Town of Barnstable Conservation Commission in its original Order with the additional requirement that the easement described in Condition #6 be recorded in the Barnstable County Registry of Deeds. e. Taylor Plan entitled "Sewage Disposal System in West Barnstable, Mass. For: Allan C. Taylor" dated 4/20/83 and revised 10/31/83 Dear Ms. Kouloheras: In accordance with your request, the following is a .list of our concerns in connection with the above-referenced proposed sewage system: 1. The test pits performed on the plan are not in accordance with Title V, Section 15.03, para. 3: 2. Test Pit #1 shows clean, fine, wet sand at elevation 19.3' and the bottom of the proposed leaching pit is at elevation 22.1' - this is 2.9' above the clean, fine, wet sand. Section 15.11, para. 3, of Title V requires 4' above. 3. According to the plan, no percolation test was performed in accordance with Section 15.03, para. 4 of Title V (the rate was assumed). 4. There appears to be more wetland than is shown on the plan. 5. The plan .does not show any U.S.G.S. ground water adjustment. 6. The plan does not show any access to construct or service the proposed sewage system. According to item 6 of the Order of Conditions issued by the Town of Barnstable Conservation Commission, there will have to be an easement from Mr. Kittredge to allow access over his property to maintain the septic system. There is no specification: in the Order that this instrument is to be recorded at the Registry of Deeds. 7. We question the practicability of the 4" pipe being only 1 foot below the bottom of the ditch. 8. Who is the owner of the ditch? 9. Another concern is that this brook drains a large portion of West Barnstable on the south side of Route 6A, and then drains into the Great Marsh. The system is located in a very fragile area and it is not a normal sewage system, Ms. Elizabeth Kouloheras, DEQE, Southeast Region January 3, 1984 Lakeville Hospital, Lakeville,, MA 02346 Page 2 but a very complicated one that is not fool-proof. What happens if there is an overflow from the leaching pit? To my way of thinking, the sewage will then drain downhill into the brook. 10. It was our understanding that at the meeting held by the Conservation Commission on November 29, 1983 that one of the points of discussion was the length of the system shown as being 285' in a straight line and this would have to be changed to something other than the straight line indicated on the plan; the Order issued does not reflect this. We have lived here for over nineteen years and in- all that time, every summer during the hot,damp weather we have experienced the stench from the. present sewage system located on the same property that this new separate system is being proposed to be located. As a matter of fact, we were forced to air condition our home in 1967 to overcome the odor and we can't understand why another system would be allowed to be installed. Since it is physically impossible for either of us to participate in the on-site inspection, we will be represented by an engineer and by our attorney, John B. Hopkins. We will be available at our home at 29 Packet Landing for any discussion after the site inspection. As you probably know, our home abuts the land on which the dwelling will be constructed which will utilize this proposed sewage system. Ve truly yours, Lawrence .W. This Order does not relieve the permittee or any other person of the necessity of complying with all other applicable federal, state or local statutes, ordinances, by-laws or regulations. 4. The work authorized hereunder shall be completed within three years from the date of.this Order unless either of the following apply: (a) the work is a maintenance dredging project as provided for in the Act; or (b) the time for completion has been extended to a specified date more than three years, but less than five years,from the date of issuance and both that date and the special circumstances warranting the extended - time period are set forth in this Order. 5. This Order may be extended by the issuing authority for one or more periods of up to three years each upon application to the issuing authority at least 30 days prior to the expiration date of the Order. 6. Any fill used in connection with this project shall be clean fill. containing no trash, refuse, rubbish or debris, including but not limited to lumber,bricks,plaster,wire,lath,paper,cardboard,.pipe, tires, ashes,refrigerators, motor vehicles or.parts of any of the foregoing. 7. No work shall be undertaken until all administrative appeal periods from this Order have elapsed or, if such an appeal has been filed, until all proceedings before the Department have been completed. 8. No work shall be undertaken until the Final Order has been recorded in the Registry of Deeds or the Land Court for the district in which the land is located, within the chain of title of the affected property. In the case of recorded land, the Final Order shall also be noted in the Registry's Grantor Index under the name of the owner of the land upon which the proposed work is to be done. In.the case of registered land, the Final Order shall also be noted on the Land Court Certificate of Title of the owner of the land upon which Conse proposed on Com,niss= work is to be done. A sign shall be displayed at the site not less than two square feet or more than three square feet in size bear- ing the words, "Massachusetts Department of Environmental Quality Engineering. Where the Department of Environmental Quality Engineering is requested to make a determination and to issue a Superseding Order, the Conservation Commission shall be a party to all agency proceedings and hea ings before the Department. 11. Immediately following completion, the project shall be certified to be as per these conditions and plans. in writing, to the Barnstable Conservation Commission by the project ngi neer who shall be registered in the state of Mass. 12. Upon certification by the project Engineer the applicant shall forthwith request, in writing, that a Certificate of Compliance be issued stating that the work has been satisfactorily completed. 13.. Except for. some minor additions this Order is similar to the one issued by the Barnstable Conservation Commission. The Department has determined that a portion of the project site is significant to the following interests of the Act: private water supply, groundwater supply, flood control, storm damage prevention and prevention of pollution. The majority of the work proposed is located within the buffer zone (as defined in 310 CMR 10.02(2b) of a narrow bordering vegetated wetland bordering on a stream. The Department has determined that if all disturbed areas in the .buffer zone are mulched and revegetated following construction, as required in the enclosed Superseding Order of Conditions, work within the buffer zone will not alter or adversely effect the adjacent wetland resource areas. 310 CMR 10.54, 10.55 and 10.56 define, respectively, a Bank, a Bordering Vegetated Wetland and Land Under Waterbodies and Waterways. It should be noted that the landward edge of a bordering vegetated wetland is determined by that area within which 50 percent or more of the vegetational community consists of wetland plant species identified in the Act. The Department has determined that the above-referenced file accurately defines the wetland resource areas present on-site. Only a 4-inch pvc pipe, a component of the' proposed subsurface sewage disposal system, is actually located within a wetland resource area. The proposed dwelling, septic tank and leaching facility are all located in the buffer zone. The enclosed Superseding Order of Conditions limits the size of the "pipe" trench and .the means by which it is to be excavated, and it requires erosion and turbidity control measures as well as the revegetation of disturbed areas. It is the Department's opinion that construction impacts associated with the project will be minimal and temporary in nature. The Department has determined that the proposed project, constructed in compliance with the enclosed Superseding Order of Conditions, meets the performance standards set forth in 310 CMR 10.54(4) , 10.55(4) and 10.56(4) . -2- The "Presumption Concerning Title 5 of The State Environmental Code," r 310 CMR 10.03(3) , states that a septic system in compliance with Title 5, or more stringent local Board of Health Regulations, is presumed to protect the seven interests of the Wetlands Protection Act from impacts caused by the discharge from the septic system if none of the components of the system are located within certain specified resource areas and if the leaching facility is at least 50 feet from the edge of said areas, or a greater distance if required by local Board of Health Regulations. The proposed subsurface sewage disposal system has been designed in compliance with Title 5 of The State Environmental Code (310 CMR 15.00) . It has been designed so that even though a component of .the system (4-inch pvc pipe) is buried beneath the stream potential impacts from the discharge from or failure of the septic system will not adversely effect the interests of the Wetlands Protection Act. Construction impacts caused by the installation of the subsurface sewage dispsoal system have been addressed in the enclosed Superseding Order of Conditions. It is the Department's opinion that the enclosed Superseding Order of Conditions adequately protects the interests of Massachusetts General Laws, Chapter 131, Section 40, and that the reasons given here are sufficient to justify this Superseding Order of Conditions. Should there be further proceedings in this case, the Department reserves the right to address additional issues and present further evidence as may be appropriate. In the case of recorded land, the Final Order shall also be noted in the Registry's Grantor Index under the name of the owner of the land upon which the proposed work is to be done. A 20-foot wide buffer strip of natural vegetation must be maintained- along either side of the existing stream with the exception of that area where components of the septic system traverse the "buffer strip" and .the stream. 2. Prior to trench excavation within the stream a row of hay bales must be staked perpendicular to the stream flow, both upstream and immediately downstream of the proposed pipe crossing to reduce stream flow during emplacement of the pvc pipe and to minimize siltation downstream. 3. The temporary trench that cuts through the stream bank and crosses the stream channel must be no more than 2.0 feet in width and must be excavated by hand. Following placement of the pvc pipe the stream bank and channel must be immediately restored to its original condition. 4. Areas disturbed within the 20-foot wide buffer strip noted above, including the stream bank, must be immediately stabilized by revegetating with local indigenous plant species. S. All disturbed areas are to be revegetated following construction. Areas stripped of vegetation during construction may not be left unvegetated or unmulched for more than 60 days. 6.
