The measurements which you observed today show the ground water to be standing at an elevation of 11 .97 feet in the well casings I previously installed on the lot. In your review of our variance request you asked that "additional site specific maximum ground water elevation data be provided. " I have been observing the elevation of the water in the wells and have found a maximum elevation of 12.2 feet occured during May 1989. This water elevation is 10 feet below the natural ground surface, at the site of the proposed sewage system. In your regulation "installation of on-site sewage disposal systems on marginal lots" adopted 12/22/85, you state that "the filling of marginal lands in close proximity to the ground water in order to provide for sufficient area to make it suitable for a sewage disposal system is not acceptable practice. . . " ' and further, "subsurface sewage disposal systems must be located in an area where there is a four foot depth of naturally occuring pervious material below the entire area of the leaching facility. . . " "this four foot depth of naturally occuring pervious material must be above maximum ground water elevation. " In support of my clients request of a variance to this regulation, I would like to highlight the following: Mr. McDonnell's lot does not require filling to provide the ground water separation. The sewage system as proposed is to be constructed entirely below natural ground elevation, and will still provide a minimum of 6.2 feet of separation to observed maximum elevation. The system does require the 4 . removal of unsuitable materials and their replacement which process is permitted under 310CMR 2. 17 when the four foot layer of pervious soil exists as required under 310CMR 3.6. It is my professional opinion that construction of the sewage system proposed will provide the same degree of environmental protection if the variance to the town by-law were not required. My reasons are as follows: we propose more than the required four feet of dry pervious soils, with the 6.2 feet shown on the plan. The soils serving to replace the clay will be carefully selected and mechanically placed, compacted, tested and will exhibit the same or improved filtration characteristics as those exhibited by naturally occuring soils. The lateral separation from any watercourse is 170 feet, 70 feet in excess of the minimum under the town by-law and 120' greater than the separation required under 310CMR 3.7. The location of the water supply for the lot will be an on-site well located 160 feet from the proposed sewage disposal system. The well will be sited in accordance with the town by-law, and will also exceed the guidelines as outlined in "Private Well Protection" as published by the Association for the Preservation of Cape Cod. In your approval variance for Mark Yuskatis dated August 6. 1976, for a similar margianl lot across the street from the subject property you stated, in part, that "this variance is only granted because the applicant had percolation tests and on-site sewage disposal plans prior to the adoption of the marginal lot regulation. " Your attention is respectfully drawn to a letter of Novemeber 16, 1988 wherein my client states as a fact he relied on percolation test approval in his decision to purchase the land in 1977. I have attached a copy of a subsurface sewage design plan in my client's possession, for the subject property drawn by Wilfred F. Taylor, P.E. dated 09/05/74. If you need any additional information or require any modifications to the filed plan, I will be available to provide this. Let me re-state my case for the record and for your consideration as you take this under advisement. I purchased this land in 1977-1978 from John Karras in good faith based upon Bill Taylor, Town Engineer percolation test approval. I purchased this land with the intent to eventually build my permanent residence there when my financial situation would allow me to do so. I have five children, three who have completed college, one who is a senior in college and one who will be entering college in the Fall. The cost of their education, all in private New England colleges, has been expensive to put it mildly. This prevented me from building on this property over the last ten years until now. Two years ago, I started to work with an architect to build on this property only to find out that the rules had changed. At that time, rather than come to the Board with a hardship request, I decided to hire Down Cape Engineering Company to run "pert" tests on the property. dy 2 _ Board of Health November 16, 1988 In addition, I asked them to develop a system that would be acceptable to the town and then to discuss with you, as I did last evening, the request for a variance. This, as you are well aware, has cost me a substantial amount of money to have this percolation and planning done. My request to you for the variance is based upon my good faith in purchasing this property to build a home. and albeit it timing, I would have had a home today on this property. The variance granted . is for Lot 39, Packet Landing Road, West Barnstable. The variance is granted contingent upon meeting the following conditions: (1) The designing engineer,must submit a revised plan showing an excavation of impervious materials replaced with clean granular fill for a distance of forty (40) feet around the proposed septic system and the reserve area. (2) The designing engineer must be on site and supervise construction of the septic system and certify in writing to the Board of Health that his design has been strictly adhered to prior to the issuance of a Certificate of Complaince. (3) A percolation test must be scheduled and performed in the clean, granular fill. (4) The dwelling cannot have more than three bedrooms. Dens, study rooms, enclosed porches, finished cellars, sleeping lofts, and similar type rooms are considered bedrooms according to the Department of Environmental Quality Engineering. The variance expires August 1, 1990. This variance is only granted because the applicant had percolation tests prior to the adoption of the marginal lot regulation. This variance would not be granted if the applicant had not taken the above mentioned action. This lot would have met the requirements of Tilte 5, of the State Environmental Code, and the Town of Barnstable Health Regulations prior to the adoption of the Marginal Lot Regulation. Mr. McDonnell is combining three lots (lots #29, 30, & 31 ) into one lot. permits This is all of his land on Packet Landing Road. We have designed a three bedroom single family residence for this location. The total area of the lot is 48, 100 sq. ft of upland. A percolation test was done on the lot by Wilfred F. Taylor, former town engineer for Barnstable on 7/24/74. Mr. Taylor measured the percolation rate at 8 min per inch. I have based my design on this rate. Test holes dug on August 10 and August 12, 1988 indicate that the clean sand observed on site exists in the same condition as shown on Mr. Taylor's report (copy enclosed) . I conducted a percolation test in similar material on adjoining lot 28 (now parcel b) and found the rate to be less than 2 minutes per inch. The plan as designed meets Title V requirements and the Barnstable ammendment to Title V except for the marginal lot regulation. The water supply is a private well located 160 feet from the septic tank, which is sited in accordance with the APCC publication "Private Well Protection" by Kerfoot & Horsley Feb. 1988. The submitted Site and Sewage Plan, dated October 24, 1988, revised November 15, 1988, shows that the test holes were observed August 10, 1988 and August 19, 1988. The groundwater was not at its maximum elevation during August 1988. You stated you utilized the maximum groundwater elevation formula contained in the United States Department of interior Geological Survey publication, "Estimating .Highest Groundwater Levels for Construction and Land Use Planning at Cape Cod, .1-3 Cl-setts, Example," dated September 1983, revised 1987. However, the publication states that "sites should be inspected for layers of silt, clay or till" and that the estimation "technique is valid only in sand and gravel." According to the submitted plan, silt and clay materials are present in the soils. The groundwater at this site is at the elevation of the silty soil. it is the opinion of the Board that it is necessary to obtain accurate site specific maximum groundwater elevation data prior to reconsideration of a variance request involving the installation of an onsite sewage disposal system at this marginal lot.
