The variances granted are as follows: Section 360-1 of the Town of Barnstable Code: To install a soil absorption system 70 feet away from the edge of the easterly vegetated wetland, in lieu of the minimum 100 feet separation distance required. Section 360-1 of the Town of Barnstable Code: To install a soil absorption system 74.3 feet away from the edge of the westerly vegetated wetland, in lieu of the minimum 100 feet separation distance required. Section 397 of the Town of Barnstable Code: To install a soil absorption system 125.7 feet away from the onsite private well, in lieu of the minimum 150 feet separation distance required. These variances are granted with the following conditions: (1) No more than two (2) bedrooms are authorized at this property. Dens, study rooms, offices, finished attics, sleeping lofts, and similar-type rooms are considered "bedrooms" according to the MA Department of Environmental Protection. Mr. Lowery said they purchased the 1,000 gallon tank from Owen Corning. It is fiberglass and Owen Corning guaranteed it for 100 years. It was purchased during the Carter Administration and during an energy crisis. They chose the tank after considering the environment and energy conservation etc. They went to the expense of this size because it afforded the protection of the environment they wanted. The Lowerys were unaware of the regulation requiring removal of underground tanks until the most recent letter received 11/24/10. The Board explained to the Lowerys that the fiberglass tanks are also susceptible to leakage.
