Gens, your tenants at 333 Parker Road, West Barnstable, MA, 02668. Please be advised that as a result of the lack of running water—both cold and hot—at the rental premises for the better part of the last 30 days, and your neglect and failure to remedy the same, a complaint has been made with the Barnstable Health Department concerning this violation and other violations that have persisted for years despite many requests to remedy them. ' . Please be further advised that any action by you to initiate an eviction action, a rental increase, or any changes in the rental terms in response to this notice or the complaint to the Health Department will be opposed as a retaliatory action in violation of Massachusetts Law. Such opposition will also include counterclaims for unfair practices under G.L. chapter 93A and for general damages for the many deficiencies in the premises that violate the state sanitation code, local health ordinances, the warranty of habitability and the law of quiet enjoyment; all as discussed below. THE WATER PROBLEM As you are aware, the first loss of water occurred apprgximately one month ago after I noted you that a pipe had sprung a leak. Your response to the leaking pipe was to shut off the water main attempt and fail to fix the leak rs tf p you a , and then abandon all 1 • Page 2 repairs and leave the water shut off. I left for Boston and returned 5 days later on November 14 and discovered that the leak was still not repaired and the water was still shut off, but it would not come back on when I put a bucket under the leak and opened the main water valve. You then fixed the leak and somehow the water came back on November 15, but the water failed the next day(Saturday, November 16). You informed me that a plumber would be coming to install a new well pump on Monday, November 18. 1 went the remainder of the weekend without water. When I came home from work on Monday, November 18, there was no new pump or any visible new parts or work performed on the water system, but the water had come back on. It failed again on Wednesday, November 20 and was still off when I left town on November 21. 1 called and left you a message regarding this and requested that you immediately hire qualified professionals to repair the system. I stayed'at my other residence as long as I could until December 5 when I had to return for work purposes and there was still no visible plumbing work performed. After I arrived the water came on for about 5 minutes and then failed. This cycle repeated several times until the water stopped altogether and I was without water into December 6. When I got back from work on December 6 the water had come back on and has luckily stayed on through this writing. In the meantime, one Tom Desmond from Desmond Well in Orleans came to the house on December 6 late in the afternoon at your request to survey the situation. Mr. Desmond informed me that he had never been to the premises before and I had to show him where the main tank and the well pump were located.After inspection, he informed me that the main tank and its fittings were installed in 1977 and were decades past their expected life span and were failing and would need to be replaced. He also stated that the main pump was being overheated by the failing tank operation and that the pump may be suspect as well. He told me to expect further failures. He advised that he did not have authorization from you to begin repairs. The failure of a landlord to restore the loss of water to rental premises is a condition that may"materially endanger"the health of the occupants and by law must be remedied within 24 hours. Failure to restore water is a violation of the State Sanitary Code 105 C.M.R. sec. 410.705(C), 410.180 and 410.190. It is also a violation of local health ordinances, the landlord's warranty of habitability and the law of quiet enjoyment, which requires that a landlord must provide essential utility services. You have been on repeated notice now for over 3 weeks that there has been a recurring failure in the provision of water to the premises but have still not yet remedied the problem or even engaged a qualified professional to undertake repairs. As a result, the premises have been largely unusable and, when I have been compelled by my work obligations to be at the house, I have had to suffer through all or part of 9 different days without water. When you have no water you cannot shower, shave, brush your teeth, use toilets, do laundry,.or cook. 2 • Page 3 The situation is unsafe and unsanitary and your handling of the matter as a landlord has been grossly negligent and unlawful. The purpose of this letter is, among other things, to once again demand that you fulfill your legal responsibilities and immediately restore a reliable water supply to the premises. OTHER VIOLATIONS No Carbon Monoxide Alarm—The State Code requires that carbon monoxide alarms be maintained in good working order 105 C.M.R. sec. 410.482 and 410.351(A). The failure of a landlord to install carbon monoxide alarms to rental premises is a condition that may"materially endanger"the health of the occupants and by law must be remedied within 24 hours. You have been on notice for several years now from your own insurance company of this requirement but have at all times failed to comply. ` Roof Leaks and Condition of Walls-The State Code (105 C.M.R. sec. 410.500) requires that structural elements of rented premises be kept in good repair and be weathertight, free from chronic dampness, and free of holes, cracks, loose plaster and other defects. For the entirety of the 9+years of the tenancy, you have been on repeated notice of chronic roof leaks in the living room, kitchen and adjoining hallway; all of which surround the central chimney where the roof flashing needs repair/replacement. This problem has never been adequately addressed and, as a result, in anything more than a light rain pots, pans, and towels have to be deployed to catch the drippings from the ceiling and furniture has to be moved to protect it from water damage. This significantly reduces the value of the rental. In addition, the gutters and downspouts of the premises have for years been in disrepair(and in the case of the rear downspouts and splash blocks missing entirely) and you have ignored all requests to replace or repair them. As a result rain and melting snow have not been directed away from the property but instead settle and permeate through the rear porch and the rear shed roof and a) have chronically leaked into the interior of the two rooms at the rear of the first floor(damaging our property and further harming your structure as well) and b) been a significant. contributing factor in the half dozen substantial flooding incidents occurring during the past five years in the first floor of the property. These floods have caused us considerable damage and repair costs to carpets, electronics, books, furniture, and much more. Moreover, the floods have caused substantial damage to the interior walls of the first floor and waterlogged the wallboard. I was present for the insurance inspection where your insurer deemed that all the wallboard needed replacement. I was also present during your so-called repairs, consisting of a new coat of paint, and for the post repair insurance inspection, where the insurance representative apparently was led to believe that behind the new coat of paint were replaced walls. As a result of your engaging in "disaster capitalism" (a/k/a insurance fraud) and your utter indifference to the requirements of the state code and the warranty of habitability—not to mention your disregard for the structural integrity and value of 3 • Page 4 your own property, the walls on the first floor-especially the bedrooms-are peeling paint, bubbled and cracked, chronically damp, and give off a faint musty odor. Dampness is a serous problem and we have had to run a dehumidifier at all times including the dryer winter months. Shoes and other items that normally would be stored on the floor or lower area of closets cannot because of the humidity and the: constant threat of further flooding. Many items have been mildewed and/or damaged beyond repair. NOTICE , We have been your loyal tenants for over 9 years and while we have politely requested that you remedy the above deficiencies on numerous occasions, we have endured the above issues regarding the premises and we have perhaps indulged your neglectful tendencies by not initiating legal or enforcement action. Your inadequate handling of the water loss problem is, however, intolerable. We simply insist that you remedy it immediately. If you do not adequately remedy the water problem and/or if you should retaliate by taking any action to initiate an eviction action, a rental increase, or any changes in the rental terms, we will pursue all available legal remedies including, but not limited to, claims under M.G.L. c. 93A sec. 9 as the acts and omissions described above that are violations of the state sanitary code, local health ordinances, the warranty of habitability and the law of quiet enjoyment also constitute unfair practices under G.L. c. 93A sec. 2. Be advised that a violation of this law can carry an award of double or treble damages and include both attorneys fees and costs. Landlord will "tinker"with well pump and it'll work for a bit then another call is placed and it takes awhile for landlord to get back and "tinker", etc. Person believes a contractor needs to come in and resolve. A fuel oil line from a 275 gallon above ground fuel oil tank to an emergency generator leaked, discharging greater than ten gallons of fuel oil onto a concrete floor.
