Luzietti 79 Arbor Way Hyannis, MA 02601 Dear Mr. Luzietti: You are granted a variance from the Board of Health "330 Regulation" . This variance allows you to operate an office/rental/warehouse establishment at 58 Plant Road, Hyannis with the following conditions: ( 1) You shall receive the approval of the Town's Zoning Enforcement Officer. (2) Any or all floor drains in the building shall be permanently sealed. (3) A management plan should be submitted to the Hyannis Fire Department and to the Director of Emergency Preparedness containing the following: (A) Name of responsible person in your absence and his/her telephone number. (B) The location of all toxic and hazardous materials. (C) In accordance with the Massachusetts Right To Know Law, Chapter 11F, Material Data Safety Sheets for all toxic and hazardous materials used, handled, or stored shall be maintained on the premises and made available for employee edification and for Health Department information. (D) All regulated substances shall be stored such that a method of containing any accidental spillage would ensure all such spills will be totally contained and prevented from reaching any surface or groundwater or into any plumbing lines, catch basins, sewer system or septic system. (E) The location of all emergency collection devices, such as vacuum suction devices or absorbent scavenger materials. Emergency containers should be of such capacity to hold the total quantity of regulated substances plus any absorbent material. (F) Proper and adequate maintenance of containment and mergency equipment. Procedures should be established for nspections performed by the manager once every three onths. Such procedures should be in writing including a regular schedule of maintenance. A log documenting any accidental spills, describing how such spills were handled, describing inspection results, and maintenance should be kept at the site for inspection by the Health Department at all times. (G) A notice should be posted setting forth the above requirements. (4 ) An emergency response plan should also be submitted to the Hyannis Fire Department indicating the following: 1) The procedures which will be followed in the event of spillage so as to control and collect all spilled material in such a manner as to prevent it from reaching any surface or groundwaters or into any sewage disposal system, sewer system, catch basin, or drywell. 2) A listing of emergency collection devices (as suggested above #3) and the locations of those devices. (5) After the emergency response and management plans are approved by the Hyannis Fire Department and the Director of Emergency Preparedness, the applicant shall submit four (4 ) copies of the plan to the Health Department for review, prior to submission to the Board of Health. The variance is granted because the applicant stated that only 67 gallons total will be discharged into the septic system each day at this site. The existing septic system is designed to handle 262 .5 gallons per day. According to the "330 Regulation" , up to 91 gallons may be discharged each day at this property of 12,000 square feet. At this location there are two buildings, covering approximately 2800 sq. ft. , most of which ' is used for retail sales, with three efficiency apartments on the second floor of the main building. In 1985 I purchased land at 58 Plant Road, Hyannis, and constructed a building approximately 50' x70' , having 3500 sq. ft. , of which 1000 sq. ft= of have always been rented out. Presently, I utilize 2,500 sq. ft. on the 1st floor and 900 sq. ft. on the second floor for storage and offices. After much consideration, in order to remain strong considering the economic conditions which have and are still affecting the Cape area, I feel that it is in my best interest to change the emphasis of my operation and concentrate more on new pool construction and servicing of existing pool . While I do not expect to discontinue my retail operation I do not feel that it should be the focal point of the business. The plan before you would allow me to . consolidate my operation under one roof , allowing for more efficiency and easier access for customers, while being more cost effective. Presently with two operations, trailer trucks are off loaded at the Plant Road site and product is shuttled by pick up truck to our retail operation on Rt. 132. Not only is this very time consuming and costly, but the exposure to heavy traffic on Rt. 132 is not in my best interest, nor that of the town. Realizing that water usage at the Plant Road location is of concern, I have received from the Barnstable Water Dept. the usage of 1992 for both locations / and calculated the gallons used. At my Plant Road location my average daily use is 26. 71 gals. while at the Rt. 132 location the usage is 162.32 gal . per day. I would estimate my use in the retail area to be approximately 25% of the total , 40. 58 gals per day, with the balance of 121 . 74 gal . being used by my three tenants. Taking into consideration that my system at Plant Road is rated for 262. 5 gal per day, it is clear to see that even combining the total consumption for both sites I would fall within the guidelines of acceptable usage. The eventual installation of sewer at both locations within s will definitely be a benefit and alleviate any concerns regar age and waste disposal . ��� �� / ~ Board of Health Town of Barnstable Page II The changes proposed for 58 Plant Road are not major and are well within the scope of the existing zoning. It would change 750 sq. ft. on the first floor to retail space and add to the existing area on the second floor for offices The storage area would remain, with improvements added for safety and other ^ code regulations. The building is in Zone B and the area presently contains many other retail operations, including Children' s Resale Warehouse Charles Music, Cape Cod Audio, Robinson' s Plumbing & Heating & The Splash Showroom!, ' Luzietti Pools has been in business for over 20 years in the Town of Barnstable and I feel that this proposed move will not only benefit me, but my customers and the town, and I am asking you to give this variance your favorable consideration.
