Dear Mr. Brown:
The Board reviewed the 25. 1ot preliminary subdivision in Centerville at its
meeting December 20, 1983. Mr. Kuhn was present at the meeting.
It was noted that a portion of the subdivision falls within a zone of
contribution and that the majority of the lots are approximately 16,000
to 17,000 square feet.
We recommended reducing the density of the subdivision by combining lots.
Minimum recommendations for approval of a definitive plan will include,
but not limited to:
The developer must provide public water to each and every lot in the
subdivision.
The developer shall have recorded on the deed that no variances from
Title 5, Minimum Requirements for the Subsurface Disposal of Sanitary
Sewage, and the Town of Barnstable Health Regulations will be granted
on any lot in this subdivision.
A percolation test must be made on each lot, at leaching site, before
a Disposal Works Construction Permit will be issued. Maximum ground
water elevations must be determined by using data available from United
States Geological Survey - Probable High Ground Water Levels on Cape
Cod, Mass.

LEGAL NOTICE
INSTALLATION OF ON-SITE SEWAGE DISPOSAL SYSTEMS ON MARGINAL LOTS
The Board of Health, Town of Barnstable, Massachusetts, in accordance with, and under
the authority granted by Section 31, of Chapter 111, of the General Laws of the
Commonwealth of Massachusetts, hereby adopted the following rules and regulations
at a meeting of the Board of Health held on December 17, 1985:
PURPOSE
The filling of marginal lands in close proximity to ground water in order to provide for
sufficient area to make it suitable for the installation of a sewage disposal system is
not considered an acceptable practice and such lands are considered as not suitable from
a sanitary point of view for human habitation and for the protection of groundwater
and watercourses. Watercourses are defined in Regulation 15.01, of 310 CMR 15.00,
the. State Environmental Code, Title 5, Minimum Requirements for the Subsurface
Disposal of Sanitary Sewage.
Subsurface sewage disposal systems shall be located in an area where there is at least
a four foot depth of naturally occurring pervious soil below the entire area of the leaching
facility and the designated leaching reserve area. This four foot depth of naturally
occurring pervious soil must be above maximum ground water elevation. .
The maximum groundwater elevation shall be determined by utilizing the formula
contained in the United States Department of Interior Geological Survey publication,
"Estimating Highest Groundwater Levels for Construction and Land Use Planning - a
Cape Cod, Massachusetts, Example", dated September, 1983, or by observing the height
of the groundwater table when it is at its maximum level or elevation. Maximum
groundwater determinations shall be made during the wettest season of the year -
normally March or April. Allowances shall be made for high water level if the Board
of alth permits the determination to be made outside the wettest season.

Dear Mr. Martin:
The Board of Health has reviewed the preliminary subdivision plan and makes the following
recommendations:
Each septic system shall be located within the prescribed boundaries of each individual lot.
The developer must submit a copy of a master plan to the Board showing the locations of the
proposed wells and septic systems throughout the subdivision prior to issuance of any building
permits.
Building permits will not be approved by the Board of Health on individual lots until the well
is installed and certification submitted as to the bacteriological and mineral content of the water
by a State Approved Laboratory. The water must meet all of the standards established by the
Safe Drinking Act of 1974.
The developer shall have recorded on the deed that no variances from Title 5, Minimum
Requirements for the Subsurface Disposal of Sanitary Sewage, and the Town of Barnstable Health
Regulations will be granted on any lot in this subdivision.
A percolatior_ test must be made on each lot, at leaching site, before a Disposal Works

The developer shall have recorded on the deed that underground fuel and chemical storage tanks
cannot be installed or maintained on property within this sub-division.
