Davidson, P.E. 38 Greenhouse Road Forestdale, MA 02644 RE: Hyannis Texaco/Route 132, Hyannis, Parcel 79 on Assessor's Map 273 Dear Mr. Davidson: You are granted a variance from the Board's Regulation limiting sewage flows to 330 gallons per acre per day within certain zones of contribution on behalf of your client, Richard Trifird at the above referenced site, with the following conditions: (1) Plans of the onsite sewage disposal system shall be designed in accordance with Title V g , the State Environmental Code and submitted to the Board with a completed Application for Disposal Works Construction Permit form. (2) Only package foods are authorized to be sold at the proposed retail food store. The building cannot be utilized for the preparation and/or cooking of food. (3) The buildings and pump islands shall be constructed as designed in the submitted plans labeled scheme "B", dated December 6, 1989, revised March 23, 1990. (4) The designing engineer shall supervise the installation of the onsite sewage disposal system and certify in writing to the Board that the system was installed in strict accordance to the submitted plans. The variance was granted because it is the opinion of the Board the proposed sewage flow would be less than the present sewage flow based on the following: (1) The total quantity of employees will be reduced from four-six to two-four per day. (2) The existing service garage building will be replaced with a smaller sized retail food building. Therefore, the total building size will be reduced from 2,700 square feet to 1,204 square feet. (3) The proposed car washing facility will be designed to recycle the wash water without discharge into the sewage disposal system. Mr. Robert M. Davidson, P.E. On March 30, 1990 the Board of Health (hereafter the "Board") granted a variance from the so-called 330 gallon regulation for the captioned property. Terms are set out in letter from then chairman, Grover Farrish, M.D. , to Bob Davidson the engineer who represented the applicant in connection with the request, a copy of which is attached for your convenience. Mr. Davidson is seriously ill. Although his interest in the project continues, it cannot be determined when he will be able to resume active involvement. In the meantime, communication between the Board and the applicant can be addressed to me. Subsequent to the grant of variance applicant has been pursuing approvals from other boards. The process is ongoing. In spite of Mr. Davidson's absence from the project in recent weeks, it is my .understanding that the Board has been kept informed with regard to pertinent events and plan changes, if any, by applicant or representatives of AYOUB Engineering. In order that the Board may be kept fully informed regarding matters within its jurisdiction, I'd appreciate it if you would respond at your convenience, so that we can be assured the Board is fully aware of the applicant's status, and confirm effective period of the variance granted and necessity, if any, for written renewal or extension.
