BOARD OF HEALTH VARIANCE DECISION
On or about June 1, 1994 , the Petitioners, David and Lucy
Banner, received an order from the Board of Health to
connect the premises located at 614 Route 132 , Hyannis, Ma,
listed as Parcel 14 on Assessor ' s Map 311, Hyannis, MA. .to
the public sewer. Due to their limited income, the
Petitioners applied for a variance to waive the requirement
that their home be connected to the Town of Barnstable
sewer. Based upon the application for a variance and other
information submitted, the Board of Health finds as follows:
1. The Petitioners stated that the on-site sewage
disposal . systems located on the subject premises
are--currently functioning properly.
2 . The petitioners are experiencing financial
hardship.
3. If the Petitioners is required to incur the costs
attendant to connect to the Town of Barnstable
sewer, they will be forced to forego basic
necessities causing them severe hardship.
4 . Based on the representations by the Petitioners
that their on-site sewage disposal systems are
functioning properly, the -Board -of Health finds
that the risk of environmental damage will be
acceptable if the Board of Health temporarily
waives the requirement that the subject premises
be connected to the Town sewer , until such time as
said on-site sewage disposal system fails to
function.

Petitioners that the subject,, premises located at 614 Route
132 , Hyannis, MA. be connected to theaTown of Barnstable

1 . This variance shall expire within 5 years from the
date of issuance.
2 . Nothing
in this variance shall be construed as
limiting the Board of Health' s power to revoke
this variance should -it determine that the on-site
sewer disposal system is malfunctioning.
3 . The Petitioners shall record this variance at the
Barnstable Registry of Deeds within thirty ( 30 )
days from the date of issuance of said variance
and shall provide the Board of Health a copy of
the recorded variance.

Dear Mr. and Mrs. Banner:
You are granted a variance from the Board of Health Interim Groundwater Protection
Regulation to add 750 square feet of office space at the Hyannis Motel, Rte. 132, Hyannis,
Ma., with the following conditions:
(1) No additional office personnel are authorized.
(2) The on-site sewage disposal system must be pumped annually and written certification
submitted to the Board by a licensed septage hauler.
(3) The proposed addition cannot be utilized for sleeping purposes.
The variance is granted although the motel is in a Critical Zone of Contribution to public
water supply wells because you have stated that no additional personnel would be employed
as the result of this addition. Therefore, no additional sewage will.be generated.

As we have previously discussed, I have been retained by Dave
inspections Banner to review the variance request for the above referenced
project. _
permits Mr. Banner has informed me that he is proposing to add office
space to his existing motel office. It has been my experience
when calculating the sewage flow estimate for a motel to use the
110 gal/day/bedroom factor, as specified in Section 15.02 (13) of
the State Environmental Code (Title Five) . I believe that the
factor specified in Section 15.02 (13) for the office buildings
referes to establishments which have a principle office type use
and is not applicable to motels. I feel that the 750 SF office
addition will not increase the sewage flow of the site and that a
variance may not be necessary.
However, if you do not agree with my interpertation of the State
Environmental Code and feel that the office building factor is
applicable then the sewage flow increase would be approximately
56 gal/day. In either case, I do not feel that the proposed
addition will have a significant adverse effect on subsurface
water supplies.

.access to the site for vehicular traffic and other fire
fighting/emergency rescue vehicles due to change in the
