The variance granted is as follows: Section 360- 18 of the Town of Barnstable Code, Marginal Lots:: To construct a subsurface sewage disposal system in an area where there is not sufficient naturally occurring pervious soil above the maximum groundwater elevation. During testing and soil evaluations conducted by the designing engineers, it was determined pervious soils were located deep into the holes, twenty feet six inches (20'6") below grade. and the depth of the groundwater table was approximately twenty feet eleven inches (20'11") below grade. Due to the extreme depth of naturally occurring material, the construction of the proposed soil absorption system will tequire the removal of all the unsuitable soil down to approximately 16 feet deep, in compliance with 310 CMR 15.213, State Environmental Code, Title V. Although this marginal lot will require extensive soil removal and replacement with fill, the proposed onsite sewage disposal system, as proposed, will provide the same degree of protection to the health of the environment as would otherwise be provided if naturally occurring material is provided four feet above the groundwater table. Thomas, Churchill Engineering, Inc. (CEI) is submitting this request for relief from the Barnstable On-Site Sewage Disposal Systems ch. 360 §18 requiring four feet of naturally occurring pervious soil must be present above maximum groundwater elevation. The deep hole observation records for this site yield the top of the strata of naturally occurring pervious material is found approximately 20'-6" below existing grade. However, the depth to the historic high groundwater table is approximately 20'-11" below grade. Hence, four feet of naturally occurring pervious soil is not present above the maximum groundwater elevation, therefore, the site does not conform to the requirements of ch. 360 §18.A. Due to the extreme depth of naturally occurring material, the proposed soil absorption system requires approximately 16 feet of unsuitable material to be removed and replaced with material conforming to 310CMR15.255(3). Thus, the separation between the bottom of the system and the groundwater table would significantly exceed the minimum distance as set out in 310CMR15.213. Hence, CEI submits that the system, as proposed, will provide the same degree of protection to the public health that would otherwise be provided if the depth of the naturally occurring strata was located 4 feet above the groundwater table. Moreover, the removal of unsuitable material and replacement with fill does not constitute a filling of marginal land to provide sufficient area to locate a sewage disposal system. Therefore, CEI respectfully submits, that strict application of the provisions of the regulation, for which relief is sought, would result in manifest injustice considering the same level of protection to the public health may otherwise be achieved.
