TOWN OF BARNSTABLE pF THE TQ eQ ♦ OFFICE OF Dsaa9TeDa : BOARD OF HEALTH i639' 367 MAIN STREET 0 MAY k' HYANNIS, MASS.02601 November 5, 1996 Steve Shuman RE: Preliminary subdivision plan of land in W. Barnstable Chairman, Planning Board Petitioner: John O'Leary Barnstable Town Hall Assessor's Map 136, Pcl 055 Hyannis, Ma 02601 Engineer: Yankee Survey Consultants Date: October 15, 1996 Dear Mr. Shuman: The Board of Health has reviewed the preliminary subdivision plan in West Barnstable, and makes the following recommendations: Each septic system shall be located within the prescribed boundaries of each individual lot. The developer must submit a copy of a master plan to the Board showing the locations of the proposed and existing wells, and septic systems throughout the subdivision prior to issuance of any building permits. Building permits will not be approved by the Board of Health on individual lots until the well is installed and certification submitted as to the bacteriological and mineral content of the water by a State Approved Laboratory. The water must meet all of the standards established by the Safe Drinking Act of 1974, revised 1986 and all the standards of the Board of Health's Private Well Regulation effective June 1, 1989. The developer shall have recorded on the deed that no variances from Title 5, Minimum Requirements for the Subsurface Disposal of Sanitary Sewage, and the Town of Barnstable Health Regulations will be granted on any lot in this subdivision. A percolation test must be made on each lot, at each leaching site, before a Disposal Works Construction Permit will be issued. Maximum ground water elevations must be determined by using data available from the United States Geological Survey - Probable High Ground Water Levels on Cape Cod, Mass. Each proposed septic system must conform strictly to 310 CMR 15.00, the State Environmental Code, Title 5, and Town of Barnstable Rules and Regulations. All tree stumps, brush and building debris removed when clearing lots or roads must be disposed of at a licensed solid waste disposal facility. Chipping brush and tree stumps is an acceptable alternative. Burial on site is prohibited. The applicant must receive an Order of Conditions from the Conservation Commission, if applicable. The Board of Health recommends that all drainage be contained on site at each lot. Proposed private water supply wells shall be constructed at least 100 feet from the railroad right-of-way due to herbicide spraying. The developer shall have recorded on the deed that underground fuel and chemical storage tanks cannot be installed or maintained on property within this subdivision. Prior to Board of Health approval of each building permit, the sewage system and water supply must conform to 310 CMR 15.00, the State Environmental Code, Title 5, and Town Health Regulations. Lots on the plan which are located within 300 feet of wetlands; it is recommended that each sewage disposal leaching facility be located most distant from wetlands to reduce eutrophication caused by nitrates, phosphorous and other nutrients. The United States Environmental Protection Agency's National Eutrophication Survey states that 0.25 lbs. per year of total phosphorous enters wetlands from every person served by onsite septic systems within 300 feet wetlands (US EPA 1980). Very truly yours, Susan G. Rask, R.S., Chairman Brian R. Grady R.S. Ralph A Mur iy, M.D BOAF1: F HEALTH TOWN BARNSTABLE. Page 35 (R&R)4-2.3. Dear End Streets. The extension ofBriar Lane for this subdivision will require a total road length(from Sandy Neck Road to the beginning of the new cul-de-sac) of approximately 1050 feet At our first meeting with the Board Fire Chief Jenkins spoke in favor of our proposal as long as the new numbering of homes was consistent with the current numbering. We also feel that the addition of a full cul-de-sac of radius 60 feet will make this area safer and much easier for the Fire Department if their services were needed At the present time it is impossible for an engine to negotiate a turn around maneuver at the end of Briar Lane. The temporary cul-de-sac is no where near large enough, and any engine needed would have to back out of the street. 2. Page 6-(R&R) 2-1. Street Minor A. The current road has a Width of Way of 40 feet and a paved width of approximately 19 feet. It would be in keeping with the Sandy Neck area to allow the extension to be maintained at these values of 40 feet and 19 feet rather than the values of 50 feet and 20 feet found in the Design Standards of the Rules and Regulations. The Planning . Department in their memo of August 1, 1996 had the same feeling as to the maintaining of the current widths. The area is rural and aesthetically the current widths are in keeping with this part of West Barnstable. 3. Page 39/40 (R&R)4-5.1 and/or 4-5.2. There are no sidewalks on either Sandy Neck Road or Briar Lane. In keeping with the rural nature, lack of significant foot traffic, and aesthetics of the area,we feel sidewalks are unnecessary.
