This variance is granted with the following conditions: (1) A composting toilet shall be installed and utilized. (2) Only greywater shall be discharged into the cesspool. (3) No more than one (1) bedroom is allowed. Dens, study rooms, finished attics, sleeping lofts, and similar-type rooms are considered bedrooms according to DEP. (4) No increases in design flow or expansions of the existing dwelling allowed. (5) The applicant shall record a properly worded deed restriction at the Barnstable County Registry of Deeds which includes the restrictions described above in conditions#3 and#4 of this letter. This variance is granted because it is the Board's policy, at this time, to encourage the use of composting toilets at the Sandy Neck cottages instead of requiring the installation of septic systems. Request the Board reconsider the matter at its next meeting (September 11, 2001) . The special condition placed on the approval of a permanent deed restriction limiting the building to one bedroom imperils the pending sale of the property, and, upon reflection, may be unnecessary from a regulatory standpoint. I am seeking relief from unintended injury. I would appreciate the opportunity to explain to the Board why another course will better serve public and private interests, and why the special condition should be rescinded.
