Dear Mr. Ojala,
You are granted conditional variances on behalf of your client, Trisko Family
Trust, to install two composting toilets and to replace the existing wooden basin
with a precast leaching pit at 270 Sandy Neck, West Barnstable. The following
variances were granted:
Section 360-1 of the Town of Barnstable Code: Replace existing cesspool
with leach pit in accordance with 15.289 (1) (b) (3); maintain within 100' of
surface waters.
Section 397-8 E (1) (f) of the Town of Barnstable Code: To maintain the grey
water system less than 150 feet from an existing well.
This permission is granted with the following conditions:
(1) The dwelling is restricted to three bedrooms as currently exists. No
additional bedrooms will be authorized at this property.
(2) The applicant shall record a properly worded deed restriction, signed
by the property owner, at the Registry of Deeds restricting the number
of bedrooms to three at this property, before obtaining a disposal
works construction permit.
(3) The back building (work space/boat storage) with a compost toilet will
not be converted to a habitable space.

(4) The alternative technology toilet system shall be built to NSF-41
standards and installed in strict. compliance with the manufacturer's
recommendations and all applicable requirements of 248 CMR 2.14, 2.15,
and 2.16.
(5) The applicant shall ensure that the plumbing components of the
system are installed by a licensed plumber.
It is recommended that the onsite well water shall be tested by a certified
laboratory for the following parameters: pH, conductivity, sodium, iron, coliform
bacteria, and nitrate-nitrogen.
This permission is granted because the physical constraints at the site severely
restrict the location of a conventional onsite sewage disposal system. It is the
opinion of this Board that the installation of a composting toilet would meet the
maximum feasible compliance standards contained within the State
Environmental Code, Title V.

The enclosed represents a modified variance filing as a result of the-comments
presented at the Board of Health meeting of December Sth.,,W.

The existing septic system, consisting of a cesspool-type structure, will be replaced
with a leaching pit in accordance with 15.289 (1) (b) (3), which will handle 178
gallons of graywater per day, which is over 50% of the required design for a 3
bedroom dwelling when utilizing composting toilets. Two State-approved Sun-Mar
composting toilets are proposed; one for the main dwelling which will service the
upstairs bedrooms and one for the workshop building to the rear. The pit will consist
of a precast 6' diameter pit with 4' of stone around, by 2' effective depth, the base of
which will be 3' above groundwater. A filter will be fitted on the inlet pipe, in
accordance with 15.262 (2), in lieu of a septic tank.
The number of bedrooms for the cottage is unchanged at 3. That they don't fit the
definition under Title 5 is expected in this circumstance, e.g., no electricity and not
enough headroom, due to the site conditions and age of the cottage. However, the
cottage has always been used as a 3 bedroom and the bedrooms meet the definition of
providing privacy and intended only for sleeping. Further, the definition states that
"single family dwellings shall be presumed to have at least 3 bedrooms". Raising the
ridge height, as is proposed, creates more headroom within each of the 3 bedrooms; as
such they still do not meet the technical definition of a bedroom under Title 5. A
conversation with Brian Dudley,of DEP outlining the above information yielded an
opinion whereby DEP would consider the existing dwelling as containing 3 bedrooms.
Hence, there is no increase in bedrooms for this site.
The uniqueness of Sandy Neck must be taken into consideration in this situation.
Extremely low water useage and the seasonal nature of the area must be factored in
when a new septic system is considered. Composting toilets and a 50% reduced area
v
graywater system are an improvement over what exists. In July of 2004, the Board at
that time approved a variance for similar conditions, as permission was granted to
install a composting toilet, as it"would meet the maximum feasible compliance
standards contained with the State Environmental Code, Title V". The approval was
granted under 15.285 of Title V '95 —which is, verbatim, identical to 15.289 of the
April 2006 Code.
We feel that by granting these variances, the same degree of environmental protection
can be attained without the need for strict adherence to the Town of Barnstable
Regulations.

Dear Mr.. Carey,
You are granted permission to. install a composting toilet and .to continue to
utilize the existing basin for greywater discharge at your cottage located at Sandy
Neck, West Barnstable. This permission is granted with the following conditions:
(1) The dwelling is restricted to one bedroom as currently exists. No
additional bedrooms will be authorized at this property.
(2) The applicant shall record a properly worded deed restriction, signed
by the property owner, at the Registry of Deeds restricting the number of
bedrooms to one at this property, before obtaining a disposal works
construction perr.it.
(3) The alternative technology toilet system shall be built to NSF-41
standards and installed in strict compliance with the manufacturer's
recommendations and all applicable requirements of 248 CMR 2.14,. 2.15
and 2.16.
(4) The applicant shall ensure ,that the plumbing components of the
system are installed by a licensed plumber..
(5) The plumber shall notify the State Plumbing Board (phone # 617 727-
9952) as to the location of the system being installed, the name of the
applicant, and the manufacturer's name and model number.

(6) The onsite well water shall be tested by a certified laboratory for the
following parameters: pH, conductivity, sodium, iron, coliform bacteria,
and nitrate-nitrogen.
This permission is granted because the physical constraints at the site severely
restrict the location of a conventional onsite sewage disposal system. It is the
opinion of this Board that the instatfation of a composting toilet would meet the
maximum feasible compliance standards contained within the State
Environmental Code, Title V.

The enclosed represents a variance filing for the above-referenced site.The following
variances are requested:
Under Barnstable Article I-
Section 360-1: Maintain existing cesspool within 100' of surface waters
Section 360-9: Request variance to maintain existing cesspool
Art II: Section 397-8E(lf): Maintain existing cesspool less than 150' to wells
The owners propose the following improvements to their cottage and separate
workshop/play area- Replace the piling foundations and raise both structures above
the floodzone elevation, convert the deck on the cottage to a roofed porch and raise the
ridge line to allow for more headroom in the upstairs bedrooms. There is no increase
in the footprint of either structure, nor will there be any increase in the number of
bedrooms.
Currently there is a cesspool-type structure which serves the sink, shower and toilet in
the workshop. There is one(kitchen) sink with hand pump in the cottage which is
Wiped to a small basin. The owners propose to install 1 Sun-Mar composting toilet in
the cottage (to replace a Porta-potti) and 1 Sun-Mar in the workshop. The cesspool
structure is proposed to accept sink water from the bathroom and kitchen in the
cottage and the sink in the workshop. This structure has a cover to grade.
The cottage is used during the summer months only. It has no dishwasher or laundry
facilities. No electricity is available. An outdoor shower is used for the majority of
the bathing. Given the unique conditions in this area, it is felt that this is the most
feasible and least environmentally disruptive solution for this site. We feel that by
granting these variances, the same degree of environmental protection can be attained

without the need for strict adherence to the Town of Barnstable Regulations.
