The project change description should include: (a) a brief description of the project as most recently reviewed There are two parcels of land proposed to be exchanged in this project. One containing the West Barnstable Shooting Range and the other referred to as The Breed's Hill Road parcel. The following is a description of the existing conditions and land uses of each parcel. The West Barnstable Shooting Range is located on the Town of Barnstable's West Barnstable conservation area (Exhibit 1). Records indicate that on March 8, 1967, Town Meeting voters authorized the Town to acquire tracts of land in West Barnstable by gift, sale, or taking for conservation purposes and passive recreation (MGL Ch. 40 s 8C). Some individual parcels would be bought in the coming years. Most of today's range occupies what is known as parcel 15. The parcel consists of approximately 30 acres and was purchased by the Town on July 6, 1970. The range is in an area bounded by Service Road to the north and the West Barnstable Conservation Area on the three remaining sides. The existing shotgun, rifle, and pistol portions of the range are approximately 3.5 acres. The West Barnstable Conservation Area Management Plan dated June 1992, states, "This 12 acre site has been in use for over 30 years. It was designated a range by the Conservation Commission in 1984, with formal rules and regulations being adopted at that time." A restricted area has been established around the range to physically prevent unauthorized access into the shooting range. The total area of the existing range (3.5 acres) and restricted buffer area (12.8 acres) is approximately 16.3 acres (Exhibit 2). The Breed's Hill parcel is located south of Breed's Hill Road in Hyannis (Exhibit 3 &4). The parcel is approximately 17 acres of wooded upland containing two low areas identified as vernal pools. The municipal parcel was purchased as open space to protect the immediately abutting Barnstable Water District public water supply well. The parcel is also part of a contiguous tract of open space lands north of the Barnstable Municipal Airport, south of the mid-cape highway (Route 6) and west to Yarmouth Road (Exhibit 5). The Barnstable Conservation Area, which includes the area identified as the Shooting Range was the subject of state a Self-Help grant, which grant agreement was recorded against the entire property. The Town of Barnstable Conservation Commission received a letter from the Division of Conservation Services on September 23, 2013, stating that "If the Town wishes to keep the range open and that is safe and in compliance with current best management practices may result in the loss of useable conservation land that is accessible to the public for passive recreation. Should this be the case, Executive Office of Energy and Environmental Affairs may require the Town to mitigate the loss by dedicating to conservation and passive recreation use land of equal or greater size and value." The Executive Office of Energy and Environmental Affairs recently determined that a review under the Massachusetts Environmental Policy Act (MEPA) was required before the Shooting Range could be released from the requirements of the Self-Help grant program and exchanged for another parcel equal in area and value (Breed's Hill parcel) through the Article 97 process. The proposed project is for the exchange of said lands. 4 (b) a description of material changes to the project as previously reviewed After additional review of the historic location of the West Barnstable Shooting Range including the shot fall area surrounding the shooting range, it was determined that a larger acreage was required. The area of the shooting range was increased from 16.3 +/- acres to 26.4 +/- acres (Exhibit 6). The Town reviewed the proposed change to the area of the shooting range and along with the screening process used to evaluate other potential parcels to add to the original 17-acre Breed's Hill Road parcel so that no net loss of conservation land would result from this proposed change with the Division of Conservation Services. An upland wooded municipal parcel abutting existing conservation land on Lumbert Mill Pond was identified for this purpose (Exhibit 7). The Town presented the increased shooting range area to the Barnstable Conservation Commission on October 18, 2016 and it was approved (see attached minutes) as modified. The original 17 +/- acre parcel identified in the initial filing plus an additional 10.25 +/- acre parcel of wooded upland abutting Conservation land on Lumbert Mill Pond (Exhibit 8) combined for a total acreage (27.25 +/- acres) of municipal land to be transferred into conservation lands. (c) if applicable, the significance of the proposed changes, with specific reference to the factors listed 301 CMR 11.10(6), and j The project acreage is increasing from 16.3 acres 26.4 acres with a corresponding increase in the compensatory acreage from 17 acres to 27.3 acres; therefore there will be no increase in negative environmental consequences. (d) Measures that the project is taking to avoid damage to the environment or to minimize and mitigate unavoidable environmental impacts. If the change will involve modification of any previously issued Section 61 Finding, include a draft of the modified Section 61 Finding (or it will be required in a Supplemental EIR). According to the ENF,it is a wooded parcel containing vernal pools and was identified by the Natural Heritage and Endangered Species Program(NMSP)as containing Priority Habitat for Rare Species. During the review period, the Town provided an analysis of the value of the 16.3-acre shooting range parcel and the 17-acre Breed's Hill Road parcel prepared by the Barnstable Director of Assessing. According to the analysis,the Breed's Hill Road parcel has a current value of$1,015,300,which could rise to$1,500,000 if the lot were subdivided,and the shooting range parcel has a value of$1,006,000.00. The.ENF included two alternatives to the land transfer. One alternative would maintain the shooting range as an active use under the BCC's jurisdiction pursuant t6M.G.L.c.40 s.8c,il but transfer the Self Help Grant requirements onto another parcel. The Town determined that this alternative would not be the most effective way to make the necessary improvements to the range to operate it in accordance with modem standards of safety and lead management..The second altermative would be to close the shooting range permanently,but this alternative is contrary to the Town's purposes. I received many comments from residents requesting that the Town further document the land transfer in a Draft and Final Environmental Impact Report(EIR). Residents expressed concerns about consistency with the Article 97 Policy;impacts to recreational uses in the WBCA associated with reopening the shooting range;the potential for lead to leach into the soil and contaminate groundwater that is a source of drinking water;and noise impacts to surrounding neighborhoods,, I note that the Town has not made a determination as to whether the facility will be reopened.In determining whether it will be reopened the Town will consider measures necessary to.construct and operate a safe and modern facility and associated costs.The Town will conduct further assessment of the site and identify the cost of site remediation. According to the Town, there is no other location available in Bamstable for the shooting range,and reopening the range on its existing location is preferable to establishing a new site.In light of the historic use of this site as a shooting range,a lack of clarity regarding when this use began and whether it was consistent with the conditions of the DCS grant,and an agreement to provide compensatory open space to offset its loss,I have determined that exceptional circumstances exist that support disposition of the land. In their comment letters,Mass Audubon,the Barnstable Land Acquisition and Preservation Committee,and the Barnstable Fire District Water Department noted the significant .� environmental value of the Breed's Hill Road parcel for the protection of the water supply,rare ,\ species habitat,and vernal pools. As noted previously,the Town provided an analysis of the value of land concluding that the Breed's Hill Road parcel,in addition to being slightly larger than the shooting range site,has a monetary value that exceeds that of the shooting range parcel. The Town has made a commitment to improve the environmental conditions and recreational resources at the site and surrounding portions of the WBCA. The Town will conduct additional environmental assessment of the shooting range and adjacent areas,develop a remediation plan,and implement procedures to manage lead in the future if the shooting range is reopened. The Town has also indicated that it will update the facility and implement modem practices for the safe use of the facility.Although the parcel will no Ionger be dedicated to conservation,it will be available for public use and the Town may revise permit programs and establish additional limits on operations that-could address concerns expressed by residents regarding increased use. i The shooting range occupies 3.5 acres and the Town has identified a safety buffer area of 12.8 acres around the facility that will have restricted access. The Town has indicated that a larger buffer area has not been included-in the shooting range parcel in order to minimize the impact to Article 97-protected land in tha WBCA. I encourage the Town to consider creation of additional trails throughout the WBCA to mitigate for the loss of those trails affected by the buffer area. 4 EEA# 15284 ENF Certificate December 24,2014 Lead Management Many residents commented about the unabated lead that is present at the shooting range. Soil samples collected by the Town indicate that lead levels may be significantly higher than the 200 milhgrams/kilogram(mg/kg)threshold established by MassDEP.The West Barnstable • Water District expressed its concern about the potential for the lead in the soil to migrate into the groundwater because the shooting range is upgradient of residential drinldng water wells. According to MassDEP,contamination of the groundwater by lead is unlikely.The groundwater is approximately 120 to 130 feet below the surface of the site and conditions that typically contribute to lead mobility,such as extended contact with groundwater or surface water,including wetlands,are not present at the site.MassDEP recommends that the Town continue adding lime to the soil at the shooting range to ensure that the soil pH remains neutral;- which will further reduce the potential for impacts to groundwater. Barnstable fire Address: Telephone.Number: Complaint Description: Found a 55-gallon drum of oil in the parking lot on its side. Small bunghole missing, with a small amount that dripped out. Actions Taken/Results: Drum was turned to have small bunghole on top. Two oil booms were put down to catch any oil that was in the water flow from the rain. Sand was place behind the boom for reinforcement, and some sand was spread around original area of drum. A plug was put in the small bunghole. The drum was then placed into an over pack drum and taken to W. Barnstable fire department for later removal. Drum has the following label: Yamalube-2; certified TC-W3; product code 25455; Batch code 4117C2916; 166/220 4- photos on file.
