We respectfully address this board with some real and valid concerns pertaining to the proposed development of 52 Buttonwood Lane We realize that the health dept. and the conservation dept. have two very different agendas and we have tried to keep these issues separate, but it would seem that they are closely related in their concerns. We submit for your review copies of some of the perk tests done during the 1980's on lots 8 & 9 also known as lots 40 & 41 respectively.. In reading the subdivision review prepared in Nov. 1976 by Gary Parker ,soil conservationist with the USDA-soil conservation service. we came across this passage on page 3. "Soil underlying much of the Watergate West subdivision presents severe limitations for the ' installation and operation of septic tanks due to wetness. Care should be taken to avoid encroaching on existing surface drainage ways. As development of the subdivision progresses, more and more land will be covered with impervious surfaces(pavement and roof tops). This will increase the storm water run off." A past history of these lots have produced unsuitable perk tests. These previous perks have shown oxides at various levels indicating long term standing water, water running through sand at different levels , stained sand and weeping. In summation, and for many different reasons they simply never properly perked. The current proposed septic location, as well as the backup location are ironically in previously unsuitable site locations based on tests performed by Arnie Ojala of down cape engineering. in 1980 After approximately 16 years of proposed building activity but non productive perks, both lots 8 and 9 were declared state class 132-non buildable properties, and assessed accordingly. We are not naive and realize, that in some instances with the advancement of septic designs that these status's could change, but the fact remains here that the land hasn't changed and it is still remains unaltered clay and wetlands and run off is a common occurrence. Whenever there it rains, the pavement on Buttonwood running along lot 8 remains wet for several days from run off The street drains themselves on Buttonwood remain full or nearly full year round because there is no nowhere for the abundance of ground water.. The swail on our property that is approximately 150 feet from the proposed septic site, directs the run off from lots 9 & 16 to the pond on lot 16.. This is one of the major reasons why this historically unproved septic site is of such deep concern. In a discussion I had with a member of the health dept. two weeks ago, the perk test done for tonight's hearing was termed "questionable" There appears to be a four foot natural occurring permeable below the water table thus creating weeping. My husband observed this test. The test hole was dug, the soil types noted but no actual perk test was conducted. The test hole filled with ground water as the clay walls slipped into it. Our understanding of the 1995 DEP's code of Massachusetts regulations for title five states in sectionl5-104 paragraph 2 states that percolation tests shall be required in the soil. How was this site passed? Also in this same DEP's State Environmental code for title 5, in sections 15- 106 Landscape Position and 15-107 Hydr.ogeologic Properties, there are many pertinent conditions that apply here that seem left un-addressed. Considerations of the directional flow of the ground water, questions of drainage, proper lateral distance to surface water and wetland delineation's. We are all aware that the capes codes are even more stringent than the DEP's. These issues are very pertinent. to the people that live here for the following reasons. There are three major ponds in this development. They are linked together by a series of small underground rivers, which have been designated on a subdivision map prepared by down cape engineering. These rivers flow year round because of underground springs and these are what feed our wells and the three ponds. The directional flow of ground water is in a northern direction towards the marsh. The potential of "questionable" or inadequate septic systems in this neighborhood, will pose the future possibility of ground water contamination. We are not slated for town water anytime in the future. In addition, the proposed house on lot 9 is to be built on a raised mound, four feet above the current level of the ground. This is so that there will be gravitational flow from the home to the septic. Lot 41 is already 6-8 feet higher than the water table of the pond. Lot 16 is the lowest lot in the subdivision. More height above the water table will truly add to the current run off problems of Buttonwood Lane. This building up of the land in conjunction with a questionable septic site, one worries what impact the alteration of this land will have for the wetlands. In regards to the pond on lot 16, this raises questions of future pond and ground water contamination. With the northern directional flow of ground water, there is great concern for the future contamination of the water of our pond, our well beyond that, the pond directly across buttonwood lane on lots 11&12, the wetland zones on lots 40-41 and lots 11,12 and 16. And the major concern for the underground rivers and springs that feed our 1 wells continuing to travel north into the marsh. There does appear to be the potential for contamination. We note that distances on the soil suitability form and the site and sewage form appear to be estimates. The distance from the proposed septic site to the pond is in actuality 111 feet at it's closest and 148 feet at its farthest. Other measurements are curious. So, in this forum, we come to you for the continued protection of the ponds and most importantly our drinking water. There were reasons these two lots had not been allowed to be built on for the last 30 years. The long and documented 'history of incompatibility for this area speaks for itself. We close citing the DEP's State Environmental Code for title 5 minimum requirements.. Many of the required procedures have not been properly administered because they could not or would not pass?
