Re: ZBA Appeal No. 2022‐029 Leveroni Special Permit
Request for Construction Site Logistics Plan as a requirement for Special Permit.
Dear Members of the Zoning Board of Appeals:
The Barnstable Yacht Club is a direct abutter to the subject property via our ownership of
Beale Way which serves as primary or secondary access to 15 other parcels. Our concern with
the proposed construction is for the safety of our members using Beale Way during the
construction period.
We have reviewed the “revised plans” submitted for a one story proposal and again
respectfully request the Zoning Board of Appeals only approve a Special Permit after a site
safety and construction logistics plan is defined and made part of the approval.
The subject property is at the at the intersection of Rte 6A where there is congestion and
vehicular conflict as automobiles, trucks, pedestrians, and youth on bicycles all enter the way
through a single lane access. We attach herewith a photo of recent tree work at the subject
property which shows the terrible congestion. A contractor cannot be relied upon to do this
after the fact with approval from ZBA in hand.
Some of the topics which we would expect to be addressed in a site safety and logistics plan
are:
Congestion: Where will contractors park? How will construction deliveries take place? Where
will materials be stored? Will construction take place during summer months?
Safety: How will access be maintained? Will construction be phased? Will the work impact life
safety and access to other properties? Is this something the Barnstable Fire Department needs
to review also?
Protection and duration: How will an open excavation be protected? Will the site be fenced?
What is the duration of construction?
We respectfully request the Zoning Board of Appeals require a framework for site safety and
logistics as part of the Special Permit.
