Could you please add the attached Superseding Order of Conditions and plan to the Martin file.
I’m sorry to be so late with this but I know the Commissioners are familiar with the Welo project.
Their inclusion in the Martin file is for the purpose of illustrating that DEP generally believes the conversion
of seasonal to permanent piers meets the requirements of MGL Ch 131 sec 40 and 310 CMR 10 for
protection of Land Under Water and Containing Shellfish, Prevention of Pollution, Storm Damage
Prevention and other interests of the Act, even where mapped shellfish habitat values are high (Welo
mapped as an “8” similar to Martin).
The Welo SOC also provides, on page 13, a list of Special Conditions which, except for #1 which cite the
Welo pier dimensions, would all be appropriate for the Martin pier.
