Dear Ms. Newman:
Your request for a variance from Regulation 22 - Mobile Food Service enacted July 19,
1978, to operate two (2) "Mobile-Units" at 946 Craigville Beach Road, Centerville, MA.,
is not granted.
You are reminded that Regulation 105 .CMR 590.003 states At all times, including while
being stored, prepared, displayed, offered, dispensed, packaged, or transported, food shall
be protected from cross-contamination between foods and from potential contamination
by insects, insecticides, rodents ... coughs and sneezes. or other agents of public health
signif icance."
You did not introduce an acceptable method for the protection from insects, coughs, sneezes
and other agents of public health significance at the hamburger and hot-dog unit and slush
cart, which you identified as a "mobile unit", during preparation, offering, and dispension.
You are also reminded that a mobile food unit is defined in the State Sanitary Code for.,
Food Establishments, Article X, as follows: "Mobile food unit means a vehicle-mounted
food establishment designed to, be readily movable". A "push cart means a
non-self-propelled vehicle limited to serving non-potentially hazardous foods or wrapped
food prepared at a food processing or food service establishment and maintained at proper
temperatures, or limited to the preparation and service of frankfurters". You stated the
carts are to be connected to motor vehicles for moving; therefore, the carts are not mobile
food units.
Also, your letter dated May 14, 1990 decribes taking hamburgers, which are potentially
hazardous foods, (and other foods), from one 'refrigerated container on one "cart" and
placing the food onto the grill located onto another "cart". However, the cooking of
hamburgers on a pushcart is not authorized according to the State Sanitary Code as stated
in the above pushcart definition.
You are also advised that the proposed use, if. conducted on private land, may violate
the zoning in the area. Pursuant to G.L.c. 40A. s.7. "...no permit or license shall be granted
for a new use, building, structure or land which use would be in violation of any zoning
ordinance or bylaw."

You are reminded that the State Sanitary Code, Article X states that a variance may
be granted only when, in the opinion of the Board of Health, the enforcement thereof
would do manifest injustice provided, that the decision of the Board of Health shall not
conflict with the spirit of any minimum standards established by these regulations. You
did not introduce any manifest injustice and your proposal conflicts with the spirit of
the minimum standards established by the regulation.

I am very disturbed by your denial of my application for my mobil
unit located on my property at Craigville Beach. I believe I
met all the criteria required under the Town of Barnstable
Bylaws.
Enclosed for your review, please find a copy of the Towns Bid
Sheet from the Recreational Department that has gone out
requesting bids for mobil food service units located on town
property at beaches. What this tells me is mobil units are
allowed if income is generated to the town. I believe that I am
entitled constitutionally to equal treatment under the law.
The enclosed bid sheet for these concessions requires the mobil
units to bide by Article #10, Regulation #22. As you know, my
application as submitted met all criteria under Article #10.
Please submit to me in writing why my application was denied!
If the Board of Health approves the mobil units per the bid sheet:.
that has gone out from the recreational department, you will have=
caused me damages.

GENERAL SPECIFICATIONS FOR MOBILE BEACH SNACK BAR CONCESSION
CRAIGVILLF., _BFArH
1. Flat fee proposal for term of contract.
2. Contracts are -awarded for one (1) year (1990 season only).
3. Total proposal payable in advance.
4. Service to include hot and cold drinks, hot dogs/hamburgers (if"unit properly
equipped), variety of .sandwiches, ice cream, and other snack bar items. The
operator must serve quality food and beverages.
5. The sites may be seen by appointment.
6. Maintain the property of the,Town in the same condition as it is found,
reasonable wear and tear excepted.
7. General area policing and cleaning to be the responsibility of the operator.
8. Commission will provide outside trash containers and trash removal.
9. Hours of operation:
a) Seven days a week, holidays included, from 10:00am to 5:00pm, beginning
June , _ through- Labor Day.
b) The above conditions subject to weather and area population.
c) Multiple .sites must each be visited twice daily by concessionaire.
10. The Commission reserves the right to cancel the- contract if the operation i's
improperly run, or if the quality of the food is not satisfactory.
11. Commission and employees of the Commission or Town of Barnstable are not liable
for any loss,' accident, damage, injuries,. ,or theft during the period of the
contract.
12. Concessionaire agrees to carry Workerls Compensation insurance. Certificate of
insurance must be on file. in the Recreation office prior to commencing operation.
13. Concessionaire- agrees to maintain liability insurance naming the Town, as its
interests appears and insuring the Town against personal injury occurring on
the premises which are the subject of the letting, or resulting from any act
or activity, or the service of food connected therewith, in minimum limits of
$200,000 per person and $500,000 per accident for personal injury;. and $25,000
for property damage, and to provide the Town with evidence that said insurance
is in full force and effect during the term of the agreement.
14. Commission reserves the right to reject any and all proposals and to award
contracts in the best interest of the Town.
15. Commission reserves the right to request submission of financial statements,
reflecting income, expenses, and labor costs.
16. Concessionaire must fulfill and abide by Article #10, Regulation #22 of the
Massachusetts Sanitary Code. (Available at the Department of Health.)

Re: Variance - Mobil Food Unit
Gentlemen:
I am requesting a variance from Regulation 22 Mobile Food Service
Article X.
I believe I have followed the appropriate channels in applying
for all licenses pertaining to this matter. Approval from this
Board for the variance of regulation 22, is the final step. I am
currently licensed under the Peddlers Hawkers permit by the
State of Massachusetts.
My plan is to have two mobil food units located on my ,, land at
946 Craigville Beach Road, Centerville, Massachusetts.% I call
these units mobil because they will be attached to my -vehicle by
trailer hitch so that transportation to our base outside the site
will be possible (see attached photos) .
Equipment: The first of the two units is a slush mobil unit
consisting of a freezer containing slush and some prepackaged
ice creams. The slush will be scooped from the container into
paper cups and served to the customer.
The second mobil unit is a food mobil unit. The mobil food unit
is designed to stock, refrigerate and grill food such as hot
dogs, hamburgers, etc. The unit is equipped with a water system
under pressure. The system shall be sufficient capacity to
furnish enough hot and cold water for food preparations, utensil
cleaning and sanitizing and handwashing in accordance with Mass.
Department Public Health 105 SMR 590 . 005, 590. 0131 and 590. 019
(see attached regulations) .
There is also in the mobil unit a waste retention tank. Liquid
waste will not be discharged from the retention tank when the
unit is on the property. The waste will be disposed of daily

either at the licensed restaurants grease trap or disposed of at
k' the Barnstable sewer plant per local codes.
j Also per state codes, the mobil food units need to have adequate
toilets and handwashing facilities available. The location of
H the mobil units in relation to my hotel would allow access to
both mens and women' s bathroor,s located within the lobby of my

hotel .
Also supplied on the mobil unit is a refrigerator to keep all
perishables cool . While awaiting prep--ration, the unit is
arranged so that food, drink and utensils will not be exposed to
insects, rodents, dirt or other contaminates. All articles of
food and all food shall be in cldan single-service containers.
i Paper plates and plastic forks will be used to serve the food.
l All beverages such as juices and soda will also be kept in the
refrigerator located on the unit, only cans of soda and/or
Juices will be served. Any condiments such as relish, mustard
and ketchup will be of the prepackaged type, non-perishable. The
food will be taken from the refrigerated container on the cart to
the grill located on the cart for cooking. All food .:will be
cooked to order and served to the
customers.
Operative Experience• The personnel who will be operating and
selling are and have been in the food service business for over
twenty years. Each owning, selling and servicing the public in
restaurants , bars and ice cream parlors. Knowledge of
preparation and protection of food is the number one concern o£f
operations. All food will be sealed in containers or other
necessary protective cartons, refrigerated or frozen as needed.
Disposal of Waste and Clean Up• At the end of each day, the
mobil units will return to the base located at the Old Village
Restaurant located on Route 149, Marstons Mills, MA as required
by Regulation 22 Article X of the Barnstable Board of Health.
The Old Village Restaurant will be the fixed food service
establishment that we will be operating out of. They are
currently licensed by the Barnstable Board of Health. (See
attached copy of license and letter)
At the end of the day, the mobil food unit will be totally
cleaned including grill , refrigerators, water systems, etc. The

waste retention tank will be emptied into The Old Village
Restaurant and all foods will be removed from the mobil unit to
the refrigeration units within the restaurant.
Since I will be operating on my own property at 946 Craigville
Beach Road, Centerville, Ma and have no intention of moving off
my property onto public property, I would not be disrupting
vehicular flow nor be creating a nuisance or hazard. I. do not
believe that this approval would set any kind of precedence for
future, similar services in that area since I own the particular
property that I would be selling out of. In addition, I am
paying taxes as commercial property on over 2 . 70 acres of land.

Although there is plenty of parking available on my site, I
believe that most of my customers would be from foot traffic,
similar to the other restaurant located down the street.
I am also convinced that there is a great need in that area for
another food establishment preferably temporary like my own
concept to service the needs of the people that are using the
beach during the summer months. There is only the garnacle
Restaurant within walking distance on the beach and - between
$8 . 00 per day parking and a $4 . 00 hot dog at the Barnacle people
visiting the Cape pay $12 . 00 to go to the beach. By operating
within the same area, the competition may be a healthy economic
barometer and good economic competition.
I promise to abide by all guidelines and regulations set forth by
the state and Town of Barnstable Codes and pray that the Board
approve my request for my mobil units.
I have recently bought this property and desperately need to
create additional income to pay the increased taxes and get the
property in the condition that this lovely neighborhood deserves .
I pray that the board approve my request.
