We believe we have been diligent in keeping with the conditions of the variance and are now waking on permits to bring in water and utilities. The present economic conditions have waked a hardship upon us and have led us to request this extention. We will, of course, be happy to meet with the board to answer any questions you may have concerning this extension. We have donated a lot to the Town of Barstable for conservation purposes and now have offered another lot to the town for their consideration. The designing engineer must perform a percolation test in the fill used for the proposed on-site sewage disposal systems before and after placement as required by 310 CMR, 15.02 (17) , of the State Environmental Code Title 5: Minimum Requirements for the Subsurface Disposl of Sanitary Sewage. ( 2 ) The septic systems must be installed in strict accordance with the final approved plans and must meet all of the regulations contained in 310 CMR 15.00. Watercourses are defined in Regulation 15.01, of 310 CMR 15,00, the State Environmental Code, Title 5, Minimum Requirements for the Subsurface Disposal of Sanitary Sewage. Subsurface sewage disposal kystems shall be located in an area where there is at least a four foot depth of naturally occurring pervious soil below the entire area of the leaching facility and the designated leaching reserve area. This four foot depth of naturally occurring pervious soil must be above maximum ground water elevation. The maximum groundwater elevation shall be determined by utilizing the formula contained in the United States Department of Interior Geological Survey publication, "Estimating Highest Groundwater Levels for Construction and Land Use Planning - a Cape Cod, Massachusetts, Example", dated September, 1983, or by observing the height of the groundwater table when it is at its maximum level or elevation. Maximum groundwater determinations shall be made during the wettest season of the year - normally March or April. The Barnstable Planning Board approved the subdivision of Evson Drive and six lots on May 20, 1974. The applicants bought the property in 1987 with the expectation of building on the lots. The water adjustment for this area in October, 1986 (using the U.S.G.S. method) is 5.2 feet so none of the lots can satisfy the Barnstable Bylaw requiring the 4 feet of natural pervious soil. However, maintaining the 5.2 foot adjustment, systems were designed for Lots 5, 6, and 7. Unsuitable soil is to be removed for twenty-five feet around the leaching area and clean medium sand is to be placed there to obtain the necessary distance to the adjusted ground water. We are requesting a variance on behalf of the applicants since we believe that the enclosed sewage design for the lots will provide adequate separation from ground water and suitable separation from water courses. The nearest watercourse is over 500 feet away. It is the intention of the applicants to file a new plan with Planning Board to eliminate lots 8, 9, and 10. Also, plans have been prepared to be filed with the Conservation Commission which address the environmental problems associated with the road construction (we have attached copies of these plans). The sewage flow for the proposed development of lots 5, 6, & 7-10 (as one lot), is 990 gallon for 2.99 acres, or 330 gallons per acre. This is in compliance with the Barnstable Board of Health recommendation allowing a residential flow of 330 gallons per acres per day for sewage in well recharge zone of contribution. However, the proposed development is not within a zone of contribution as as shown on the town maps. Therefore, we believe that granting the variance requested with the conditions outlined above will not be detrimental to the interests of the community in preserving the water supply. This variance will allow you to install an onsite sewage disposal system at Lot 5, Evson Drive, Centerville, Ma., with the following conditions: f (1) The designing engineer must furnish a sewage disposal system plan including the location of percolation tests and the construction of the mound listing any erosion preventative measures, prior to obtaining a Disposal Works Construction Permit from this department. (2) The designing engineer must perform a percolation test in the fill used for the proposed on-site sewage disposal system before and after placement as required by 310 CMR, 15.02 (17), The State Environmental Code Title 5: Minimum Requirements for the Subsurface Disposal of Sanitary Sewage. (3) The septic system must be installed in strict accordance with the final approved plan, and must meet all of the regulations contained in 310 CMR, 15.00. The submitted plan shows the reserve leaching area only 20 feet from the dwelling. (4) The mounded on-site sewage disposal system shall be inspected by the designing engineer every 3 months and a written report submitted to the Board of Health evaluating the effectiveness of the system for a period of 18 months after completion. The report shall include: (1) depth of groundwater and (2) any change of contour elevations of the mound due to erosion and stormwater run-off. This evaluation may have a bearing on further evaluation and possible approvals of other proposed mounded systems in this area and must include concentrations of nitrate-nitrogen and nutrient loadings at down gradient of the mounded system. We must have a written contract between you and your client agreeing to these conditions prior to issuance of an On-Site Sewage Disposal Permit.
