Enclosed i,s a copy of the subdivi.si.on plan showing the above-
lots:. I:n order to build on Lots` 5, 7 'and 8, it will be necessary
toto complete. the. road from just beyond the northerly s'ideline.s
of Lots 5 and 8 through th.e 'cul-de_�-Sac shown on this plan.
According to the engineer who has been consulted, this property
comes within the. limits stated in. the recently promulgated
Groundwater Protection regulation of the Board of Health,.
As; shown by thi's plan, ,the. smallest of these lots, Lot 3 ,: still
exceeds the minimum lot size- of 15,0.0.0. square feet for the area,
and the: other three. lots are all substantially in excess of the.
area requirement.
I would like to be- placed on. -the_ agenda of the. Board of Health-'s
meeting on. November 15th_ at 4.30. p.m. to discus whether the Board
of Health- would waive. any requirement that buildings on the-se lots
be sewe.red.,
These lots, which_ are. pre.s:ently owned by Robert F., Cross, Jr. and
Robert F. Cross, ' I;II:, are under agreement to my, client, James F.
Hurley, Trustee- of J'FH Developers- Trust, and the. early determination
of this questi.on. wial enable- the parties to eliminate one of the
contract con.tngenci:e.s.
