Dear Mr. Childs:
Thank you for your letters dated July 19, 1995 and August 2, 1995 regarding the
proposed septic system at 236 Holly Point Road, Centerville. Below, I am responding to
each of the concerns#14 contained in your letters.
1. The Board of Health voted to require a five (5) feet separation distance between the
bottom of the leaching facility and the groundwater as required by the State
Environmental Code, Title 5. Attached is a copy of the Board of Health decision letter to
Glorya Geltman dated August 7, 1995. The Board felt that run-off should not drain into
the neighbors property if the system is installed according to the submitted plans.
2. According to Health Inspector Edward Barry, who is certified as a soil evaluator by the
Massachusetts Department of Environmental Protection, the groundwater level was below
the peat moss. The peat moss layer was not moist or wet. Therefore, the groundwater
elevation was noted at the actual level observed.
3. The existing septic system at this property is located closer to the pond than the
proposed replacement septic system. Therefore, I believe, the new septic system may
alleviate a source of pollution to the pond.

4. The designing engineer, Martin Moran, P.E., utilized an assumed elevation due to the
fact that the nearest benchmark is located several miles away. It is common practice for
professional engineers to utilize assumed elevations. The designing engineer for this
project also utilized the U.S. Geological Survey maximum groundwater adjustment
calculations to ensure the proper separation distance between the bottom of the proposed
leaching facility and the groundwater table. The system will be elevated an additional 4.7
feet above the observed groundwater table. Therefore, the system will be a total of 9.7
feet above the observed groundwater table.
In regard to the Welch property located at 334 Annabelle Point Road, Centerville, we will
consistently ensure that the five feet separation distance requirement above maximum
groundwater table elevation is strictly adhered to.

Your request for a variance to install an onsite sewage disposal system at 236 Holly Point Road
only four feet above the maximum adjusted water table is not granted.
The Town of Barnstable Board of Health Regulation Part Vll 1, Section 10.00, requires a minimum
separation distance of five feet above the adjusted water table.
Your concern regarding run-off into the neighbors property was reviewed by the Board members.
A site visit and close review of the submitted engineered plans revealed that the run-off should not
drain into the neighbor's property.
Also, variances are granted only, when in the opinion of the Board of Health (1) The same degree
of environmental protection will be achieved without strict application of a particular provision and
( ) applicant The demonstrated that enforcement thereof would cause manifest injustice.
You did not provide information that the same degree of environmental protection will be achieved
by providing only four feet of separation distance above the maximum adjusted
water table. Also, you did not provide information that enforcement of the regulation would cause
you manifest injustice.

Reference(b): Site and sewerage plan of August 2, 1995 for Hillard and Joyce Welch,
334 Annabelle Point Road, Centerville,MA.
Dear Mr. McKean,
At the Board of Health hearing of Tuesday, August 1, 1995,the Board addressed
Item 1 of Reference (a)by denying a requested waiver to the town's vertical separation
requirement of a minimum of 5 feet. This Association applauds that ruling.
Reference (a), however, presented four(4)major Items regarding the proposed
system and, even though lakefront property owners at that hearing verbally presented
Items 2, 3 and 4,the Board opted not to address them at that time. Since we have had no
response to Reference (a), this letter requests a formal response to Items 2,3 and 4.
Therein:
li Item 2 deals with establishing the 5 foot vertical separation requirement in way of
peat moss.
Item 3 deals with using a standard reference point from which the Town's 100
foot minimum horizontal setback requirement is measured. By prior communications
with the Board of Health,the Board reaffirmed that the minimum reference point for
the waters edge would continue to be 34' 0"; whereas the Geltman's system used a lower
elevation reference point.

Item 4 deals with the practice of using actual elevations in lieu of assumed
elevations on all such lake front projects. The use of assumed elevations is confusing
and does not enable the public to understand and appreciate important actions of the
Board.
At the Conservation Commission Hearing of August 8 1995 Reference b was
addressed. By prior communications with the Board of Health, the Board established
that by definition pursuant to the language of Title V Regulations,that the elevation of
34'10"would be used around the Wequaquet Lake area as a ground water standard for
applying the minimum vertical separation requirement of 5'. Reference(b)however
uses a lower elevation of approximately 34'4". The Board has on many occasions
emphasized the critical importance of maintaining minimum vertical separation
requirements and yet Reference (a)compromises this needed protection of our water
supply. We note that the Welchs' leaching system is located in a swale, thus readily
facilitating raising of the system to gain the 34'10" ground water elevation requirement.
The Board's position on this specific issue is also requested.

This Association strongly protests the continuing practice of granting variances to
accommodate personal and individual preferences of Wequaquet Lake waterfront
property owners. With each variance, we lose another step in what should be a mutual
effort to improve the quality of the lake's water.
There appears to be four(4) major issues pending, regarding the subject proposal:
1. Most critical to the effectiveness of this septic systems is to maintain a
minimum vertical distance of five feet(5')between the water table and the bottom of the
leaching field. This critical requirement should never,be compromised; and in the
subject project,variance considerations are being requested. The problem is NOT
because the five foot(5') separation is unattainable, but because there is a slight -
possibility of a run-off problem if the system is not graded correctly. -A simple solution -
require the finish grading of the project to be done correctly and keep the five foot(5')
separation.
2. The required five foot (5')vertical distance between the water table and the
bottom of the leaching area must be comprised of acceptable drainage material. Peat
moss is NOT one of such materials. Most professionals in the field of sewage systems
installations conclude that whenever there is peat moss contiguous with the water table,
the upper level of the peat moss determines the water table. In this case, the engineer is
using the lowest level of the peat. This industry practice is important due to the high
absorption capability of the peat moss and its poor filtration capability. This factor is
also implicated in the subject case. In effect, there should be an additional two feet (2')
of separation to make up for the two feet(2') of peat.

3. The 1.00 feet minimum distance requirement(set-back) from the waters edge
of the lake to the septic system should be based on the minimum reference point of the
waters edge, i.e. a lake level of 34'0" above mean sea level. Town agencies have used,
this standard reference point for years, even though there are times when the lake level
reaches 34'10" above mean sea level. For this proposed septic system, the waters edge
reference point was measured in October 1994 when the height of the lake was 33'5".
This false reference point provides the owner with several additional feet in his attempt
to meet the 100 foot set-back.
4. For the subject project, compliance with regulations is being based on assumed
elevations using certain selected benchmarks. This practice is not reliable when used in
such environmentally sensitive areas. It is recommended that in the case of the subject
project and in ALL lake front projects, the ACTUAL ELEVATIONS be used so that all
parties can be assured that decisions are based on accurate data and that the best interests
of Lake Protection have been served.
