The "garage" and "family room" shall not be occupied, rented, or leased as a separate unit. 2. The "family room" cannot be.partitioned from the adjoining existing "kitchen/dining" area. 3. The "family room" and "garage" cannot be supplied with plumbing-. 4. The dwelling cannot have more than three (3) bedrooms and one (1) family room. Sewing rooms, lofts, dens, enclosed porches, finished cellars, and similar type rooms are considered bedrooms, according to the Department of Environmental Quality Engineering. 5. The onsite sewage disposal system must be pumped yearly and written certification from a licensed pumper submitted to the Board of Health: The existing onsite sewage disposal system .was approved because it meets Title 5 of the State Environmental Code. Town Hall Pe Main Street Hyannis, MA 02601 Re: Lot 62 Long Beach Road (Our file# 2.0101 .0) Dear Board Members: Our office represents Robert Shields Jr . , owner of and resident at the above captioned site. Mr . Shields has obtained permission from the Conservation Commission and DEQE to construct an addition to the house existing at the site. The addition would house a garage on the lower level and a family area on the upper level . The family area is open to the existing living space of the dwelling and, therefore, could not be readily used for bedroom purposes. The septic system for the existing hous e was permitted in 1979 . An as-built plan was done by Craig Short P.E. It shows two flow diffusers with several feet of stone set in the front yard. Leaching provided, as calculated by the design engineer was 366 gpd; sufficient for a three bedroom dwelling . At the time of request of a building permit for construction of the addition, Mr. Shields ' agent was informed that the existing septic system would have to be enlarged by the addition of preferably two but at least one more galley. When an inquiry, was made as to the basis of the request, he was told it was policy to require one galley per bedroom. In reviewing the Board' s regulations, we have not been able to find such a regulation. Because no bedrooms are being requested, the existing system appears adequate for the proposed use in terms of flow. The system was designed to have 4 ' between its bottom and then observed ground water of 1 .31 . In fact, based on the as-built plan, it is only 0 . 02 ' short of providing 5 ' above M.H.W. for the site. The existing system is also +100 ' from the present shoreline. First, leaching would be increased to just over 500 gpd This capacity is more than sufficient for an additional bedroom. Because Long Beach is environmentally sensitive and, due to its exposure, hazardous, it is not advisable to encourage higher levels of use. Yet when you require additional economic investment with very limited basis, you do exactly that. Certainly at resale, a house with a system capable of handling four bedrooms is worth more than one with three and is therefore apt to be marketed and used that way. Secondly, due to the configuration of the system and the wall retaining soil around it, and additional galley and its stone would be not more than 15 ' from the vertical face of a field stone wall .
