Dear Mr. Ames: You are granted a variance from the Board of Health Regulation re- quiring; 40,000 square feet on lots serviced by private wells and private sewage systems on Lot 8, Lumbert Mill Road, Centerville, on behalf of Christine M. Bania. The variance is granted with grave reservations, and is not to be considered as setting a precedence. The Board inadvertently re- leased the developer from a covenant not to sell or develop the lots. This releasing legally did not require us to approve septic systems and wells on lots less than 40,000- square feet. However, in view of pecularities of this particular situation, and the ap- parent misunderstanding on the part of the buyer, the variance is granted. The following conditions apply: (1) You .must receive the approval and an Order of Conditions from the Conservation Commission. (2 ) The septic system and well must be installed in strict accordance with the designing engineer' s plan and the well must be 150 feet from any septic system. The de- signing engineer must supervise construction of the system and certify, in writing to the Board, that his design has been complied with prior to the issuance of a certificate of compliance and occupancy permit. ( 3) The well must be installed and the water tested prior to issuance of a building permit. The water must meet all of the standards contained in the Safe Drinking Act of 1974. As I have stated in my previous letter of June 5, 1981, the only way that water could be installed is under the Betterment Sections of the Massachusetts General Laws. Water main installations under the Betterment System would take approximately fourteen (14) months from this date to complete. Ames owns a lot of land. Town water is available -to this lot from the area of Ebenezer Road about 1,000 feet to the north of this lot on Lumbert Mill Road: The approximate cost of extending the water main to` this lot would be about $20,000.00. There are about twelve to fifteen lots on Lumbert Mill Road that would benefit from this water main extension. The Centerville-Osterville Fire District is now laying water mains under the Massachusetts Betterment Sections of the General Laws in other parts of the District and it is <possible to do the same in this area if .the property owners request it. I would like to remind you that an agreement was made some time ago about building on every other lot until such time when: town water would be available.
