The developers sought to construct 36 units of housing on 6+ acres of land . The Board of Appeals granted 24 units . Subsequently .the developer filed an appeal with the State Housing Appeals Committee . After a,n initial hearing, the case was remanded back - to the Board- of Appeals because the developer proposed to' add 2+ acres of land to the site and reduce the request from 36 to 34- units . Jansson Chairman .SEP 2 9 1988 Zoning Board of Appeals 367 Main Street - Hyannis, Ma 02601 Dear Mr. Jansson: Re: Forest Estates Chapter 40 B Comprehensive Housing Application Old Stage Road, Centerville The Board of Health is of the opinion that 72 bedrooms on 6.6 acres of land is an overuse of land in the Town of Barnstable. However, this project by itself does not present any more specific environmental problems than others previously allowed by the Town. The project is not located within a zone of contribution to any public water supply well. Studies commissioned by the Town indicate that our drinking affected. The septic stems will be of be immediate) P y water supply will n y affe PP y located a considerable distance from any wetlands and does not appear to pose a specific threat to our fish and shellfish harvesting areas, and swimming areas. However, Title 5 of the State Environmental Code does not afford complete environmental protection and does not provide adequate sewage treatment. Septic systems installed following these minimum standards have a documented history of failure. Septic tank capacity and leaching area requirements should be increased by at least 50% over Title 5 requirements. The 50% would be in addition to the required 150% of the design flow for the septic tank and never less than the minimum 1000 gallon tank. The Town continues to approve high density developments, yet cannot provide adequate sewage treatment or waste disposal. The development we have permitted throughout the Town has caused irreversible environmental damage and has lowered the quality of life. I� Mr. Ron S. Jansson, Chairman Zoning Board of Appeals FROM: Thomas McKean, Director of Public Health Cz::V_*1 RE: Forest Estates, Distance to wells - Single Family Versus Multi-family The buildings at Forest Estates will be connected to Town water according to the site and septic system plans dated May 23, 1988, revised July 6, 1988, prepared by Peter Sullivan of Baxter and Nye, Inc. Therefore, the Town of Barnstable Board of Health Regulations requires a 150 feet minimum separation distance to abutter's wells. Currently, the 150 foot minimum separation distance applies to both single family onsite sewage disposal systems and multi-family onsite sewage disposal systems to abutter's wells. However, DEQE regulates separation distances from multi-family septic systems to onsite wells. Enclosed is a copy of the DEQE brief notice of Drinking Water Regulations. The poject site is made up of Lots 1, 213, 4 , 7 , r and 8 as shown on the subdivision plan for Lebel-Sollows dated September 30, 1986 Attachment 2 . The area making up the project site is basically treed and 1 relatively level . Abutting the site to the north is the 210 ' wide Commonwealth Electric easement and to the south is the 450' wide state forest. ,. Old Stage Road (Centerville West Barnstable Road ) is a 60' county way and is the proposed access for the project . The project is located in a RC zoning district and this is presented on Attachment 3 . The surrounding land use is I residential, see Land Use Locus Attachment 4 . From an environmental standpoint the proposed project is ;not located within a Zone of Contribution to a public water supply, see Attachment 5 . The site and surrounding area is supported by town water. The soil on site will readily support an on site spetic system.
