MAY 0 367 MAIN STREET � M• HYANNIS, MASS. 02601 July 12, 1988 Mr. Thomas McLellan Downcape Engineering Co. 939 Main Street Yarmouthport, Ma 02675 Dear Mr. McLellan: You are granted on behalf of your client, Ruth Hill, multiple variances from Title 5, of the State Environmental Code, and Town of Barnstable Health Regulations to upgrade an onsite sewage disposal system at 56 Short Beach Road, Centerville, listed as Parcel 39 on Assessor's Map 206. The variances granted are as follows: Regulation 15.02 (17): Removal of unsuitable soil 10 feet around leaching facility in lieu of required 25 feet. Regulation 15.03 (7): The distance from the septic tank to the foundation wall of the dwelling will be 9 feet in lieu of the required 10 feet. Regulation 15.03 (7): The distance from the leaching facility to the property line will be 3 feet in lieu of the required 10 feet. Town of Barnstable Health Regulation: The distance from the leaching facility to the.edge of Westland will be 81 feet in lieu of the required 100 feet. Regulation 15.13 (2): The flow diffusors will be installed in an area where the maximum groundwater elevation is 2.0 feet below the bottom of the leaching facility, in lieu of the required 4.0 feet. The above variances are granted with the following conditions: (1) The dwelling is restricted to four (4) bedrooms. Sewing rooms, study rooms, dens, enclosed porches, and similar type rooms are considered bedrooms according to the Department of Environmental Quality Engineering. (2) The dwelling must be connected to public water. (3) Garbage grinders are not authorized. (4) The designing engineer must be onsite to supervise construction of the system and certify in writing to the Board of Health that his design has been strictly adhered to prior to the issuance of a Certificate of Compliance. My family has occupied this house for 40 years during the summer months and, with no washing machine, dishwasher nor .disposal , I feel .that we are not the most contributing factor to this problem. In the last several years, as I am sure you are aware of, there has been a considerable increase in construction, which results in an increase in population, along with rentals to multiple families. Having been a Cape summer resident for many years, and hoping to continue, we have been very concerned about the increased building.
