The leaching pit was recently installed. The variance is granted because the Disposal Works Construction Installer, Scott Frank, installed the leaching pit after designing the system based on a plot supplied by the owner of the property, Phillip Neagle. It was later discovered that the plot plan was incorrect. The Board is of the opinion that the use of this leaching pit which replaced an old cesspool, will not alter the quality of the groundwater in the area. With the exception of meeting the minimum setback requirement, the new leaching pit was constructed in compliance with Title V, the State Environmental Code. Sincerely yours, r jsph C.
