Substantial progress shall be made in correcting these violations before August 15, 1995. Your attorney, William Delaney, testified that there is a court order which requires the cooperation of the counsel to the occupants of this dwelling. He stated the repairs cannot be made if the occupants who were served with eviction notices are not at home or are not cooperative with the repairman. Health Inspector, Christina Kuchinski, R.S., testified that although two violations were corrected, there are 17 violations which remain uncorrected. The Director of Public Health, Thomas McKEan, R.S., C.H.O., stated these violations have not been corrected since May 5, 1995 and regardless of any eviction notices and court orders, the tenants continue to reside in the dwelling and these violations must be corrected at this time. In the meantime, the tenants had called the Fire Department complaining about the smike detectors and they in turn called me. I explained that all was in order. By the way, the electrician works for the Town of Barnstable and he had been to the house in the past. He said that there was basically nothing wrong and that there was no basis for a complaint to be filed. As I mentioned in our conversation, I did not receive the letter which was to notify me of the Board of Health hearing that took place on June 6, 1995 at 8:00 P.M. As a result, this letter serves as my request for a hearing to discuss the aforementioned property. You informed me that the next hearing is scheduled for July 18, 1995 at 7:00 P.M. I expect I will receive confirmation of my scheduled appearance from your office upon receipt of this letter. Health Inspector for the Town of Barnstable because of a complaint. The following violations of the Town of Barnstable Rental Ordinance Article 51 were observed: i 410.500: Wooden front entrance door panels are cracked. 410.500: Side entance storm door does not have a self-closing device. 410.500: Kitchen ceiling paint is peeling. 410.500: Kitchen wallpaper is stained due to old leak in upstairs plumbing. 410.480: Side entrance doorknob latch is frozen in place. 410.351: Light in hallway, next to kitchen, does not have a globe. 410.351: Some of the control knobs are missing from the heat radiators. 410.551: Screening material is not connected*to screen frame in upstairs bathroom. 410.551: Child's bedroom#1 has windows with no screens and windows with torn screens. 410.500: Door to child's bedroom#1 has no doorknob. y1 410.550: Doorknob to door of child's bedroom#2 is not functioning due to mechanism being stripped. 410.551: Child's bedroom#2 has windows with torn window screens and windows with no screens. 410.500: Ceiling paint is peeling in child's bedroom#2. 410.500: Wallpaper near radiator is child's bedroom#2 is peeling and touching radiator. 410.551: Window screens in child's bedroom#3 are torn. 410.354: Cross electric metering of electric outlets and light fixtures from converted garage apartment to tenants meter#70611, account#1458 836 0033. 410.354: Cross connection of oil heat/forced hot water to converted garage apartment. 410.351: Kitchen dishwasher door does not close and lock and dishwasher does not function. 410.351: Second floor bathroom tub drain and mechanism need repair. The mechanism is frozen in place and tub drains very slowly. 410.482: Smoke detector in the basement is missing. You Are directed to correct the violation of 410.482 within twenty-four (24) hours of receipt of this notice. You are also directed to correct the remaining above listed violations within seven (7) days of receipt of this notice. You may request a hearing if written petition requesting same is received by the Board of Health within seven (7) days after the date order is received. However, this violation must be corrected regardless of any request for a hearing. Please be advised that failure to comply with an order could result in a fine of not more than $500. Each separate day's failure to comply with an order shall constitute a separate violation. The above listed violations were also observed on May 11, 1995. A facsimile message dated May 15, 1995, was received from you requesting a hearing before the Board of Health. On May 31, 1995, a notice of the Board of Health hearing date, time, and place was mailed to you from Barbara Sullivan, Office Assistant of the Town of Barnstable Health Division. The hearing was scheduled to be held on June 6, 1995 at 8:00 P.M. at the Town Hall Hearing Room, 367 Main Street, Hyannis, Massachusetts. However, you were not present at that time.
