The sewage system proposed on your revised plan, dated_
i September, 1975, James H. Bowman, P.E. is approved with the
following conditions :
(a) Office building is limited to 20 peroons.* This
building cannot be used for a doctor' s or dentist
office, beauty parlor, barber shop, cafeteria, or
any other business that would increase the proposed
sewage system.
(b) Peat muet be excav�lted to elevation 4.80 feet an
shown on plan.
(c) Installation must be supervised by designing
engineer including excavation and placement of
clean fill.
(d) Board of Health must receive certification, from

P.rtner I have been authorized by Joseph Mayo to submit. this request
for your consideration. You are probably familiar with the
long history of the tot, consequently, it is not my intention
to review all of that history. However, there are a few
historic facts which should be brought to your attention for
consideration during your deliberations.
Some ten years ago, both the Board of Health and the
Conservation Commission gave positive consideration and
approved the construction of an.office building on the site.
Please see Attachment #1. More recently, in late 1983, both
Boards acted again on the proposed construction of a
retail/office use on the site. -The result of this review was
•approved by the Conservation Commission and a ruling by your
Board which was tantamount to being a denial. Please see
Attachment #2.
Your determination respecting the 1983 request for variance
leaves the petitioner with a considerable hardship. The cost
of a percolation test, presently estimated to be in the range
of $8,000-$10,000 using a de-watering operation is far in
excess of what is usually required and, therefore, very
expensive. This fact, when considered within the context of
the petitioner continuing to pay local real estate taxes
without the benefit of any abatements, seriously .jeopardizes
the economic feasibility of developing the site.
We are requesting the Board to vary the application of the
required procedure as described in Title 5 of the State
Environmental Code, conditioned upon our securing a positive
percolation test. Those variances are, as follows:
1. 310 CMR Section 15.02 (17)' requires the removal of 25 feet
of unsuitable material between the proposed leaching

chamber servicing the building and the street line (west). We.
can only get 10 feet. Accordingly, due to the existing site
� � .�•, conditions we are requesting permission to excavate less than
required re u the q 25 feet of unsuitable material located around the
leaching chamber.
2. 310 CMR Section 15.14 (12) relates to the slope requirement.
Due to the existing site conditions, we are requesting
permission to increase the slope, or in the alternative, to
PearTree Associates construct a retaining wall in order to contain the slopes
around the facility in order to meet applicable standards.
It should be noted that the petitioner fully understands that the
granting of such variances are conditioned upon his securing a
positive percolation test by a licensed contractor in accordance
with 310 CMR 15:03 (5) (6) .
If the petitioner is granted these variances, we would proceed
immediately with the necessary percolation test. Then, subject to
meeting all other local requirements , we would install a properly
designed septic system prior to filling-in the excavation; remove
approximately 19,500 SF of existing sur'face pavement; remove all
unsuitable material (peat) to .Elevation 4.80; and construct a
building on a 7,000 SF footprint and required off-street parking
on approximately 5,000 SF, substantially in accordance with the
plan, dated June 3, 1983, a copy of which is attached.
The Board should note that, about 7,500 SF of the existing paved
area will be replaced by landscaped area. Perimeter planting, as
well as improvements to the existing landscaped area at the rear
of the site, would be installed. A catch basin with an
oil-absorbant pillow will be installed to serve the off-street
parking are located southeast of the proposed building site. In
addition to these positive environmental benefits, the development
of the site will have. obvious economic benefit to the Town of
Barnstable and will be a welcomed addition to this viable business
community.

Partner I have been- authorized by Joseph Mayo to submit this request
for your consideration. You are probably familiar with the
long history of the lot, consequently, it is not my intention
to review all of that history. However, there are a few
historic facts which should be brought to your attention for
consideration during your deliberations.
Some ten years ago, both the Board of Health and the
Conservation Commission gave positive consideration and
approved the construction of an.office building on the site.
Please see Attachment #1. More,.recently, in late 1983, both
Boards acted again on the proposed construction of a
retail/office use on the site. -The result of this review was
approved by the Conservation Commission and a ruling by your
Board which was tantamount to being a denial. Please see
Attachment #2.
Your determination respecting the 1983 request for variance
leaves the petitioner with a considerable hardship. The cost
of a percolation test, presently estimated to be in the range
of $8,000-$10,000 using a de-watering operation is far in
excess of what is usually required and, therefore, very
expensive. This fact, when considered within the context of
the petitioner continuing to pay local real estate taxes
without the benefit of any abatements, seriously jeopardizes
the economic feasibility of degeloping the site.
We are requesting the Board to vary the application of the
required procedure as described in Title 5 of the State
Environmental Code, conditioned upon our securing a positive
percolation test. Those variances are, as follows:
1. 310 CMR Section 15.02 (17) requires the removal of 25 feet
of unsuitable material between the proposed leaching

chamber servicing the building. and the street line (west). We.
can only get 10 feet. Accordingly, due to the existing site
conditions we are requesting permission to excavate less than
the required 15 feet of unsuitable material located around the
leaching chamber.
2. 310 CMR Section 15.14 (12) relates .to the slope requirement.
Due to the existing site conditions, we are requesting
permission to increase the slope, or in the alternative, to
PearTree Associates construct a retaining wall in order to contain the slopes
around the facility in order to meet applicable standards.
It should be noted that the petitioner fully understands that the
granting of such variances are conditioned upon his securing a
positive percolation test- by a licensed contractor in accordance
with 310 CMR 15:03- (5) & (6).
If the petitioner is granted these-variances, we would proceed
immediately with the necessary percolation test. Then, subject to
meeting all other local requirements ; we would install a properly
designed septic system prior to filling-in the excavation; remove
approximately 19,500 SF of existing surface pavement; remove all
unsuitable material (peat) to Elevation 4.80; and construct a
building on a 7,000 SF footprint and required off-street parking
on approximately 5,000 SF, substantially in accordance with the
plan, dated June 3, 1983, a copy of which is attached.
The Board should note that, about 7,500 SF of the existing paved
area will be replaced by landscaped area. Perimeter planting, as
well as improvements to the existing landscaped area at the rear
of the site, would be installed. A catch basin with an
oil-absorbant pillow will be installed to serve the off-street
parking are located southeast of the proposed building site. In
addition to these positive environmental benefits, the development
of the site will have..obvious economic benefit to the Town of
Barnstable and will be a welcomed addition to this viable business
community.
Your positive consideration of .these variances is respectfully

for your consideration. You are probably familiar with the
long history of the lot, consequently, it is not my intention
to review all of that history. However, there are a few
historic facts which should be brought to your attention for
consideration during your deliberations.
Some ten years ago, both the Board of Health and the
Conservation Commission gave positive consideration and
approved the construction of an office building on the site.
Please see Attachment #1. More recently, in late 1983, both
Boards acted again on the proposed construction of a
retail/office use on the site. The result of this review was
approved by the Conservation Commission and a ruling by your
Board which was tantamount to being a denial. Please see
Attachment #2.
Your determination respecting the 1983 request for variance
leaves the petitioner with a considerable hardship. The cost
of a percolation test, presently estimated to be in the range
of $8,000-$10,000 using a de-watering operation is far in
excess of what is usually required and, therefore, very
expensive. This fact, when considered within the context of
the petitioner continuing to pay local real estate taxes
without the benefit of any abatements, seriously jeopardizes
the economic feasibility of developing the site.
We are requesting the Board to vary the application of the
required procedure as described in Title 5 of the State
Environmental Code, conditioned upon our securing a positive
percolation test. Those variances are, as follows:
1. 310 CMR Section 15.02 (17) requires the removal of 25 feet
of unsuitable material between the proposed leaching

chamber servicing the building and the street line (west). We
can only get 10 feet. Accordingly, due to the existing site
.'. •.. conditions we are requesting permission to excavate less than

leaching chamber.

2. 310 CMR Section 15.14 (12) relates to the slope requirement.
Due to the existing site conditions, we are requesting
permission to increase the slope, or in the alternative, to
PearTree Associates construct a retaining wall in order to contain the slopes
around the facility in order to meet applicable standards.
It should be noted that the petitioner fully understands that the
granting of such variances are conditioned upon his securing a
positive percolation test by a licensed contractor in accordance
with 310 CMR 15.03 (5) & (6).
If the petitioner is granted these variances, we would proceed
immediately with the necessary percolation test. Then, subject to
meeting all other local requirements, we would install a properly
designed septic system prior to filling-in the excavation; remove
approximately 19,500 SF of existing surface pavement; remove all
unsuitable material (peat) to Elevation 4.80; and construct a
building on a 7,000 SF footprint and required off-street parking
on approximately 5,000 SF, substantially in accordance with the
plan, dated June 3, 1983, a copy of which is attached.
The Board should note that, about 7,500 SF of the existing paved
area will be replaced by landscaped area. Perimeter planting, as
well as improvements to the existing landscaped area at the rear
of the site, would be installed. A catch basin with an
oil-absorbant pillow will be installed to serve the off-street
parking are located southeast of the proposed building site. In
addition to these positive environmental benefits, the development
of the site will have obvious economic benefit to the Town of
Barnstable and will be a welcomed addition to this viable business
community.
