The Board of Health had recommended that Mr. .Franco connect each lot in the subdivision to Town sewer. Mr. Franco, in attempting to follow the recommendation of the Board of Health, has had a system designed for the connection to Town sewer but Mr. Campo, your Superintendent, has refused to approve that system on the basis that such an extension conflicts with the Master Plan and the overall policy of .extensions of the sewer systems in the Town of Barnstable. Mr. Campo did advise Mr. Franco that his decision was subject to review by the full Board of Commissioners and, therefore, we are requesting such a review. Mr Franco's engineering consultant has suggested that tF if an easement could be obtained over town-owned land, the nine lots as r well as Mr Franco's Real Estate office on Route 28 could be hooked up using a gravity feed line to the High School Service Road where a sewer ►' actually exists. Mr. Campo has indicated that this proposal would be j unacceptable to DPW inasmuch as it involves an easement across a piece j of property and really doesn't extend the sewer system such that other I people could -connect to it. He went on to say that Mr Campo recommended ^} that all the lots be tied into a system on Falmouth Road and that Mr Franco bring the sewer from wherever it is on Falmouth- Road to the subdivision. Given the topography of this particular subdivision, all of the lots would !' i require an individual pump to get sewage up to Falmouth Road or, in the r« alternative, a pumping station located near to the center of the subdivision. ij Mr Franco went back to his consultant and obtained an estimate from Chandler Construction (which he distributed to each of the members) figuring the cost both ways (to the High School Service Road- and up to Falmouth Road). To pump everything up to Falmouth Road would cost $98,000 while going down to the High School Service. Road would cost, u $32,240. Mr Franco and he (Mr Ford) then ent back to Mr Campo'to ask him to reconsider recommending a gravity feed system. They understand that even if Mr Franco is allowed to install a gravity feed system he has another whole hurdle to jump through inasmuch as it would require Town -I Meeting approval to be granted an easement across property under the jurisdiction of the School Committee in order to get the sewer over to the High School Service Road. The subdivision is in a. water recharge area and Mr Franco would like to sewer it. He could install an on-site system for about $1,500 per lot and he (Mr Ford) feels that as a result of the plan Preceding the adoption of the Board of Health's new regulations he clearly has the right to comply with regulations which existed at the time the plan was filed. As a result, he believes this particular subdivision is unique and he is unaware of any other subdivisions which were filed prior to that particular regulation coming into force. `Therefore, this is not necessarily a precedence setting case. It is a situation where he believes he can gravity feed it and wants to•sewer it, and the Board of Health wants him to sewer it. But, to sewer it the other way just doesn't make good economic sense. If he is required to sewer it the other way, he has no choice but to go back i to the Board. of Health and tell them he has to put in on-site systems. The status of the plan at this time is that the Planning Board has looked, at the definitive plan and they have not taken any action on it. The recommendation from the Board of Health to the Planning Board, which they have to follow, is that the subdivision must be sewered. However, the Board of Health"has indicated that they want to meet with Mr Franco again, following the outcome of this meeting with the DPW Commission, to decide whether they want to modify their decision based on the feasibility analysis from an economic standpoint as to whether the subdivision should be sewered. Going through an easement was explained but there is also a change in the district he is changing over. Even if he goes up to Route 28 he would be crossing over to another district which was not planned heretofore for this particular area. Part of his development should go into _one district and part into another but it would be very burdensome .to separate the development. From an engineering design point of view, not financial, the system would eventually have to go into Route 28. One of the things you find by going through backyards and easements, is that ' it raises problems for DPW in terms of a maintenance program, knowing where it is, etc, and access to it. He said that he indicated, as Mr Ford said, that from his point i of view to be consistent with what we have been doing to everyone else i in town, cost notwithstanding, he has to stay with the master plan as !� presently conceived. Where Mr Franco's subdivision is located r { part of it should flow west and the remainder to the east. The nursing t home property was always planned to hook up in the way that it will be hooked up. The nursing home has been directed to extend the sewer in accordance with the master plan and then to the High School Service Road. There will be no deviation in the plan with the nursing home hook-up. Mr Franco will have to deviate in two ways - first by crossing over to another i district and second acro ss an easement. Requests for individual developments connection may or may not be a final recommendation of the facility plan. In 1974 a master plan for sewering much of Hyannis was sub- mitted by Whitman & Howard. In 1982 the Department of Public Works submitted an application for "557" funding. Town funds have yet to be allocated for construction. The area of your concern is not in the "557" application because it was not in a master plan. Unlike the IaFrance Avenue Project and the Scudder Avenue project the proposed development is not in the vicinity of drink- ing wells; it is below the grade of the Route 28 Sewer. The proj- ect will of necessity require a lift station and State approval for excavation.
