The purpose of this SPCC plan is to form a spill prevention program that minimizes the chances and/or severity of spills or discharges and the proper handling and management of hazardous materials. EPA— SPCC Plan A facility is subject to SPCC regulations if 1. It is a non-transportation facility, and 2. It is engaged in drilling, producing, gathering, storing, processing, refining, transferring, distributing, using or consuming oil, and 3. It could reasonably be expected to discharge oil in quantities that may be harmful into navigable waters or adjoining shorelines (as defined in 112.1(b)), and 4. It has a total aggregate capacity of aboveground oil storage containers,greater than 1320 gallons of oil, or capacity of completely storage buried tanks greater than 42,000 gallons of oil (does not include completely buried tanks subject to all technical requirements of 40 CFR 280/281) This facility is subject to 40 CFR 112 — SPCC Plan DEP Contingency Plan A facility is subject to Contingency Plan regulations if 1. The facility stores hazardous materials at the facility. This facility is subject to the Town of Barnstable Toxic and Hazardous Materials (Chapter 108 & 381) and Fuel and Chemical Storage (Chapter 326). Requirements to prepare and implement an SPCC Plan 40 CFR 112.3 The owner or operator of an onshore or offshore facility subject to this section must prepare a Spill Prevention Control and Countermeasure (SPCC) Plan in accordance with 112.7 and any other applicable section of this part. 1. If your on or offshore facility was in operation on or before August 16, 2002, you must maintain your plan, but must amend it, if necessary to ensure compliance with this part, by July 1, 2009. If your facility becomes operational after August 16, 2002 but before July 1, 2009, then you must prepare and implement an SPCC plan on or before July 1, 2009. 2. If you are the owner of a facility that begins operations after July 1, 2009, you must prepare your SPCC Plan before you begin operations. 3. If you are the owner of a mobile, on or offshore facility the above dates and conditions apply. You do not have to prepare a new plan every time the facility moves; you may prepare a general Plan. The Plan is applicable only when the facility is in fixed (non-transportation) operating mode. 4. A licensed Professional Engineer must review and certify the Plan. 5. Amendment of SPCC Plan by Regional Administrator-CFR 112.4 The SPCC plan is not required to be filed with the US EPA, but the following occurrences require submittals to the Regional Administrator. 1. The facility discharges more than 1,000 US gallons of oil in a single discharge as described in 112.1(b) (harmful amounts to navigable waters or adjoining shorelines), or 2. The facilityhas discharged more than 42 gallons of oil in each of two g separate discharges (112.1(b)) within a 12 month period. If either of the above situations occurs, certain information must be submitted to the USEPA Regional Administrator within sixty (60) days. This information is as follows: 1. Name of the facility 2. Your name 3. Location of the Facility 4. Maximum storage capacity and normal daily circulation 5. Corrective action and countermeasure taken. This includes a description of equipment repairs or replacements 6. A description of the facility, including site and topographic maps, and flow diagrams 7. The cause of spill, including a Failure Analysis of the system and subsystem in which the failure occurred 8. Additional preventive measures taken to minimize the possibility of recurrence 9. Such other information as the Regional Administrator may reasonably require pertinent to the plan or discharge This information shall also be sent to appropriate state agency. If after review by the state agency and recommendations are sent to the Regional Administrator, and after review by the Regional Administrator you may be asked to amend you plan if it is does not meet the requirements. General requirements for SPCC Plans 40 CFR 112.7 Facility Description —112.7 (a) (1,2,3) The Plan must conform to the requirements of this section. The Plan may however, deviate from the requirements in paragraphs (g), (h) (2) and (3), and (i) of this section and the requirements of subparts B and C of this part, if environmentally equivalent protection is provided by some other means. If this is done, the reasons for the non conformance will be stated and the methods used to provide equivalent protection will be explained in detail. Environmental equivalence will not be allowed for secondary containment. Facility Description The facility covered by this Plan produces various sand and aggregate products such as double washed sand and crushed native stone. The facility also has an administrative office, truck scale, maintenance/materials storage garage, aboveground and underground fuel tanks. Please see the Site/Facility Plan (Figure 2). Hazard Material Storage Aboveground Storage. Tank #1 - The facility has a one 10,000 gallon aboveground storage tank (AST) which located within a 110% containment dike. The AST contains diesel/#2 oil which is utilized to fuel the on-site mobile equipment and a neighboring asphalt plant in which Aggregate Industries operates. SPCC,Contingency and Hazardous Materials Management Plan Tank #2 & 3 —The facility has two (2) 275 gallon AST's which store oil which was drained from on-site equipment. The AST's and associated piping are located aboveground for visual monitoring, which is the primary leak detection control. Miscellaneous Material Storage The facility has a 55-gallon drum storage area for various types of liquids utilized in the on-site mobile and production equipment. All drums are located in the maintenance building which will capture any potential spills or rupture of the barrels. The virgin materials stored in barrels include: motor oil, hydraulic oil, transmission fluid, anti freeze, windshield washer fluid, etc... Underground Storage Tank#4 — A 2,500 gallon underground storage tank (UST) is located adjacent to the administrative offices. The UST contains gasoline which is utilized to fuel company vehicles. The UST and associated piping has periodic integrity testing to ensure the tightness of the UST. Additionally, the UST has over fill / spill devices for additional environmental protection. . All AST's and UST at this facility are engineered and maintained in accordance with the State of Massachusetts Fire Marshall AST regulations — 590 CMR 9.0. Please refer to Table 1 for detailed AST and UST information. Please refer to the facility diagram (Figure 2) for location of AST's and UST. Federal National Response Center (800) 424-8802 If a spill or leak occurs and 10 gallons or more of a petroleum product enters the environment you MUST notify the department within 2 hours at the listed number above. • Spill Reporting Requirements Federal Notification In the event of a release of oil, the "Spill Response Notification Form" must be completed per 40 CFR part 112 regulations. The information on this form must be provided to the Environmental Protection Agency (EPA), National Response Center (NRC) and all other response personnel. Information required by the form should be known at the time of the spill or should be in the process of being collected. The individual reporting the spill should NOT delay notifying the NRC or other appropriate agencies in order to collect any information. Copies of the notification form may be submitted to other federal, state and local agencies as required. A copy of the "Spill Response Notification Form" has been provided in Appendix H of this SPCC Plan. A record of each notification to the NRC must be maintained. Damages or injuries caused by the discharge 10.Actions used to stop, remove, and mitigate the effects of the discharge 11.Whether an evacuation may be needed 12.Names of individuals and/or organizations who have also been contacted • Massachusetts Department of Environmental Protection Reporting Requirements In accordance with the MA Contingency Plan CMR 40 = the MA DEP shall be notified immediately of all discharges or releases into the surface waters and ground waters of the state, or in land area where the oil will ultimately seep into ground water or surface water UNLESS all the following conditions are met: A. The discharge is less than 10 gallons; B. The discharge is immediately contained; C. There is no impact or potential impact to ground water or surface water. If a spill requires reporting to the state of Massachusetts please complete the Incident Report Form included in Appendix H. Town of Barnstable Reporting Requirements In accordance with Barnstable Code of Fuel and Chemical Storage Tanks § 326-18,if a spill occurs, the following procedures must be followed: A. In the event of a leak, whether determined by testing or otherwise, the following steps shall be taken: (1) The operator shall immediately notify the owner. (3) If testing has confirmed that the source of the leak is the piping for a particular tank, the operator shall take that tank out of service immediately. (4) If testing has confirmed that the source of the leak is a particular tank, the owner shall within 24 hours cause that tank to be emptied of all its product. B. The head of the local Fire Department shall take charge of all emergency containment procedures, and shall take whatever measures are necessary to prevent fire and explosion, or, in the case of a fire or explosion, to protect the persons and property within the vicinity from such hazards. C. The head of the local Fire Department shall verify that the requirements of 326-18A of this regulation are compiled with. D. Upon the arrival of the representative of OIR-DEQE, the head of the local Fire Department shall advise him of the conditions at the site and the results of the investigations required by § 326-18A of this regulation. E. The owner and the operator shall cooperate with the representative of OIR- DEQE in all efforts to locate the source of the leak, to contain it, etc. The head of the local Fire Department shall have the responsibility of the • containment procedures as long as, in his opinion, a fire or explosion hazard exists. During this period, the elimination of the fire/explosion hazard will have priority over all other concerns, at all times. Once such hazards cease, the representative of OIR- DEQE shall assume all responsibility. (5) In the event of a spill, leak, or discharge of any type: 1. ASSESS the situation for safety: are personnel in danger if they remain in the area of the spill? If so-evacuate the area and call for assistance. If not, 2. STOP the spill, leak, or discharge. 3. CONTAIN the spill, leak, or discharge properly. The first priority of containment is to prevent the spill from reaching water. This containment will be executed by using all available onsite absorbents and mobile equipment. If an uncontained spill were to occur, mobile equipment would be utilized in order to construct a berm made of sand, screenings, and any other absorbents, such as booms, absorbent pads, and socks, used to contain and absorb the spill. In the event of a pipe leak, as much of the leak will be contained as possible by using various storage containers until it can be properly disposed of, or possibly even reused. In the event of a tank failure, the liquid level of the tank will be reduced as • much as possible by filling each piece of mobile equipment on the job, and any empty storage containers, so as to limit the size of the discharge. After the spill has been contained, the absorbents must be collected and separated from other materials and absorbents, so as not to contaminate them. These absorbents will be kept separate until such time as proper disposal methods can be determined. It may be necessary to sample the absorbents to determine what kind of material was absorbed, and thus the proper method of disposal. Cleanup will be considered complete when all materials have been properly disposed of and all documentation is complete. All other miscellaneous cleaning/maintenance materials will be stored and handled properly, with proper labeling clearly visible. 4. REPORT the spill promptly to the Manager and/or Environmental Coordinator. A release due to equipment or tank failure for the UST would be detected by the leak detection.equipment which would send an audible alarm to the administrative offices located on-site. Containment and Diversionary Structures -112.7(c) (1) Please refer to Table 1 for containment number and construction. Please refer to Appendix C for containment volume calculations. Demonstration of Practicability - 40 CFR 112.7(d) Facility management has determined that use of the containment and diversionary structures and readily available equipment to prevent discharged oil from reaching navigable water are practicable and effective at this facility. If a facility owner/operator finds that containment methods are "impracticable," alternative modes of protection to prevent and contain oil discharges are available. If an impracticability determination is made, the SPCC Plan must clearly describe why secondary containment measures are impracticable and how the specified additional measures are implemented. Inspection and testing_protocol details: AST's 1. All tanks, containment areas and associated piping systems are visible on a daily basis to the plant personnel who will notify their supervisor if a problem or potential problem is seen. 2. All tanks, containment areas and associated piping systems are visually inspected monthly by a supervisor or their designee. These records are kept in Appendix A. 3. Cape Cod Aggregates is deviating from the integrity testing provision of 112.8 (c) (6) for tanks 1,2 & 3. This is based on good engineering practice and the details of the installations. These tank is elevated on saddles so that all sides are continuously visible. They are located over an impervious surface,which Cape Cod Aggregate,Corp.-! The UST and associated piping systems will be periodically tested by an outside certified UST tank testing company. The schedule for testing the UST and associated appurtenance will be as required by the MA State Fire Marshalls Office — 590 CMR9.0 Inspections, Tests, and Records -112.7(e) Inspections, tests and records are kept in Table 1 and Appendix A. These records will be kept for a period of 3 years. Each master flow and drain valve is locked to ensure closure when unattended 2. All pump controls are locked off and accessible to only authorized personnel 3. Loading/Unloading connections are capped or blank flanged when not in service 4. There is adequate lighting to assist in the discovery of discharges and prevention of vandalism. We believe this combination of methods provides equivalent environmental protection to fully fencing the site. Facility Tank Car and Tank Truck Loading/UnloadingRack -112.7 h ( ) • There are no "loading/unloading racks" at this facility. • Signs are posted informing transport drivers to check for leakage prior to filling or transit, and to insure that premature vehicular departure is prevented. • Signs are posted informing tank truck drivers to check the lower most drain and all outlets and tighten if needed, prior to filling and disconnection of oil transfer lines, and prior to departure. • Delivery tankers are inspected before and after and unloading to verify quantity received. • In cases in which fueling/servicing/lubricating cannot take place inside contained areas, a spill containment kit is available. • In the case of fuel deliveries, the site has well maintained roadways. • Transport employees are required to check with facility office personnel before unloading. • Transport employees are required to be present at the pump off point while unloading. • Tanks and valves are properly labeled. Field Construction Containers — 112.7(i) There are no field constructed containers on this site. Conformance with State Regulations —112.7(j) The standards for containment and prevention of discharges used in this plan are in accordance with the standards detailed in 40 CFR 112, and all state rules, regulations and guidelines. SPCC plan requirements for onshore facilities 40 CFR 112.8 Specific Requirements 112.8 (a) Onshore facilities must meet the general requirements for the Plan listed under 112.7, and the specific discharge prevention and containment procedures listed in this section. n Facility Drainage 112.8 (b) 1. PP Drainage of containment dikes is not applicable to this site due to the AST's either being located in a secondary containment with a rain shield installed to prevent storm water from entering (AST 1) or located in a covered building (Miscellaneous Hazardous Material Storage). 2. Facility drainage is engineered to prevent oil from reaching navigable waters. Bulk Storage Containers 112.8(c) 1. All tanks are commercially constructed of a material that is compatible with the materials that they contain. _ 2. Secondary containments that contain bulk storage tanks are large enough capacity to hold the contents of the single largest tank within, plus precipitation that may occur. 3. Please see Appendix A for this information. 7. There are no effluent treatment facilities at this facility. 8. Any accumulation of oil in containment areas caused by visible discharges will be promptly removed. As accumulation can result from failure of or damage to seams, gaskets, piping, pumps,valves, rivets, and bolts, corrective action is undertaken immediately. 9. Mobile or portable oil storage containers are positioned or located such that discharges will be contained by secondary containments, and topography of fhe land. Facility Transfer Operations — 112.8(d) • 1. There is no underground piping from the diesel / #2 fuel oil AST (Tank #1) to the fueling station. Any buried piping that is installed or replaced on or after August 16, 2002 will be provided with a protective wrapping and coating. The UST piping is considered to be double walled piping or European suction design. , 2. When piping is not in service or is in standby service for an extended time it is capped or blank-flanged at the terminal connection, and marked as to its origin. 3. Pipe supports are properly designed to minimize abrasion and corrosion and allow for expansion and contraction. 4. All above ground piping, valves and appurtenances are regularly inspected on a daily basis by plant personnel. Items such as flange joints, expansion joints, valve glands and bodies, catch pans, pipeline supports, locking of valves and metal surfaces will be assessed and provided in the monthly tank inspection report shown in Appendix A.
