First, when they took title to the lot in February of 1982 the lot which contains,'approximately 24,000 square feet of land complied with all applicable zoning which required a minimum of 20,000 square foot lots. As you know at the November Town Meeting minimum lot size requirements in this zone changed to one acre. Mrs Schumann's lot is however grandfathered as she did not own any other lots contiguously. Second, Mrs. Schumann's life long dream has been been to b& semi-retire to the Cape so she could run her electrolysis business out of her own home. 0n April 16, 1987 she petitioned the Board of Appeals to allow this "Electrolysis/Home occupation use" and on April 30, 1987 the Appeals Board unanimously approved the-appeal, again assuring Mrs. Schumann that the lot was ready to go.. Third, Mrs Schumann feels that her business will only generate an average of 4 to 6 customers per day with a peak of 8 per day as her visits require an average stay of 12' to 2 hours. ,: Mr. Kelley has informed me that we would need 5 gallons of waste capacity per day allotted per customer, per day. When you couple the 40 gallons (assuming peak usage) allotted for the customers, with 165 gallons allotted for the three people living in the residence you have a total of 205 gallons of waste being used per day, which is still well under the 330 gallons per day required for-a 3 bedroom home. The Board of Appeals found Attorney Richard .Largay represented the petitioner who is seeking a Special Permit to allow the construction of a single-:family residence with an attached office and salon for electrolysis use at the northwest intersection of Route 28 and Straightway, Hyannis in an RC-1 zoning district on a lot consisting of 23,945 square feet. The petitioner proposes a two-story structure with a total of 2,151 square foot area. Six parking spaces are provided with three expansion parking spaces all with access from Straightway; the home occupation use will consist of 400' square feet as required under Section I, Paragraph 12. In addition, the petitioner is seeking variance relief from the 100 foot setback requirement - the petitioner cannot place the house elsewhere on the lot for compliance with setback regulations. Other properties on this area of Route 28 are in compliance with the 100 foot setback requirement. This lot has a unique shape and therefore due to a substantial hardship, if not able to use the lot, the petitioner meets criteria for Variance relief. Signage to be what the Zoning By-law allows for home occupation use. Luke Lally made a finding that the petitioner meets the criteria under the proposed home occupa tion use and would permit a good use of the land, and would not be detrimental to the neighborhood which has many commercial uses in existence. Also find that the lot having a unique shape meets variance criteria. The motion was seconded by Gail Nightingale.
