(Lots #34,44,46,47, and 48). Each and every lot must have a perculation test, etc., and all sewage disposal areas must be seventy-five (75) feet from the marsh or wetlands and ten (10) feet from any property line, and twenty (20) feet from any dwelling before any building or sewage permit will be issued. Subsequently, Mr. Oman was .to'ld that the permit was going to be revoked because new Board of Health regulations had been published in the Cape Cod Standard Times on January 31, 1972. Mention was also made of the fact that the Planning Board Covenant, recorded in the Barnstable Registry District as Document #132 ,367 , had not been partially released with respect to these two lots. Although many houses have been built in 'the subdivision' covered by this Covenant, I find that only two lots have been par- tially released by the Barnstable Planning Board and these two. lots have not yet been built upon. I have made _ a formal written. request for ,release of these two lots from the Planning Board Covenant on the basis that the requirements of the subdivision control law have been complied with in full. I expect the Planning Board to release these two lots as of Monday, February 14th, .1972. Mr. Lawson has engaged an engineering firm to determine whether he can meet the Board of Health requirements as published on January 31. The engineer has informed me trat. he cannot design a system which at all points will be 75 feet from the edge Board of Health, Town of Barnstable 9 February 1972 2 - of the marsh because of the peculiar configuration of these lots. - It will be a great hardship on the Lawsons if they cannot build on these lots, and I respectfully request your Board to consider modifying the requirements in this case. I think you should keep in mind that Mr. Lawson did everything that a reason- able and prudent man could do prior to purchasing these lots aside from starting the construction of his home immediately which, for various reasons, he was unable to do . As .I read the legal notice which appeared in the Standard Times, the Board of Health does have the discretion to modify its requirements in a particular situation. Mr. Lawson is perfectly willing to co-operate with you in any way to assure that the septic tank and leaching field which he proposes to . install will not pollute the waters of Snow' s Creek. I think you should give great consideration to the fact. that almost all other lots in this subdivision have been built upon under' the old regulations and I cannot see how one further building permit in this area could harm the ecology of the area. The contractor withheld voluntarily, the building permit, at my request pending investigation of claims. 4) Unknown. 5) This can and will be done very easily and simply. 6) This property has been inspected several times by: Mr. Taisto Ranta, representing the Conservation Commission. Mr. David Green, Town Engineer and Member of the Wetlands Commission. Two members of the Board of Health, Town Counsel and myself. To the best of my knowledge, no sewage violations have occured. I trust that it is unnecessary to review developments to date as I am sure your office is familiar with same. Let me state initially that clients are not concerned with the existance of a dwelling at the location in question per se .but are extremely disturbed as regards the potential pollution problem which will result from the proposed sewerage system. From my understanding of the situation coupled with a personal view of the premises, it is my opinion that the entire matter demands a very close scrutiny bearing in mind the following points: (1) I submit that the proposed sewerage system is in violation of the set-back requirement of the Town of Barnstable. (2) I submit that .the original building permit was erroneously and unlawfully issued in view of prior Board of Health and Planning Board rulings. (3) I submit that the initial building permit is void and understand that a new permit has not issued and that the building is under construction without a proper permit. (4) I submit that the builder has not posted upon the premises the building permit which he purports to be in effect. Please understand it is not anyone's intention, at this point, to cause this owner to not have a dwelling at this site. With limited knowledge relative to sewerage, it would appear that the only plausible solution which would not be injurious to public health would be to require the installation of a holding tank or, in the alternative, the owner procurring easements which would allow the bumping to a site further removed from the .creek. This entire matter is complicated by the fact that the Town of Barnstable has shellfish areas within a very short distance of Mr. Lawson's property thus making any pollution problem much more accute and of public concern. I would strive to solve this problem on a local level, and am reluctant to bring the matter to the attention of the State Board of Health and Department of Natural Resources until you have had -an opportunity to review and correct this matter.
