The State and Conservaon Commission have established buffer zones to protect those wetland resources – but perhaps it must be stated that the buffer zones should not be confused as a resource area unto themselves. Chapter 704, also as amended in 2011, secon G states: The Conservaon Commission finds that the uniform provision of an undisturbed buffer zone width of 50’ will serve to insulate wetland resource areas from adverse impacts stemming from developments elsewhere in the buffer zone. While we appreciate the Commission’s current consideraons of further amending the Buffer Zone Regulaons, unl such me as they are amended, we believe any Burden of Proof on the potenal effects to the wetlands is meet through compliance with the current Buffer Zone Regulaons. Any decision to the contrary would be inconsistent with the 1000+ Order ’s issued under the current regulaons since 2011. That said, the applicants are much aligned with the Commission’s mission. While this property has easily has the potenal to be redeveloped with 13+ bedrooms, and a virtually unlimited footprint and floor areas for dwellings and accessories, and sod to the 50’ buffer – the applicants are trying to preserve the rural nature of the property and restore some small poron of the charm of what was once the 1000 acre Davis Estate encompassing all of Seapuit with farming, gardens, and nurseries. All garden areas will be organically maintained. The aached Landscape Plan has been revised to increase the width of the meadow bio swale, and specified nave fruit shrubs in those beds closest the salt marsh. These revisions provide essenally an approximately 85’ buffer zone in the area of the proposed garden. The revised plan has also added proposed orchard trees as paral replacements in the area.
