The proposed improvements include repaving existing impervious surfaces, new curb installations, and minor stormwater drainage improvements to this commercial property. This RDA is being filed since a small portion of the proposed work will occur within the 100- foot Buffer Zone to inland Bank and Isolated Vegetated Wetlands, as well as the locally regulated 0-50-foot and 50-100-foot Buffer Zones. These areas are regulated under the Massachusetts Wetlands Protection Act (WPA, M.G.L. c. 131 §40) and/or the Town of Barnstable Wetlands Protection Bylaw (Chapter 237) and implementing regulations. All of the proposed work will occur within previously disturbed areas with no anticipated impacts to the surrounding jurisdictional resource areas. The Applicant respectfully requests that the Barnstable Conservation Commission make a Negative Determination, confirming that a Notice of Intent (NOI) will not be required for the proposed work. This RDA application includes the following items: • Attachment A – WPA Form 1 • Attachment B – Figures • Attachment C – Project Drawings • Attachment D – Site Photographs • Attachment E – Abutter Information The following text describes the jurisdictional resource areas and other existing conditions, proposed activities, and proposed protective measures. Site Description The Project Site consists of a large, paved property developed with several retail and restaurant businesses. It is located in a commercial area along a highly trafficked road near the airport in Hyannis. The property is abutted by Iyannough Road (Route 132) to the south, Airport Road to the west, Barnstable Road to the east, and a small, vegetated area with a manmade stormwater detention basin to the north. Please refer to the figures provided in - 2 - Attachment B and the Project Drawings provided in Attachment C for more information on the project location. Wetland Resource Areas Site reconnaissance and wetland resource investigations of the project area were con ducted by a Tighe & Bond wetland scientist on December 28, 2022. The reconnaissance was conducted in accordance with the Massachusetts Department of Environmental Protection (MassDEP) guidelines, 310 CMR 10.00, and Chapter 2 37. Jurisdictional resource area boundaries were surveyed using an Arrow 100® Global Navigation Satellite System (GNSS) sub-meter unit. TABLE 1 Summary of MA WPA Resource Areas by Flag Series Wetland ID Series Flag Numbers Resource Area Type 1 1A-1 through 1A-13 Isolated Vegetated Wetland 2 2A-1 through 2A-18 Inland Bank The following resource areas are manmade stormwater management features that have been characterized in the context of the Conservation Commission’s jurisdiction based on precedent. While the exact date of construction of the retention basin to the north of the Project Site is undetermined, a record of satellite imagery indicates it took place in the 1970s, which was prior to the MassDEP 1996 Stormwater Policy. The detention area to the southeast was constructed during the later part of the 1990s. All open space on the property has been previously disturbed. Inland Bank Inland Bank is defined by 310 CMR 10.54(2) as the first observable break in slope or the mean annual flood level, whichever is lower. Wetland series 2A delineates the Bank of a stormwater retention basin at the northern limit of work adjacent to Barnstable Road. Stormwater is discharged into the retention basin via several outfalls positioned around the basin. The area generally does not support a wetland vegetation community except for a small cattail (Typha spp.; OBL) population present at the narrow western edge of the basin where soil has eroded and accumulated at the bottom of the slope. All Bank points occur along the mean annual flood level. The basin is relatively open and unvegetated with upland species such as pitch pine (Pinus rigida; FAWU) and American holly (Ilex opaca; FACU) dominating the steep surrounding slope. Isolated Vegetated Wetlands Wetland 1A can presently be characterized as a palustrine emergent (PEM) wetland at the eastern extent of the project site at the intersection of Iyannough and Airport Road s. The wetland was constructed as a stormwater detention basin, and the area is regularly landscaped and maintained. Observed hydraulic indicators include high water table, drainage patterns, and geomorphic position. Commonly identified vegetation includes common reed (Phragmites australis; FACW), Oriental bittersweet (Celastrus orbiculatus; UPL), and northern bayberry (Morella pensylvanica; FAC). Bordering Land Subject to Flooding The Federal Emergency Management Agency (FEMA) flood map (Panel No. 2500 1C0566J, effective July 7, 2014) was consulted to evaluate the presence of BLSF at and near the project - 3 - area. The project area does not fall within an area subject to flooding and/or inundation by the 100-year flood, and therefore is not regulated as BLSF. Rare Species The Massachusetts Natural Heritage and Endangered Species Program (NHESP) Atlas (15th edition, effective August 2021) and MassGIS online mapping tool were reviewed during the preparation of this RDA. According to these sources, the project area does not fall within Priority or Estimated Habitats of Rare Wildlife. Proposed Activities The proposed project consists of maintenance and improvements to the commercial property at 790 Iyannough Road, including repaving of a portion of existing parking lot and construction of new curbs where needed to more efficiently direct and collect stormwater. Additionally, the southern entrance from Airport Road will be reconstructed to improve grades and drainage, and a rain garden will be installed to the east of Wetland 1A that will reduce drainage flow to that area. Additionally, vegetation clearing may occur around the stormwater basin, Wetland 2A to the north of the Project Site. To repave portions of the lot, the existing pavement will be milled using heavy machinery. The ground will then be graded and sloped to improve water drainage and flow particularly in the vicinity of the western entrance off Airport Road. Asphalt will then be poured and compacted using a heavy roller before curing for several hours. Curbs will then be reconstructed and constructed where absent. A stone rip-rap apron will be installed to the east of Wetland 1A that will replace a paved swale. The rip-rap apron will dissipate flow collected via the closed drainage system and will be an improvement to the drainage flow to the former stormwater drainage system. All materials and equipment will be staged on the lot within paved and previously disturbed areas. Protective Measures Wetland resource areas in close proximity to the proposed project area will be protected by a row of erosion control barriers. The erosion control barriers will consist of silt socks. Additionally, inlet protection will be installed at catch basins within the project area. Details of both measures are provided on Sheet C-400 of the Project Drawings. These measures will be installed prior to the commencement of work and will be maintained for the duration of construction and until disturbed areas have restored and stabilized. Regulatory Discussion The proposed work will result in approximately 42,200 square feet (sf) of temporary impacts and 415 sf of new impervious impacts to the 100-foot Buffer Zone. Temporary impacts consist of repaving existing pavement and grading associated with the new entrance off Airport Road. New impervious impacts are associated with new curb edges at both resource areas and the stone rip-rap by the new entrance. Table 2 summaries impacts to jurisdictional resource areas. - 4 - TABLE 2 Summary of resource area impacts. Given the limited open space, maintained nature, and existing site use of the shopping plaza, Tighe & Bond additionally requests waiver from mitigation planting for this miti gation-constrained site. The proposed work will not change the general characteristics of the area and areas disturbed by the proposed work will be restored to pre-existing conditions to the extent practicable. Application Requirements A filing fee of $175 has been submitted to the Barnstable Conservation Commission, and abutters to the project will be notified via USPS Certificates of Mailing, in accordance with the Chapter 237 abutter notification requirements. A copy of the abutter notification form and a list of abutters is enclosed in Attachment E. Summary We look forward to having the opportunity to discuss this project with the Barnstable Conservation Commission at the public hearing on January 31, 2023. We anticipate these materials are sufficient for the Commission to issue a Negative Determination confirming the proposed project may proceed without the filing of an NOI.
