Based upon the following, it is my opinion said lot is a buildable lot for zoning purposes: 1. The lot is located in the RG Residential Zoning District; 2. The current Bulk Regulations for a buildable lot in the RG Residential Zoning District are: Minimum Lot Size 65,000 sq. ft. Minimum Lot Frontage 20 feet Minimum Lot Width 200 feet 3. Lot 6 meets the current Bulk Regulation requirements for a buildable lot(see discussion of Lot Width in paragraph 5 below). '4. Lot 6 was created by a Definitive Subdivision Plan approved on September 9, 2013. In the Notification of Approval of Definitive Subdivision Plan it was noted on page 1 Zoning that"all of the lots meet the minimum lot area, lot frontage, lot width requirements for the district they are located in and all conform to the lot shape requirement. The lots as delineated meet zoning requirements for developable lots:" (See Notification of Approval of Definitive Subdivision Plan with copies of ' Definitive Subdivision Plan attached as Exhibit B). 5. Section 240-128 of the Barnstable Zoning Ordinance allows an owner to "establish his own setback line at a distance greater than required, and the lot width may be determined at the setback line so determined." (See copy of§240-128 attached hereto). This method was used to determine the lot width of Lots 5 and 6 on the plan recorded in Plan Book 651, Page 49 (see Sheet C of the plan attached to Exhibit B). 6. Lot 6 is abutted by, and held in common ownership with Lots 4 and 5 on the plan recorded n Plan Book 651, Page 49. Each of these vacant lots were created by the same Definitive Subdivision Plan Approval and meet the requirements to be a buildable lot in the zoning district within which they lie. 7. The only other abutters to Lot 6 as shown on the Definitive Subdivision Plan are the Town of Barnstable Conservation Commission(see Deed recorded in Book 4939, Page 172 attached hereto as Exhibit C) and the Town of Barnstable Land Bank(see Deed recorded in Book 12866, Page 225 attached hereto as Exhibit D). I have run the title to each of those parcels and there has been no change in ownership to date. 8. Massachusetts General Law Chapter 40A, Section 6 and Section 240-91E of the Barnstable Zoning Ordinance protects lots created pursuant to an approved Definitive Subdivision Plan from change in the Zoning Ordinance for a period of eight (8) years from endorsement. Riley and Kenneth D. Polivy. The plan proposed the division of a 9.24-acre parcel addressed 2519 Main Street(Route 6A), Barnstable MA into a 6 lot subdivision. In October of 2012,an application for Approval of a Preliminary Subdivision Plan was submitted to the Planning Board for the subject property. However, a motion to approval the preliminary plan with modifications and conditions did not carry and approval of the preliminary subdivision plan was not granted. The subject property fronts on Main Street(Route 6A)in Barnstable Village. It is located on the southwest - side of the railroad overpass on Route 6A. The parcel is wooded except for the north-west corner that is developed with a single-family dwelling, built circa 1750(commonly known as the'Elijah Loring Sr. House'). There are historic stone walls defining the perimeter of the parcel and a few scattered inside the subdivision site. 1 The property is bounded by Town Conservation and Land Bank property on three sides. The Barnstable West Barnstable Elementary School is located approximately 62o ft.to the west of the parcel. The property is not within a Groundwater or Wellhead Protection Overlay District nor is it within the Resource W Protection Overlay District. It is not within the Zones of Contribution to Saltwater Estuaries. It is not in a designated Habitat Area of the Natural Heritage Endangered Species Program and not within a Significant Natural Resource Area as identified by the Cape Cod Commission.There are no known wetlands on the site. The parcel is within the Old Kings Highway Regional Historic District and the existing dwelling,'the Elijah Loring Sr.House', is cited as being a contributing building to the District. The Subdivision was assigned No.822,and is commonly referenced as"William A.Riley—Aberle Way". Zoning: The parcel is located in the RF-2 and RG Zoning Districts. The RF-2 District has a minimum lot area requirement of 43,56o sq.ft.and the RG a minimum of 65,00o sq.ft. Lots No.1, 2,3,and 4,are in the 1-acre RF-2 Zoning District and the back two lots, Lots No.5 and 6,are in the 1.5-acre RG Zoning District. Lot No.1 is delineated around the existing dwelling that is to remain. All of the lots meet the minimum lot area,lot frontage, lot width requirement for the district they are located in and all conform to the lot shape requirement.The lots as delineated meet zoning requirements for developable lots. I,' Notification of Definitive Subdivision Plan Approval Subdivision Plan#822—William A.Riley—Aberle Way • Applicant: The Applicants are William A. Riley and Kenneth D.Polivy. The Applicant purchased the subject parcel on August 24, 2012,as evidenced by a deed recorded at the Barnstable Registry of Deeds,in Book 26616, page 245. William A.Riley has a mailing address of P.O. Box 212, Barnstable, MA o2630 and Kenneth D. Polivy mailing address is 12o Gordon Road,Waban, MA 02468. Certification of Plans: The plans were prepared and certified by Daniel A.Ojala Registered Land Surveyor and Professional Civil Engineer of Down Cape Engineering,939 Route 6A Yarmouthport, MA 02675. Mr.Ojala also represented the subdivision application before the Planning Board. Attorney John W. Kenney was also present during the hearings and participated in the presentation. Waivers: In accordance with the Code of the Town of Barnstable,Subdivision Regulations,§801-5 Waivers, the application requested certain waivers from total compliance to the following subdivision regulations: • poi-29(B)Sidewalks conditionally required. The Applicant has requested a waiver from building any sidewalks. The justification citied is that only 6 houses would be served and the road is a short dead end roadway. • 58o1-26(B)(1)Appendix Design Standards,Typical Road Cross Section Minor A. The applicant requested to use those standards for a Minor B Street(a street standard for ways with less than 4 dwellings). The waivers are to reduce the right of way from 50-feet to 4o-feet and to reduce the overall paved traveled way from 22-feet to 18-feet.. Procedural: A public hearing before the Planning Board was duly advertised in the Barnstable Patriot on February 8th and 15th 2013,and notice sent to all abutters in accordance with MGL Chapter 41 Section 81T. In accordance with 58o2-24.E,copies of the application and plans were forwarded to other officials and departments for review and comment. The hearing opened July 22, 2013,continued,August 26,2013 and to September g, 2013 at which time the Board approved the definitive subdivision with the waivers requested subject to certain conditions and restrictions as enumerated herein. Board Members rendering this decision on the definitive subdivision plan were; Paul R.Curley, Raymond B. Lang, Felicia R. Penn, Patrick Princi and Board Chair Matthew K.Teague. During the proceedings Daniel A.Ojala,P.E., & P.L.S., presented an overview of the subdivision plan to the Board. The proposed private way"Aberle Way"is to serve the 6 housing lots. The overall length of the Way is approximately 75o feet and ends with a cul-de-sac.Given the number of lots and the short roadway,the Applicant is requesting waivers to reduce the right-of-way to 4o-feet,the width of the road to 18-feet including a 1-foot Cape Cod berm on each side,and eliminating any sidewalks. Roadway pavement in the Cul- de-sac would be 28.5-feet wide. The road would include an extended base of reprocessed asphalt gravel hardened 2-feet on each side of the paved road to provide solid support for vehicles that may have to maneuver off the pavement. The subdivision and all lots would be connected to the public water supply located in Route 6A. Wastewater would be handled by private on-site Title 5 disposal systems installed at the time the lots are developed. The Board and Applicant clarified that all of the six lots shown on the subdivision plan will be accessed directly from Aberle Way. The Applicant has adjusted the alignment of the pavement of Aberle Way at the entrance 2 . Notification of Definitive Subdivision Plan Approval Subdivision Plan#822—William A.Riley—Aberle Way to Route 6A so as to avoid visual conflicts with an existing utility pole on Route 6A. In addition,the Applicant intends to relocate an existing overhead light closer to the proposed new intersection to the subdivision. The Applicant and/or the Homeowners Association will require private lighting be installed at all future driveways off Aberle Way. A Homeowners Association will be established to assure long-term maintenance of the Way. Old Kings Highway Historic District: On April io, 2013,the Old Kings Highway Historic District Committee approved an application for the removal of two 36-inch caliper Silver Maple Trees situated in the right-of-way of Route 6A. One of the trees must be removed to accommodate the intersection of Aberle Way with Route 6A,and the second is necessary to provide sufficient sight distance. The existing perimeter stone walls are not to be disturbed. Disturbance of the scattered interior stone walls will have to be approved by the Old Kings Highway. Attorney John Kenney stated that the deeds to the lots will notice the new owners that the perimeter stone walls are not to be disturbed and any alteration of interior stone walls must first be approved by the Old Kings Highway Historic District Committee. Aberle Way: Regarding"Aberle Way"(Ah-bur-lee),the following correspondence has been entered into the file: • The Barnstable Fire'Department Chief, Francis M. Pulsifer,approved the road name on May 3,2013. • On May 14, 2°13, Frank Schlegel, Egss Data Liaison determined that the name was acceptable. • A July 22,2013,e-mail from Peter Burke, Barnstable Fire cited that they and Barnstable Water District have reviewed the plans and have no issues with the plans as drawn. The Applicant will need approval of Mass Department of Transportation to install a curb cut on Route 6A and to connect with the utilities in Route 6A. That approval will be sought after the subdivision is approved. Upon the completion of Aberle Way,the existing dwelling located on the parcel will take its access from Aberle Way. The existing driveway onto Route 6A will be closed and the parkway restored appropriately. The Board and Applicant discussed safety issues with the proposed intersection of Aberle Way and Route 6A. Route 6A is posted at 25 miles per hour in this area and the sight distances provided for Aberle Way meet the requirement of the Subdivision Regulations. It was noted that traffic often exceeds the posted speed and the curvature of the roadway limits visibility. The Applicant will improve sight distances on Route 6A by trimming vegetation and installing supplemental new trees set back from the traveled way so as to not interfere with safe sight distances. Thereafter it shall be the responsibility of the Homeowners Association to maintain the sight distances along Route 6A. Easements: The Applicant agreed to create an easement containing the slope retaining wall at the cul-de- sac. That easement would be in favor of the Homeowners Association to assure the retaining wall is protected and maintained. It was determined that the easement on Lot No.2 bordering the Railroad tracks would only be used if Mass Department of Transportation needed it. Athird easement, located on Lot No.4 and labeled"Natural No-fill Overflow Drainage Easement"is an existing natural basin intended to collect any overflow storm water from Aberle Way. That basin is to remain in a natural state and not built-on. Board of Health: The Board of Health has reviewed the subdivision plan and approved it per a July 25,2°13, letter to the Planning Board subject to 6 recommendations. The Applicant has agreed to those recommendations and they are incorporated into this decision(Condition No.17). 3 Notification of Definitive Subdivision Plan Approval Subdivision Plan#822—William A.Riley—Aberle Way Board's Engineer Report: Stephen Seymour, P.E. and Senior Engineer with the Growth Management Department cited in his memorandum of September 5, 2013,that he is satisfied with the proposed development plan and recommended that a Form S—Road Maintenance and Repair be executed. Decision: At the conclusion of the meeting of September 9,2013,a motion was duly made and seconded to approve the definitive subdivision plan entitled"Definitive Plan of Land in Barnstable, MA#2519 Main Street Riley Subdivision"prepared for William A Riley,as drawn by Daniel A.Ojala P.E., & P.L.S.dated June 10, 2013 revised August 27,2o13,and consisting of 5 sheets. • Front page shows the Lasic subdivision of the property identifying the proposed lots and the defined metes and bounds for each lot. The plan defines the proposed Way and drainage easements,and shows the approximate location of existing stone walls. • Sheet B presents the geographic coordinates for the existing and proposed bounds to be set. • Sheet C is a drainage area sketch plan for the roadway and subdivision it includes proposed drainage system and over flow areas and easements. • Fourth page is the Road Profile Plan. • Last page is a Detail Sheet showing a typical road section including the cul-de-sac,drainage and rock retaining wall sections. This approval includes the grant of the following two requested waivers from the Code of the Town of Barnstable, Subdivision Regulations: • §8o1-29(B)Sidewalks conditionally required—by granting the waiver the Planning Board allows the subdivision way to be built without sidewalks as there is no connecting pedestrian infrastructure. • g8o1-26(B)(1)Appendix Design Standards,Typical Road Cross Section Minor A-to allow those standards for a Mi-ior B Street. The specific waivers are to reduce the right-of-way from 50-feet to 4o- feet and to reduce the overall paved traveled way from 22-feet to 18-feet including the 1-foot Cape Cod berm on each side. This waiver is granted with the exception that pavement in the cul-de-sac will be 28.5-feet wide and the added requirement that the road would include an extended base of reprocessed asphalt gravel hardened 2-feet on each side of the road pavement. Regarding the grant of the waivers requested the Planning Board specifically finds that the plan is in keeping with the character of the surrounding area,the roadway design standard approved is adequate for the number of lots being served by the way while the reduced standards maintain the historic rural character of the area. It shall not be built-upon nor shall it be filled. It shall be the responsibility of the Homeowner's Association to maintain the drainage system in operational conditions. 14. An easement shall be created over parts of Lot No.3 and No.5 to surround the proposed slope retaining wall abutting the cult-de-sac of Aberle Way.That easement shall be dedicated to the Homeowner's Association for the perpetual protection of the slope as it is a critical element in maintaining the roadway. 15. The proposed Lots Numbered 2,3,4,5 and 6 created in this subdivision shall be held in covenant as surety for completion of the subdivision including construction of Aberle Way and installation of all utilities. Two fire hydrants must be installed in this subdivision. c. Any lawn area created must be at least four(4)inches of loam. d. All tree stumps,brush and building debris removed when clearing lots or roads must be disposed of at a licensed solid waste disposal facility. Chipping brush and trees stumps is an acceptable alternative. Burial on site is prohibited. e. The applicant must receive an Order of Conditions from the Conservation Commission,if applicable. f.
