The lot also has a 24 by 22 foot, two-car attached,one-story garage and a detached 32 by 24 foot,two-story, one-car garage. The property is located in a Residential F-1 Zoning District and is serviced by public water and a private on- site septic system. The property is addressed 49 Acre Hill Road,accessed off Braggs Lane in Barnstable. It is also located with in the Old King's Highway Historic District. According to the application,the petitioner is proposing to utilize the upper level of the detached as a garage 756 sq.ft.,one-bedroom,Family Apartment to be occupied by their daughter Lisa A Carty and granddaughter Hope E. Carty. The petitioner has requesting a Special Permit for a Family Apartment pursuant to Section 3-1.1(3)(D)of the Zoning Ordinance. Procedural & Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on August 30, 2004. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened October 27, 2004, continued to December 08, 2004; and February 2, 2005, at which time the Board found to grant the Family Apartment Special Permit in accordance with Section 3-1.1(3)(D)of the Zoning Ordinance. Board Members deciding this appeal were,Ralph Copeland, Sheila Geiler,Jeremy Gilmore,James Hatfield, and Ron S. Jansson, Acting Chairman. At the February 02, 2005 continuance, the applicant John Carty presented the appeal to the Board. He noted that the apartment was to be developed in a detached accessory structure and is to be occupied by his daughter and granddaughter. He stated that the unit would be his daughter's principal residence as she would be attending college. Mr. Carty cited that he has read all of the requirements for a family apartment and would abide by all of those requirements. He stated that the dwelling is his primary residence and that he resides on the property year round. The Board questioned the application with respect to the newly enacted family apartment provision that now would permit a family apartment only as an attached unit to the dwelling. It was noted I ' that the application was submitted to the Board prior to the first publishing of the notice of the proposed amendment and that the application could be acted upon by the Board. Public comment was requested and no one spoke in favor or in opposition to the request. Findings of Fact: At the hearing of February 02, 2005,the Board unanimously made the following findings of fact: 1. Appeal 141 of 2004 is that of John and Lucy Cartyseeking a Family Apartment Special Permit in accordance with Section 3-1.1 (3)(D)of the Zoning Ordinance. That section of the ordinance was recently amended to permit family apartments as-of-right. However,the application was made prior to publication of the notice of that proposed amendment and the applicant is therefore entitled to still seek the relief that was applied for. 2. The locus of this appeal is addressed 49 Acre Hill Road,Barnstable,MA. The property is located as shown on Assessor's Map 297 as parcel 070. It is in a Residential RF-1 Zoning District and a Groundwater Protection Overlay District. 3. The applicants are proposing a family apartment unit developed above a detached garage. Plans for the proposed apartment entitled"John&Lucy Carty, Garage Addition"have been submitted to the file. A certified plot plan entitled"Building Plot Plan Prepared for John Carty" showing the location of the structures on the property in conformity to the required setbacks has also been submitted to the file. 4. According to the application, the applicants are proposing to utilize the upper level of the detached garage as a 756 sq.ft.,one-bedroom,Family Apartment to be occupied by their daughter Lisa A Carty and granddaughter Hope E. Carty. The applicants have stated that they understand and will comply with all of the requirements for a Special Permit for a Family Apartment pursuant to Section 3-1.1(3)(D) of the Zoning Ordinance. The dwelling and the apartment unit will be the year round residence of the owner and his daughter who is to occupy the family apartment with her daughter. 5. The applicants are aware that the proposed development of the apartment and its use is subject to compliance with all Board of Heath regulations with respect to the on-site wastewater disposal system. 6. Special Permits pursuant to Section 3-1.1(3)(D)-Family Apartment-are permitted in all residential Zoning Districts provided all criteria are met, and only if this Board finds that the proposal fulfills the spirit and intent of the Zoning Ordinance and would not represent a substantial detriment to the public good or the neighborhood affected. 7. The proposed family apartment fulfills the spirit and intent of the zoning ordinance and would not represent a substantial detriment to the public or the neighbor affected. 2 Decision: Based on the findings of fact, a motion was duly made and seconded to grant the appeal with the following conditions: 1. The applicants shall comply with all of the requirements for a Family Apartment and shall maintain the unit in full compliance with all restrictions of Section 3-1.1(3)(D)of the Zoning Ordinance. 2. Location of the family apartment shall be in the detached garage as shown on the plan submitted,not to exceed 756 sq.ft. in area. The Family Apartment shall be developed and maintained as per plans presented to the Board entitled"John&Lucy Carty, Garage Addition" scale 1/4"=1',dated March 14, 2003. A copy is contained in the file and initialed and dated by the Acting Chairman. 3. The on-site septic system shall comply with all Town of Barnstable Health Division regulations and State Title 5 regulations without any variances from the Board of Health. 4. The locus shall comply with all State Building Code and State Fire Prevention Regulations. The vote was as follows: AYE: Ralph Copeland, Sheila Geiler,Jeremy Gilmore,James Hatfield,Ron S.
