It is in a Residence F-1 zoning district. The property has frontage on Allyn Lane and Matthias Lane. Matthias Lane is a short, private, dead-end street that terminates in a paved turn- around. The principal dwelling was constructed in 1992 and presently conforms to all setback requirements in the district. Procedural&Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on April 12, 2011. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened June 8, 2011, at which time the Board found to grant the variance subject to conditions. Board Members deciding this appeal were Board Chair Laura F.Shufelt,Alex M. Rodolakis, Craig G. Larson, George T.Zevitas, and Brian Florence. Chris Childs of Patriot Builders represented the Applicants before the Board. Mr.Childs explained the relief requested. He stated the property was a corner lot,which required them to conform to a front yard setback along Matthias Lane which is a short, dead-end private road. He pointed out there are historic stone walls on the property that surround the dwelling that cannot be removed or altered. There are also old growth trees that require review to be removed. Mr. Childs stated the Applicants explored placing the addition over the existing patio; however multiple roof lines of the existing dwelling would have to be altered, creating a financial hardship. In Appeal 2011-028, the Applicants are seeking relief from the 30 foot front yard setback required in the RF-1 zoning district. The proposal is to construct a 15'by 14'2"addition to an existing single-family residential dwelling. The proposed addition would encroach into the required 30 foot front yard setback by 8'1" 2. The subject property, located at 66 Allyn Lane and shown on Assessor's Map 258 as Parcel 073, is a.82 acre corner lot located in Barnstable, north of Route 6A. The property has frontage on Allyn Lane and Matthias Lane. Matthias Lane is a short, private, dead-end street that terminates in a paved turn-around. 3. There exist circumstances related to the shape and topography of the land and structures located at 66 Allyn Lane in Barnstable,and especially affecting Y such land and structures, but not generally the zoning district in which it is located. There are stone walls and old growth trees on the property that limit expansion of the dwelling. The lot is a corner lot and is required to conform to front yard setbacks along Allyn Lane and Matthias Lane. 4. A literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship,financial or otherwise to the petitioner.
