It is vacant with the exception of a foundation which was recently put in place on the high point of this site. The applicant is in the process of building a single-family, ranch style residence on the property and was issued'a building permit(No. 26097). The property is located in a RF-1 Residential F-1 Zoning District which requires a minimum 30 foot front yard setback. However,the foundation was constructed only 26.3 feet from the front properly line. The applicant would like to leave the foundation where it is and is, therefore, requesting a Variance from the minimum front yard setback requirement. The applicant is seeking a Variance to Section 3-1.3(5) Bulk Regulations, in order to allow a single-family residence to encroach approximately 3.7 feet into the minimum 30 foot front yard setback required on the subject property. The property is located in the Old King's Highway Regional Historic District. The proposed residence was originally approved by the OKH Historic Commission on October 6, 1998. On September 17, 1997, and again on April 15, 1998, OKH approved changes to the design of the proposed residence, All of these approvals were for a residence situated 80 feet from the front property line. Attorney John Alger represented Raymond Caterino,who was present, The subject property is located in the Old King's Highway Historic District. The proposed residence was originally approved by the OKH Historic Committee on October 6, 1998. However, since that time the proposed location of the house on the site has changed. The Board asked Mr. Alger if this new location has been before Old King's Highway. Mr. Alger responded that the applicant has not yet been back to OKH, and if the Board would like him to seek Old King's Highway's approval first, then he would like to continue this appeal. The Board unanimously decided to continue Appeal Number 1998-95 to November 04, 1998. Board Members hearing this appeal at the continuance on November 4, 1998 were Richard Boy, Gene Burman, Elizabeth Nilsson, Torn DeRiemer, and Chairman Emmett Glynn. Attorney John Alger represented the applicant, Raymond Caterino, who was present. Attorney Alger explained that a building permit was obtained to build a single family home on this site. Mr. Caterino is the applicant/owner/contractor, and he measured incorrectly when he poured the foundation, The certified plot plate sites the foundation at 30.9 feet at one end and 26.3 feet at the other. Therefore, the foundation is 3.7 feet too close to the lot line which is why he is seeking a Variance. The site complies with all ether zoning requirements of the district. On September 23, 1993, a Certificate of Appropriateness was approved by the Town of Barnstable Old King's Highway Historic District Committee for the proposed house at this location. As to Variance conditions, pursuant to Chapter 40A Section 10, Attorney Alger reported the property drops off drastically in the rear-at least 30 feet- and the foundation could not be moved back because of feet would be a substantial that slope. To tear up the foundation and move it back approximatelyfour financial hardship and would deiay the building of this house. This lot is unique because a great amount of fill would be needed to move the foundation back any further on the lot. This is not typical of other lots in this area. The relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance because the house will line up with other houses on either side of the street. Attorney Alger indicated the direct abutters were in attendance at the Old King's Highway Historic District Committee Meeting and reported they were not in opposition to this location. No one has called or written in opposition to this location. Public Comments: No one spoke 41 favor or in opposition to this appeal. Findings of Fact: At the Hearing of November 4, 1998, the Board voted on the following findings of fact as related to Appeal No. 1998-95: 1 The petitioner is Raymond W. Caterino. The property address is 50 Althea Drive, Cummaquid, MA as shown or Assessor's Map 334, Parcel 042 and consists of a 1.34 acre lot. There are single family residences located to the east,west and south, across the street, from the subject property. 2. The property steeply slopes down toward the rear of the site causing a topographical hardship in the land. 3. The site is located in a RF-1 Residential F-1 Zoning District which requires a minimum 30 foot front yard setback. Part of the foundation was constructed only 26.3 feet from the front property line,which is 3.7 feet less than is required for this zoning district, The applicant is seeking a Variance to Section 3-1.3(5) Bulk Regulations, in order to allow a single-family residerica to encroach approximately 3.7 feet into the minimum required 30 foot front yard setback. The other side of the foundation is 30.9 feet back which is within the setback requirement. 4. A literal enforcement of the provisions of the Zoning Ordinance would involve substantial financial hardship if the applicant were required to move the foundation back four feet especially in view of the fact that there is no opposition from the neighbors affected. 7.
