DEFINITION OF HOMEOWNER Person(s)who.owns a parcel of land on which he/she resides or intends to reside,on which there is,or is intended to be,a one or two- family dwelling,attached or detached structures accessory to such use and/or farm structures. A person who constructs more than one home in a two-year period shall not be considered a homeowner. Such"homeowner"shall submit to the Building Official on a form acceptable to the Building Official,that he/she shall be responsible for all such work performed under the building permit. (Section 109.1.1) The undersigned"homeowner"assumes responsibility for compliance with the State Building Code and other applicable codes,. bylaws,rules and regulations. HOMEOWNER'S EXEMPTION � The Code states that: "Any homeowner performing work for which a building permit is required shall be exempt from the provisions of this section(Section 109.1.1-Licensing of construction Supervisors); provided that if the homeowner engages a person(s)for hire to do such work,that such Homeowner shall act as supervisor." Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor (see Appendix Q,Rules&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in serious problems,particularly when the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor is ultimately responsible. To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit application,that the homeowner certify that he/she understands the responsibilities of a Supervisor. On the last page this issue is a form currently used by several towns. You may care to amend and adopt such a form/certification for use in your community. Atlantis specifies a stabilizer to be used on spans over 4'which may allow your system to meet the code with cables at 3" oc. I believe that component is pre-drilled at 3" oc which would mean it should work as installed per their instructions. I was planning on using 4x4 mahogany posts that are on four foot centers and a 2x6 mahogany top.rail either over the top or post to post with a 2x4 mahogany stiffener under the top rail. Manufacturer calls for 3" centers on the cables but if you want me to use 2-3/4" centers I will do that instead. Shepley's carries the Atlantis Rail system and is what I was planning on using. Their web site is www.atlantisrail.com for more info and examples. If you think the "spreaders" are needed in between the posts I will do that too. Historically, a system as drawn on your plan will not pass the inspection. Most systems require a ridged top rail, a maximum horizontal span of 4' between posts, spacing the cables a maximum of 2 3/4" o.c. and installation of intermediate ridged"spreaders". However, different manufacturers use different cables and tensioners. Also, many systems have failed if the cables have been installed at 3"o.c. This information is being provided to eliminate your having to redo the rail system. Please provide more information about the type of cable rail system you will be using.
