The subject lot is an 0.11-acre lot(5,065 sq.ft.), developed with two, one-bedroom, cottage dwellings, totaling approximately 440 sq.ft. The structures date to the 1940's. The lot was created in 1932 by a plan entitled; "Plan of Lots at Barnstable as Surveyed for George Cobb"recorded at the Barnstable Registry of Deeds in Plan Book 45 page 135. The lot being shown as Lot No. 37 on that plan Demolition and reconstruction on a lot of less than 10,000 sq.ft.requires a Special Permit from the Zoning Board of Appeals pursuant to Section 240-91.H(2). Within that permit, the Board can also provide for the new building setbacks to be"equal to or greater than the yard setbacks of the existing building". Procedural &Hearing Summary: This appeal was filed at the Town Clerk's Office and at the office of the Zoning Board of Appeals on September 21, 2006. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened November 15,2006 at which time the Board found to grant the special permit subject to conditions herein. Board Members deciding this appeal were,Randolph Childs,Daniel M. Creedon,James R. Hatfield,John T.Norman, and Chairman, Gail C. Nightingale. Attorney Meredith K.West represented the applicants during the hearing. Also present was Chris Childs of Patriot Builders. Attorney West described the proposal to demolish the existing dwelling on the lot and rebuild one single-family dwelling. She cited that the new dwelling would be a modest, Cape Cod style home of less than 1,500 square feet. The structure would fully conform to the requirements of the • Town of Barnstable-Zoning Board of Appeals Special Permit Decision and Notice-2006-098—Martin Ordinance for the Special Permit. The only nonconformity noted was a slight infringement of the fireplace and its chimney into the side yard setback. Findings of Fact: At the hearing of November 15,2006,the Board unanimously made the following findings of fact: 1. Appeal 2006-098 is that of Todd and Mariah Martin seeking a Special Permit pursuant to Section 240- 091 H(2) of the Ordinance for property addressed as 14 Bay View Road,Bamstable,MA. The lot is shown on Assessor's Map 319 as parcel 039. It is in a Residence B Zoning District. The permit is sought to demolish the existing buildings located on the lot and rebuild a new single-family dwelling on the lot not in conformance with the current setback requirements. 2. According to the Assessor's record,the subject lot is a 0.11-acre lot(5,065 sq.ft.), developed with two, one-bedroom,cottage dwellings. The cottages measure approximately 22 feet by 10 feet for a total area of approximately 440 sq.ft. 3. The lot was created by a 1932 plan recorded at the Barnstable Registry of Deeds in Plan Book 45 page 135. The Assessor's record indicates that the structures were built around 1940. Therefore,the subject lot is a pre-existing,legally created,non-conforming lot. The dweh1 g(s),having been built in 1940, would have conformed to the zoning at that time as setback requirements were not enacted until after 1949. Therefore,the existing structures are pre-existing legally created,nonconforming buildings. 4. The proposed new dwelling is to be a four-bedroom,two-bath, 1 &3/4-story cape style structure measuring 28 feet by 29 feet. According to the engineered site plan,the structural footprint is to be 904 sq.ft.or 17.8% of the lot. The total gross area of the structure is approximately 1,498 sq.ft. The dwelling is to be positioned 8.2-feet from the northern property line where a 10-foot side yard setback is required.All other setbacks have been met. The proposed 8.2-foot setback would be in greater conformity than that of the existing setback to that property line which is 5.8-feet. 5.
