Map 319 parcel 31. They seem to constantly have water in crawl space basement, so they have a sump pump running. Conservation was made aware by Don Anderson (617- 416-4394)just days prior to Martin leaving. We spoke briefly with Brian about it, back then. One of our Commissioners saw the site while visiting the property next door, two days ago. Described the site as a complete mess. It could be they are not containing the water onsite sufficiently. Ed and I will be looking at this under conservation as well to see if it is ending up going into the isolated wetland on the abutters property. I looked at it a week ago but did not see a Conservation violation.Their DEP permit is still open for a few more years, so they have time to install the gutter downspouts/drip trench, as far as Conservation is concerned. I am not sure if the standing water in the crawl space is a building department concern. Attached is the complaint record, if you need the details. The subject property is located at the bend of Bay View Road and Sunset Lane, one lot away from Barnstable Harbor. The existing cottage sits 1.6 feet from the property line and adjacent to a beach access right of way. The owner recently purchased this lot and sought to construct a new dwelling complying with the required setbacks. According to the Assessor's records, the cottage was constructed in 1948 and is served by water and sewer. Procedural & Hearing Summary Special Permit Application No. 2016-033 for the demolition and rebuilding of a dwelling on a " nonconforming lot containing less than 10,000 square feet was filed at the Town Clerk's office and office of the Zoning Board of Appeals on September 18, 2016. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters and interested parties in accordance with MGL Chapter 40A. The hearing was opened on October 12, 2016 at which time the Board found to grant the special permit subject to conditions. Board Members deciding this appeal were Brian Florence, Matt Levesque, Robin Young, Spencer Aaltonen, and Jacob Dewey. Dan Ojala of Down Cape Engineering represented the Applicant before the Board. Mr. Ojala presented the proposed plan to the Board, reviewing how the proposal met all of the performance standards. He discussed the proximity of the dwelling to the isolated wetland and affirmed they had received Conservation Commission, approval. The Board discussed the possibility of adding landscape screening to the southern property line and Mr. Ojala agreed to communicate with the neighbor and add landscape screening. The Board Chair requested public comment and a letter from an abutting property owner was read into the record. Findings of Fact At the hearing on October 12, 2016, the Board unanimously, made the following findings of fact in Special Permit Application No. 2016-033, a request to demolish and rebuild a single-family dwelling: Town of Barnstable Zoning Board of Appeals.-Decision and Notice Special Permit No. 2016-033-Drago 1. In Application No. 2016-033, Mark Drago sought a special permit proposing to demolish an existing 640 square foot cottage and construct a 2,712 square foot, four bedroom single-family dwelling on 9,293 square foot lot. 2. The subject property is located at 90 Bay View Road, Barnstable MA as shown on Assessor's Map 319 as Parcel 031. 3. Section 240-91(H)(3) allows for the complete demolition and rebuilding of a residence on a nonconforming lot containing less than 10,000 square feet by Special Permit. 4. Site Plan Review is not required for single-family residential dwellings. 5. After an evaluation of all the evidence presented, the proposal fulfills the spirit and intent of the Zoning Ordinance and would not represent a substantial detriment to the public good or the neighborhood affected. The proposed dwelling will be in compliance with required setbacks and will be in keeping with the character of other dwellings in the neighborhood. 6. The building setbacks will comply with all required setbacks, including the requirements of the Residence B Zoning District. 7. The proposed floor-area ratio is .27; the maximum permissible FAR is 0.30. 8. The proposed lot coverage is 19.3%; the maximum permissible coverage is 20%. 9. The proposed ro p p height e ght is 19 feet to top of plate and the proposed dwelling is 2 stories; the maximum permissible building height is 30 feet to the highest plate and 2'/z stories. 10. The total lot coverage of all structures on the lot shall not exceed 19.3% and the floor-area ratio shall not exceed .292. 4. The proposed redevelopment shall represent full build-out of the lot.
