All workmen are covered by Workmen's Compensation Insurance, and we also carry Public Liability, Automobile Liability, and Property Damage insurance on all projects. Customer, by accepting this proposal, agrees to assume responsibility for the protection against damage of personal property and the property interior during construction, and agrees to hold SingleSource Roofing Corporation harmless for any such damage, unless the damage is a result of gross negligence by the Roofing Company. Oral or other arrangements not appearing on this agreement will not be recognized. All collection fees, attorney fees, court costs, or any expense involved in the collection of these charges, and the collection of any non-warranted service work that is performed throughout the warranty period, will be borne by Building Owner. Any claim or dispute involving Owner's payment obligations shall be determined at Roofing Company's option, by recourse to the state of federal courts located in Pittsburgh, Pennsylvania, and Owner hereby consents and waives all objections to personal jurisdiction and venue in those courts. A finance charge of 1 112 % per month (18% per annum) charged on past due accounts and past due non-warranted service. Following are our terms of payment for work to be performed: ❖ Payment of 50% of the contractual amount due at project commencement. ❖ Progress payment of 40% due at project completion level of 90%. ❖ Payment in full due upon project completion. Remedies for Nonpayment:. These services will include roof inspections two times per year and an accompanying report identifying any issues that, if left unattended to, could negatively impact the new roof investment. After the first full year of providing these services, the PMA may be cancelled by written request from the building owner or their representative to the Account Service Manager for SingleSource Roofing listed in this contract. After the first year, an invoice will be automatically generated and sent to the owner for the continuing PMA service. The invoice will be sent each year in January and will be due within 30 days. The charge for the PMA Service is $0.03 per square foot of roof area. • There is a bi-annual inspection and several inspection items are listed below: • Visually inspect the roof, paying close attention to the following: • Cap Flashing • Edge metal • Base Flashing • Penetrations • Penetration Pockets • Field of Roof • Membrane Fasteners Membrane Seams • Roof Adhesives • Traffic or Damage Patterns • Perimeter Walls that may have voids or cracks allowing water to enter behind the roofing system. • Caulk, seal and make minor repairs to areas not related to the PVC system(these repairs are meant to be maintenance and not to repair larger existing problem areas). • Clean roof of debris such as glass, screws/nails, tree limbs, vegetation, etc., that could cause damage to the membrane (this does not include large debris such as abandoned or unused rooftop equipment, trees or large tree limbs). ,I IV. If there is an increase in the price paid by Roofing Contractor for steel, polyisocyanurate or petroleum-based consumer products, the amount of the proposal/contract shall be similarly increased to reflect the increased costs to obtain the materials.
