Dillinger, the Trustee of 1878 Cobble Stone.:Road; Realty Trust, who is the owner of the property located at 174 Cobble Stone Road, Barnstable, in the RF-2 zoning district. I attach for your convenience a copy of the information sheet from the Assessor's Office (Exhibit 1), as well as a copy of an Approval Not Required Plan, the "ANR Plan",recorded in Barnstable Registry, Plan Book 379,Page 99 (Exhibit 2), whereon the property is identified as Lot 90. Ms. Dillinger currently has the property under a Purchase & Sales Agreement, however, the buyer is questioning the buildability of Lot 90 for reasons not entirely clear to me, and has requested that we obtain a letter from your office attesting to buildability under the Zoning Bylaw. I understand you provide such letters where the issue is common ownership, but that is not the case here. The property has been held in ownership separate and apart from any abutting parcels, since April 7, 1983, the date on which the then owner, Holly Moore, conveyed Lot 90 to Gilda Dillinger, Christine's mother. This also happened to be the very date on which the ANR plan was recorded. Enclosed is a copy of the deed into Gilda(Exhibit 3). I am aware the creation of a lot pursuant to an ANR plan does not constitute certification of zoning compliance for the lots shown thereon, however Lot 90 complied with the dimensional requirements of the Bylaw when created viz. minimum lot size (upland) 43,560 sq. ft., and frontage, 150' and continues to comply with the dimensional requirements under the current Bylaw, as well. The only changes are that the Lot is now located in the Resource Overlay Protection District (ROPD), as well as the Aquifer Protection District (AP), neither of which operates to prevent building on Lot 90. . - -- - - - - 11Page Mr. Brian Florence September 27, 2017 Page 2 Owing to the lowlands delineated on the ANR Plan, any construction on the property will require an Order of Conditions from Conservation. Clearly there is sufficient area for construction of a residential dwelling.
