DEFINITION OF HOMEOWNER Person(s)who owns a parcel of land on which he/she resides or intends to reside,on which there is, or is intended to be, a one or two-family dwelling, attached or detached structures accessory to such use and/or farm structures. HOMEOWNER'S EXEMPTION The Code states that: "Any homeowner performing work for which a building permit is required shall be exempt from the provisions of this section(Section 109.1.1 -Licensing of construction Supervisors);provided that if the homeowner engages a person(s)for hire to do such work,that such Homeowner shall act as supervisor." Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor(see Appendix Q, Rules&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in serious problems,particularly when the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor is ultimately responsible. To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit application, that the homeowner certify that he/she understands the responsibilities of a Supervisor. On the last page of this issue is a form currently used by several towns. A public hearing, duly noticed under M.G.L. Chapter 40-A was opened, held, closed and a decision rendered by the Board on April 6, 1994. The petition was heard by Board Members Rick Barry, Betty Nilsson, Emmett Glynn, Gail Nightingale and chairman Richard Boy. Background Information: According to the Assessor's Records the lot is located in Barnstable Village, at 40 Commerce Road, consisting of 0.22 acres, containing 1,384 sq.ft. and a one and a half story single-family dwelling. The structure, originally built in 1920, contains 2 bedrooms, 1.0 bath and has public sewer and water, and gas utilities. The applicant is requesting a variance to allow the construction of a new accessory structure referred to as the `barn' located within the required 10 foot setback. The new structure is to be located 1.8 feet from the property line as established by the existing garage structure. Old King's Highway Historic District Commission has approved a Certificate of Demolition for the garage structure and a Certificate of Appropriateness for proposed barn structure. Public Hearing Summary: Mr. Anderson explained a plan to construct a two story, 30, by 32' barn on the Northeastern corner of his land on the footprint of the existing garage which will be removed. 1 Appeal No. 1994-26: Anderson Decision: Variance -Bulk regulations; Min. Rear Yard Setback Mr. Robert Johanson (his neighbor) spoke. He wants Mr. Anderson to move the • building away from his yard as it is now only "eight inches" from his property line. Mr. Boy asked if the proposed barn could be moved on the lot to conform to zoning. Mr. Anderson said yes but he wanted to do it according to the plan presented and added that the second floor of the "barn" would be used for storage and eventually, for his aging parents family apartment. Mr. Boy cautioned he did not see a hardship, no variance conditions existed, the garage is in violation as it is and asked why the Board should compound the violation by approving this appeal. Betty Nilsson maintained the proposed accessory building as larger than the existing main dwelling by 530 feet. Mr. Boy asked for Public Comment and beside Mr. Johanson, no public comment was forthcoming. Finding of Facts: Based upon the evidence submitted and testimony given at the public hearing, the Zoning Board of Appeals unanimously finds as follows: 1. No Variance conditions exist as shown or presented. 2. No hardship conditions have been presented. 3. No reason has been presented as to why Mr. Anderson could not conform to the Zoning requirements. 4. It would be detrimental to the neighborhood. Decision: Accordingly, based upon the findings, a motion was duly made and seconded that Appeal No. 1994-25 for a Variance to Section 3-1.1(5), Bulk Regulations, minimum rear/side yard setback to allow construction of a new accessory structure (`barn') located within the required 10 foot setback be denied. The vote was as follows: AYE: Rick Barry, Betty Nilsson, Emmett Glynn, Gail Nightingale and Chairman Richard Boy. NAY: None. Order: Appeal No. 1994-25 for a variance is denied.
